The chance of you getting any sort of settlement from the court/legal system are very slim at best. If you had hired an attorney to help you with this issue early on as SEVERAL members of this forum suggested...your time in jail could have been avoided. If you hire an ambulance chaser to reperesent you to sue the court/police/DA etc you will only be prolonging the issue and it probably won't work out in your favor.
IMO just make sure it is now settled and move on...and treat this as a hard lesson learned about the legal system.
I did hire an attorney. There wasn't exactly much time between "vacations," if you will, and the second time, i was there until my court date, where the situation was cleared up.

Someone earlier called it the legal system. That's a pretty common phrase today, but when did that happen. Wasn't it once the Justice system? Why the change? Was that phrase setting unrealistic expectations for what today's 'process' is. Not justice, but legal, ie -- no justice, just law. Maybe the significance is minor to some. /rhetoric

I wish I could see the humor in those, but I don't. It's a pity, since the tag tool, used correctly, is actually very useful IMO, and fills a hole in the abilities of the search feature very nicely ... It has always been the "legal system" going back to the Roman thesis of natural law...and the US legal system which can trace most of its roots back to the 1300s and English and Welsh system of law. A legal system is the mechanism for creating, interpreting and enforcing the laws in a given society. It merely relates to a system governed by laws. The term justice system was actually an offshoot from the legal system as philosophy entered into the mix as a part of the equation. To think that it was the Justice system that somehow morphed into the Legal system...disregarding what is "fair" is simply not correct. Today they are really interchangeable in the way they are used. Now, in the interim, if you go in and pay the ticket, whomever you paid didn't bother to clear the warrant.
Hire a lawyer if you wish, however a visit to the DA is probably all that is required. As far as damages? Pfffffffffffffffft. You got inconvenienced a little, file it under **** happens.

Inconvienenced a little is a bit relative to a poor 20-something who is paying school loans. I got gyped of about $800, spent about a week in jail, got arrested twice, over a warrant that shouldn't have been issued in the first place.
But that being said, you may all be right.... my absolute main concern at the moment is that i want to be SURE that the warrant disappears completely, as in it NEVER existed, and the arrests never happened either. Regardless of whether or not they affect employment oppurtunities or not, i don't want them ANYWHERE associated with me. I can swallow the $800 if i have to, i've had to do worse before.
I'll make some calls and see where that gets me.
But what you guess happened, didn't. I got the ticket. I showed up and payed it on time, didn't miss anything. The rest of your hypothesis is mostly correct, as i outlined in previous posts.

So he took me to the jail, and i waited 2 hours for them to process me. They called me up, asked for my SS#, i gave it to them. Gave it again, and again, and one more time. They started to get a weird look on their faces. I asked why.
"There's no warrant under this SS#." Alarm bells start going off.
They ended up pulling a warrant under my name, via a name search. It had a social that was so far off that not even ONE number matched on it. I was in their system TWICE. Once under my correct social (clear) and once under the wrong social. (Warrant)
Here's where it gets REALLY weird.
The warrant was issued 10/23/08. I'd been pulled over SINCE then in that county, and not a word was said. There was NO REASON on the warrant as to why there was a warrant, and no officer could tell me WHY there was a warrant.
As a little back story, i had a little issue with my liscence starting from a speeding ticket that i had lost and forgot to pay. That was all taken care of fairly recently. All court costs and fines paid, and my liscence reinstated in full. This was done AFTER the warrant was served. I never got served, since the warrant had the wrong address on it as well.
The ONLY thing that this warrant could have been related to was traffic offense. I've never had an issue with anything else. IF this warrant was valid, then i wouldn't have been able to get my liscence back, as far as i'm concerned. I was able to get my liscence back, because my true identity was and still is clear.
Long story short.... i spent 4 hours there last night before i got released. The bail bondsman said that NOTHING sounded right. He started to tell me not to drive anymore so i didn't get picked up again. I had to stop him and tell him:
"I wasn't driving. I have a valid liscence, i just gave it to you. It is clear, has only 4 points on it, no restrictions."
"Oh, well hell. That's **** up. This all sounds wrong."
Sooo.... that's my story.
What do i do? I'll have a court date set shortly, and i'm trying to decide if i should get a lawyer to help sort this out and seek damages, etc, since now i have to put on job applications that yes, i HAVE been arrested, and this falls under the category of Wrongful Arrest as far as i can tell.

so your story fits perfectly in the screen top to bottom. i was reading it with a bit of a chuckle and a bit of sympathy both as ive seen before what a mistaken identity can do to a perfecly decent human being. then i scrolled and saw the dont drop the saop comment! LOL PRICELESS. sorry for the bad luck. im sure youll get it straightened out. serious inconvenience though im sure. -

You can't give the ****'s any reason to pull you over. Johnson County is broke and surviving only through the Franklin Jail and fees associated with the legal system.
I swear the local constabulary is over the edge and no longer give a crapola about individuals rights.

Seriously? Screw the lawyer. At least for now. You have already lost time and money that you won't be getting back.
My advice would be to go talk to your DA [District Attorney], any of them. Call them up and make an appointment [f that's a possibility where you live]. Start documenting everything. All correspondence, all letters, faxes....whatever. Try to get all correspondence in writing when you can and still document all verbal conversations, times, dates, who you spoke with, etc. and keep everything in one location. First off, find out why the warrant was issued.

Someone could have had a warrant entered wrong, information not cleared from NCIC, name mispelled etc. A lot of things could have happened wrong on their end. I have seen peoples name return as a possible hit for being wanted, where they have the same name but the middle initial is different. It could still return your name as a possibility. Even though the SSN is totally different.--Gary--

Good info here Ben. Your biggest problem is Johnson County. Two of my best friends are on the JC Sheriffs Dept. One I went through the USMC with.

Good luck. I would follow Treitz's advice, get a lawyer at the first sign of real trouble. So you don't go insane, I picked up the fact from your OP that a warrant had never been issued on you. Nobody can even tell me if the warrant is tied to traffic. There isn't even a reason listed on the actual warrant as to what it's for. None of the officers could tell me. They all agreed that it was strange.
