    Actually, that doesn't sound too bad. The reason I was interested is related to a powered subwoofer that I have that has minor damage to a rear corner. Since it is flat black instead of gloss, it doesn't sound like fixing it would be difficult.

I don't know what you people want me to do. Just GIVE the money back because of a Fedex error. Well that won't happen, unfortunetely I'm not rich. You saw the damn speakers in the before and after picture it obviously happened AFTER the shipping. Not to mention the corners of the boxes. Look at how they are all dented and busted open, it's not like Fedex would have shipped them in boxes in that bad of shape. Use some common damn sense. So I will say this again one last time and I mean it. And please make all the smarmy comments you want because I really just don't give a ****. You don't know jack anyway. Apparantly you can't read plain damn English. I mean I only posted this about 10 times.

    Hmm, Well? Bubblewrap - one time. No stuffing, or NETHING? WELL? WTF! Dude, Packing something well, 1,000 dollar item. 50 pounds+ each speaker. Try, double foam, double box, and bubble wrap. Bubblewrap dosnt cut it. Its none of our business, true that, however that is a mess.

I shipped a speaker, indeed it was FED EX's fault.. and i to "thought" it was packed well enough, I also am not rich and couldn't pay the money asap. However i acknowledged the problem, did all the claim work and got his refund... This isn't to bring up past stuff, But ive been there and learned and know!!!!!!!!

    Take it from me and do the claim and do the right thing, its very easy to do, it involves showing proof of the value you paid ie: e-bay ended auction, the value you sold it for, filling out the claim form found on fed ex's website and faxing it to them.. go to www.fedex.com and look under claims, or insurance...

    enough of the name calling.. these people aren't stupid.. they see things, they do research, they weed out people just like you and all in the name of helping the rest of us..

    You obviously know very little about the legal responsibility of a seller of goods. Be glad that this is a long distance transaction because I assure you that were this to go to court YOU would lose.

    YOU sold the merchandise and it was your responsibility to get it to the buyer in good condition.

    YOU packaged the merchandise.

    YOU hired the shipper.

    YOU received compensation for the items sold.

    In this case it is YOUR responsibility to take back the speakers for the price that was paid and it is YOUR job to go after Fed EX for the damage they caused since YOU hired them. This isn't about being a nice guy...it's about taking care of your legal responsibilities.

    So the query you posed was:

    Your business transaction was conducted on a public forum, as such it is our business. We pride ourselves on being honest and fair with each other in our business dealings here, often selling items much cheaper than they are worth just to allow a brother to share in the insanity called audio. When a deal goes south for the reasons yours did, it is the sellers responsibility to make it right, PERIOD!!! If you really did have these insured, then file the claim and make this deal right. Quit defending the way you packed the speakers, they were not packed well enough to withstand shipping them. Let me make that as plain as I can, it is not a FedEx error,

    YOU DID NOT PACK THE SPEAKERS WELL, IT IS YOUR FAULT!!!

    It's one thing thinking FED ex might of been rough with the speakers, its one thing, you might not have packed them good enough, But regardless you have to own up to something and atleast take the steps, talk to him, make him payments, do the damm claim, what ever!! But pay him..

    he seems like a nice guy and understanding, i am sure he would work with you.. you don't even want to talk about it!! Not saying he should "work with you" or you deserve a payment plan, But it would be better than, "Piss off im not paying him" type attitude

    Regardless of your packaging vs. packaging received. I have an in-law that worked for UPS. He's told me some stories by golly.

    "IF" it was insured, then file the claim already.

    "IF NOT" and it is just an honest mistake then you deserve to be called plenty of things. Not thief mind you, but idiot or fool are a minimum. You learn from your mistakes. What a better way to learn than to atleast offer some $ compensation to the buyer. He could probably take them somewhere and have the dings removed and relaminated. No need for new cabinets or drivers, but come on. Maybe you can agree on a figure that meets half way. After all he got a deal and probably didn't include "PLEASE INSURE THESE LARGE, HEAVY AND EXPENSIVE SPEAKERS." on every communication. Most people wouldn't.

    Either way. I think you need to do SOMETHING and quickly. If you've been reading this thread (or others) then you know the issue and can understand the result it has had on this site. It boads badly and wouldn't be suprised if "The Flea Market" is stopped. This is where most of the HOS comes from and Polk doesn't make any money off it. I'm sure it's being watched and a sigh of relief from them would be beneficial to all.

    Remember. All people have a degree of integrity. It's the trust that matters the most. It's hard to get and easy to lose.

    Edit: The whole Bingo reference was in response to faster's 12:36 post. It took me awhile to do, but the rest remains current.

    Think back to your early participation, before all this occurred. Were you not developing a feeling of ownership as well?

    At the start of this deal gone sour, you gave us half a chance to be sympathetic to your end of the situation and many, if not all, of us were. We offered you things you could try to do to work this out. But we have seen no evidence of action by you. And our sympathy fades…

    Instead we learned how you came by the speakers and what they cost you. We learned that you profited. And our sympathy fades…

    You said you felt pressure to ship the speakers. You then shipped them in haste. I know from first hand experience that haste and pressure are both part of the price of procrastination.

    I believe you are feeling pressure right now, but the source is different. If I am right in that belief, that tells me you have a conscience that is not at peace right now. Nor will it be anytime soon if the only action you take is to post the occasional angry response here.

    If, as you now say, the shipment was insured, file the claim tomorrow. If, as you said before, you thought it was insured, tomorrow visit the FedEx location that accepted the speakers and make your case. Either way make tomorrow the day you begin to work towards the resolution of this problem. And our sympathy will cease to fade…

    I feel sorry for you Janusch. I think we all really need to be careful when it comes to purchases here in the flea market. You never know what you'll get..epecially when you cannot see past transactions and comments from other buyers (like on Ebay). I think we all should pitch in some money for Janusch, and even though I'm sure we won't accumulate the full amount, I think a little will help. Whatch guys think? You got paypal Janusch?

    First things first. I don't think we're done yet with this buyer/seller transaction. I'm not giving a dime and nor should anybody else that is outside of the actual transaction. The results of the facts will lead to a conclusion. There are a few variables that have yet to become facts.

    Very simple what you need to do.

    In order:

    Refund Janusch the money to fix the speakers or whatever it takes to fullfil your obligation. Without delay. This is your responsibility. Period, end of story.

    File the damn claim, what's it been, a month?

    Take your sunny disposition someplace else. IMO, a greedy person who refuses to take responsibility for his actions isn't welcome as far as I'm concerned.


    Just so we are clear, I will be on you like a rash on the forum until you do hold up you end. I may be ignorant, I may be a **** and I may not be able to read English but I DON'T screw people because of my own negligence and laziness. Chew on that.

    Like I said you don't know jack. I'm already in the process of trying to get reimbursement for the speakers from Fedex. And I don't see how thats any of your business in the first place. So you need to think twice before you just go calling people negligent and lazy. Because you do not know me.
    So you can be on me like a rash all you want because like I said before I don't really give a damn. So please do, I welcome it. But remember you don't own this forum and all your childish insults only make me want to set up camp here and NOT be nice and help anyone.

    So I'll tell you what. I was planning on giving any claim money I got to Janusch for repairs. But you make one more smart ****, immature comment and any money I get back from Fedex will go right into my bank account. All because you don't know how to contain your fat mouth and know it all attitude.

    Lesson: Don't cast judgement and opinions when you don't even know whats going on. It makes you look like an ****.

    You are right in that you and Janusch are the only two with a critical need to know on the dealings. However, as the sale took place and the problems surfaced in our public forum, we feel involved as well. As such we do appreciate updates.

    What people know is what is posted. You posted the sale here, so YOU are the one who made it public. You could have immediately said that you were on top of the damage claim.. you could have said "damn, sorry that happened.. let's get this worked out!" You could have done myriad things that would have shown your concern.. and you failed on all counts. Whether you continue to post in the future is up to you and the Polk moderators. But I can tell you one thing... you can save your time and effort ever posting another "for sale" here. You won't get a nibble from regulars, and newbies will be warned.

    This is a cleaver way to try and turn the forum and the attention off himself and onto TRoy or who ever has made statments in this post.. REST assured we know better and this will not happen, Either you want to pay the refund or you don't.. anyways The speakers will have to be inspected and possibly go back to E-tool.. with these few statements i don't think i would let the speakers leave and depend on him sending the refund, no way!!!

    Edit: And anyway, why would fed ex give you anything considering you made the mistake in packaging? The packaging you provided wouldn't pass their requirements anyway. And even if they do pay, they will send directly to the buyer, unless you shipped air in which case they send to the seller. It is all right there on the claim forms. Don't you have a copy of them?

    Didn't you guys ever stop to think "why would he even still be posting here unless he is trying to make things right". Well I'll tell ya, it's not because I need to justify anything. No offense, but I could care less about what anyone on these boards thinks of me.

    All I am concerned about is hopefully getting Janusch some money back from Fedex. Not posting updates every 5minutes just to keep nosey people off my back. And certain people won't shut the hell up and stop judging me for long enough to get anything settled. And that is really annoying.
    For the record I wasn't serious about not giving Janusch any of the claim money. I just wanted TroyD to STFU, because that childish hot headed attitude of his has caused controversy here before. And it's not cool. I'm sure I come across as the biggest jerk in the world here and I don't care because I might be.

    You know I read this thead and I have mixed feeling about it.

    I think some of you **** should calm down and let them work it out.

    If he didn't take insurance for the ship,then thats all him,thats a big risk.

    I have sold alot of stuff to alot of you in here and had great experiences except with one.My beautiful Bello rack got damaged in shipping to Reeltroubles home.UPS packed the rack as I didn't have the orginal boxes anymore and wanted them to pack it as I felt it was the right thing to do.I spend a butt hole amount of money to ship and pack.They broke dented and scratched a couple parts,some came though just fine.Well I had Insurance on it,as I do with every single thing I have sold just in case.He took pic's of everything and called UPS upon delievery as they just dropped it off in his backyard.

    This is between Reeltrouble and myself.We are working it out with UPS.I made the claim and they are going to cut a check for the value of the rack.Sad part is the fact that it's going to take a couple weeks.I don't know why it has to take so long but thats what they do........go figure.

    My feelings is that Reeltrouble got a killer deal on a beautiful rack and it got trashed during shipping.I feel so bad about it.I thought I did everything on my side to make the ship go right.I also felt that UPS was the place to go since they bought Mailboxes ETC which is who packed my rack.

    I really hope THEY can work this out between them.......I know all about effed up wango.........and now this dude but he hasn't been in here long enough to jump all over him.I don't think it's right.I don't think this entire thead is right.

    Well lets all walk away then. The seller doesn't feel any obligation in this matter and wishes the thread would end anyway. So what if a fellow member looses a grand. I mean what is a grand. Certainly not enough to get any of us worked up. We can all afford to loose that measly sum and none of us really cares if each other gets ripped or not.     I endorse your tone down plea at this point. And I think it's doable now that we know that e-tool has initiated steps to set things right. Those of us PM-ing about the “15-fund” had already come to that conclusion.

    Your deal with RT was private all the way, but even had it been public, there would have been no uprising. Why? Because you are a known quantity in this forum and whatever members think of your opinions, no one would ever have a doubt that you would set things to right.

    This case was public from the start and appeared to be going badly. What we knew was being amplified by what we did not know. Add in that we don’t really know e-tool, and, being human, in the absence of information, we assumed the worst.

    Anyway we now have both the information and a reasonable hope for a positive resolution.

    I know all the history of bad deals around here,I saw most of them live happen in here.It's unfortunate.

    sometimes dealing online is tuff.Shipping companies hire people who for the most part don't give 2 **** about there job and handle packages like trash.I seen this from the inside as I worked for UPS when I was in college.

    Re read my post if thats what your angry about.They meaning the 2 involved should work it out.If they don't and eulogyt00l stiffs Janusch then at very least he should be banned from the forum......

    I'm not angry about your post. What I am is annoyed about three aspects of this deal.

    1: A mistake in judgement was made about how to package these speakers. When the idea bombed, it is made to look like the fault of the shipping agency and is left to them to pay. If they don't pay, well, there will be no payment. That is pure bull.

    2: The speakers were advertised as "open box speakers" when originally purchased by etool. He advertised them as "NIB". (and then didn't even supply the box). There is a big difference. I'm sure the original seller could have demanded a higher price if he were willing to S-T-R-E-A-T-C-H the truth like this.

    3: When defending himself he stated that he paid $25 for new boxes. When received by the buyer the boxes used were marked "golf clubs" and such.



    I don't like deception or lack of responsibility whatever the reason. He eff'd up and should be willing to accept the speakers back with a refund or pay to get them fixed, let alone make a profit.

    In essence, what does fedex have to do with this.

    I agree with all of your points but one.When you ship something for someone,it should be handled with care.If it was packed badley,they should have said something or not excepted the cargo.Shipping companies need to improve.I have had alot of things broken in the past.UPS does take responsability for all there mistakes.They don't seem to have time for bull.
    I don't deal with FED ex very often.

    I'm gonna sit back and just watch from here on out.I really don't have much more to add.I just hope all parties get taken care of.


    Lastly might be the wrong time to point out but the Lsi15's are trashed,maybe good for some parts.

    Since it was stated that they were still in the original boxes and only one was open, just to take the picture. What happen to the original boxes? I still have a hard time with them being sent out on the 19. They did come with the warrenty cards. This has not been a very easy purchase.

    I (my husband) have done other purchase after this one from this site - So far they have turned out very well.

    OK, here is MY take on it.

    If you don't wish to incur scrutiny on the forum, don't sell stuff here. It goes with the territory. That's just the nature of the beast. It's not a big secret if you do just a *little* research.

    Second, I certainly hope that etool makes good on his end. I feel inclined to point out that he has been less than forthcoming with the facts to Janusch (see his wife's post I quoted above). A simple email to Janusch saying "hey, let's work this out so on and so forth" (at which point I'm sure Janusch would have posted that things were being worked out between him and etool and all would have been fine) would have avoided any unpleasantness. The FACTS are that etool did none of this. He claimed that the speakers were uninsured and vehemently stated that he was not going to shell out the money out of his pocket which tells me that he fully intended to leave Janusch holding the bag. At this point, Janusch, justifiably feeling that he was getting the shaft, takes it to the forum. I'm sorry, that **** DOESN'T fly with me. I don't care who it is. George Grand is right, you don't get three out of four stars for integrity and based on the previous statements of both the buyer and the seller, I fully support and defend my position, statements and actions.

    For the record, I feel that it is the sellers responsibility to ensure that the item, once paid for, is delivered to the buyer as advertised. If it isn't it is the sellers responsibility to make it right with the buyer. Period. IMO, it is the sellers duty to refund or make restitution to the buyer (since he has the purchase money) and seek restitution from the carrier. The buyer shouldn't be jacked around waiting on a claim check. That's just the way it goes.

    Now, having said that, since etool has resurfaced, I will remain civil. However since I am probably one of the little **** Dan refers to, let me just say that, yes, seeing a forum member very likely being screwed out of a thousand dollars is a VERY big deal to me and I will not let it pass without doing what I can to help set it right and if that means hurting someone's feelings, so be it. If others wis to sit idly and let it pass, that's fine, but that's not my way and until they repeal the free speech amendment that's the way it's going to be.

    I think you might be a little misguided here. I DON'T believe that people automatically assume they are going to get a hook-up here. I DO think that they expect to be dealt with fairly and honestly. I also think that we have our own method of 'policing' the flea market. Ebay has the public feedback ratings, we have the court of forum opinion.

    I'd also say that there aren't a lot of folks on here with "a shitload of green". That's a faulty assumption. A thousand dollars to a public servant like me is a lot of money. A lot of us have families, mortgages and so forth and making ends meet is a challenge so I would caution you about making general statements about the financial situations of other forum members.

    I certainly do hope we can close this ugly chapter and if etool makes good on his obligations I will apologize and retract my statements, however, until that happens I support and defend my position.
