Got arrested last night.

Chill out. you need a constitutional law course in REAL law. The Nazzis are arresting him for an old warrant on a probably stupid minor traffic ticket to get his money as USUAL(infraction NOT A CRIME) and even a drivers licence is not technically required when you are NOT FOR HIRE (at least in california, the old statute is very clear on this) the gov just wants EVERYONE numbered like the poor jews in Auschwitz were - this is another constitutional violation see Brown V Texas. And another thing you all may not know is there's typically a statute of limitations on infractions and misdemeanors of 2 years max, so if the warrant is over two years old the WARRANT may be INVALID anyway. I have had dismissal on this technicality before. BUT YOU MUST ARGUE THIS BEFORE THE JUDGE to get it dismissed.

Wow my injustice system is so inefficient. WHAT A JOKE IT IS! getting worse by the year because PEOPLE LIKE YOU ENCOURAGE THEIR LAWLESSNESS. I hope the kid wins on a technecality and at least gets a dissmissal. IF he's not a murderer or a real screw up they need to let the traffic warrant GO. its a waste of time. I want them fighting CRIME not wasting my money puttin kids in jail for stupid old minor traffic tickets. GOT IT!

Don't beat down this kid like you are a judge when its obvious to me you must be pretty ignorant about the law. thus you care nothing of mine, yours or others constitutional rights. ITs called IGNORANCE of the law and trust me its RAMPANT.

Educate yourself and do not be so quick to side with our screwed up in- justice system.

The warrant was issued. It came back to YOU. Correct SSN or not, it came back to YOU. The point is that there never should have been a question as to whether the warrant was for you or not. There was this councilwoman here in wilm. nc who wasn't liked by all and one night an off duty cop thought she was drinking at this restaurant and called his bud to pull her over later. he did, took her downtown but the blood test showed up 0. She sued for 3,000,000. and got an undisclosed settlement.She sued her own employer and won and still worked for the city until her term ran out. Some can get it.. I hope you can too.

I've been wrongly arrested 30 yrs' ago for dui. I called alot of lawyers and then gave up. they didn't want to sue their potential employers (court appointed cases) and the reward settlement for me/them wouldn't be that much to bother with. I pleaded guilty By my lawyers advice!! really, I had to or the law would've twisted stuff around and I would've spent more time in jail than the 6hr. that I did. A little more to the story but it doesn't change anything.
I almost got murdered by a guy and escaped. At court he didn't show up and the judge asked me "did you get hurt". No I didn't ,(I escaped). Wellllllll then, why don't we just drop this case... What ..I thought... My god.... what... I did, shaking my head..I needed to work to eat and court time took away from my food allowance. That wouldn't be the case now but it was then.


Do check with some lawyers in your area and I wish you the best of luck!!!!!

I would not over look the idenity theft issue. Look into this just to make sure!!!!

I have a VERY uncommon name. I am 100% sure that i am the only person with my name in the midwest. The other "social" doesn't seem to pull much up. In their system, the other social has my name, and even my old address.

Sooo... the address of that social is my most recent previous address from about 10 months ago.

I'm inclined to believe that it is a major clerical error, and not much else. But i will still investigate the identity theft possibility, trust me.

I appreciate your advise, you've given me more info than i could hope for.

But, i know for a fact that i have no outstanding traffic fines/violations/court dates, etc.... Every bit of that was cleaned up with a fine toothed comb, and the fact remains that i've been pulled over in the same county SINCE the warrant was issued at least once, and been through their court system, and not a word was said about a warrant.

I will update again when i talk to a lawyer. You've given me much to go on. I appreciate it!

DOn't waste your time responding to this injustice legalistic lover.

Read my past posts and if you need any more help I can counsel you.

Hopefully when you get to court the judge will figure out they screwed up and dismiss it. Do NOT waive time, you can always waive time later if you need more time you get 45 days out of custody to get to "trial" traffic or otherwise Jury if jail time could be had, which typically it is not on infractional crap. you can ask the judge for an "indicated sentence" which he/she will tell you what the fine is if you enter plea of No contest and it forces them to get their case together faster. Learn how to file paper/breifs, subpoena all the records and look at the case file. Its all free. Ask NOW to look at the case file they have on you. This may help clear up what happened and if is accurate or not. Remember the 2 year statute of limitations, I will have to verify it if you live in texas as I live in ca.

Good luck! and remember to DEMAND ALL YOUR RIGHTS!

When i have the officers apologizing to me because THEY don't even know what's going on, there's a problem. Plain and simple.

I am glad to help. Get the warrant and/or case number then go to the clerk of that court and ask to see the file. you can view it for free and its a couple bucks if you need copies of stuff. (DO NOT TAMPER WITH OR REMOVE THE DOCUMENTS FROM THE FILE) they typically have you on camera and its a felony to mess with their files. But THEY MUST give you access to them or give copies to you as needed. Its the LAW.

That is what I would suggest to do first. Then you may be able to figure out what happened. (wrong person or ssn or whatever) Demand a verified written complaint at your arraignment. Until you view the case file its mostly speculation. If they did screw up you want to show them how they did. also get your old case stuff out to show the judge how you took care of it all. He/she may know this but you being proactive lets the judge know you did your homework before you came to court. DOing all the above will also make your lawyer happier and save you money too.

Concealer - why do you need a lawyer? You were arrested and let go and not charged with anything, right?

Did you pay bail? They usually make you pay bail so you'll be sure to appear in court to face the charges against you. Again, were you charged with anything?

Don't worry about just an arrest on your record. Employers will be interested in whether or not you were convicted of anything. I have some, uh, experience in this area. They usually are looking for felonies or crimes other than "minor traffic" convictions.

What constitutes a "minor traffic" conviction? Do they mean a civil traffic infraction (speeding ticket)? A misdemeanor traffic infraction (drunk driving)? Some type of felonious driving offense like reckless driving causing death? Well if they aren't more specific it's pretty much up to your interpretation and several court cases have held this to be true. I've successfully used this excuse for my impaired driving conviction on many an occasion. :) Although if you actually killed someone, interpreting that as "minor" would not likely hold up I think

Finally, even if your future employer goes looking for an arrest record. They are often very difficult to find. Many police precincts/stations (at least around here) don't load that type of data into any kind of state or national database where it would be easily located.

Sorry to hear about your injustice. I know of several people who were unlawfully arrested for DUI's and other things and they won good money in settlements. (its sad we have to sue our own government but thats all they seem to listen too, and yes attorneys are usually crooks too) Its so sad our system and the Dumb asses who run it cannot be truthful... but instead are LIARS and rights violators. They are brain washed in government ran law schools. I know this because I read US supreme courts and not "the west law and other watered down BS.

I help people when ever i can if they are minor offenders. the system CREATES criminals instead of preventing them.

So thus someone like me needs to help others to make up for the systems transgressions.

So sad.

He's right I would not worry about an "arrest" don't even mention it on your employment apps, that is unless your getting a security clearance.
then they want your underwear size too.

Technically we are all under arrest "temporarily" when we are stopped for a minor traffic violation. its called a custodial arrest or interrogation by definition. anyway,

Again its not an issue unless a conviction exists for a major "criminal" or felonious act.

I am a Laymen Lawyer but will NEVER EVER be an attorney. The system is rigged to protect itself so I can't have a real conscience and be a good attorney. AND furthermore when they read you your Miranda rights they get it all wrong. I read the whole Miranda case. its not a pretty one what the police did to him. He was a scum bag rapist but then the police beat him with chains to get a confession. That is why the supreme court let him go.

The proper term is "unfettered counsel of choice". Counsel is ANYONE, a friend or whomever you want to help you NOT only an attorney. You can argue with the Federal supreme court but good luck with that one!

Personally I would not bother with an "attorney" yet. Like i said, go look at your case file BEFORE you do anything. THIS IS TOTALLY FREE. This way you are fully informed about your case and then you can decide if you need to pay for counsel (attorney) or not. My guess is you do not.

They even denied it existed and I held it up in court and told the judge what is this? a fake warrant? a figment of my imagination?? he got flustered and shut up his lies and BS and rescheduled me. This was all in superior court and was all on the record so he was in a real bind!

I was pissed. I told them if I got picked up on this false warrant I would sue the crap out of them. ahh they don't care but will when I get 100k out of them for unlawful detainment. Again good luck and go PULL YOUR CASE FILE. This is NOT rocket science and unless you are rich you really do not need to waste money on an attorney yet until you know all the facts.

You got no claim for damages. And, if any lawyer says you do, that's when you walk out the door. Any lawyer willing to put his rep on the line for damages is just trying to charge you. Just get someone willing to show up in court, file the paperwork, and able to insure you have no costly marks on your record.

I wanted to be a lawyer at the age of around 17-20 but the cost prevented me.....I've have always tried to help others when I could still.
I hate to see Injustice!!!! I just hope when all is said and done, those who persicuted unjustly will then be punished justly.

Well, here's your update. I got picked up again when pulled over for a liscence plate light out. Ugh.

They kept me this time until the court date.

Upon going to court, i realized the significance of me being in the system twice. They were holding me for Failure to Appear to a court date in October concerning a traffic violation.

Which.... upon investigation, i had proof that i had been there that date, paid my fines and court costs, and had even appeared in front of that same judge. They just never did anything about the duplicate.

Everything is cleared off my record, i am now seeking damages for wrongful arrest, missed work/pay, slander, etc....

So that's where i've been. It's all winding down, and i was correct in thinking that i had everything taken care of, system was wrong.

And that's that!

Thank you. It's been hectic, which is why i haven't been on in the last week or so, but we're back to normal now.

The whole time i couldn't stop thinking "This all better be done before my turn on the ERC-1 demo dammit!!!" :P

Hahaha, that would be nice.... I'm not sure that i'll use any of the money if i win to go towards hobbies though. The responsible side of me says to put it away for a rainy day.

I have a feeling that it's not going to be a real large amount. But oh well. It's the principle of things. I mainly want the money that i would have earned at work. Anything extra is gravy.

I do have to start shopping for the next upgrade though.... have to wait til i finish moving though, and have my placement and everything all taken care of.

I have a few friends who will run my social security/DL numbers for me about once a year just to check things out. When I first moved to this communist state of New Jersey I had a problem with the DMV. It was because of the quality of workers they hire in our capitol, Trenton, for some reason the person could not tell the difference between a L and an I and caused me a minor problem and some aggravation. You can never be too careful especially in a state like New Jersey.

That's pretty much what happened here. At some point, either the court or the officer that issued the ticket got my info horribly wrong. The court summons had my correct info on it, and i went and took care of that. In the meantime, the other one sat out there, had a warrant issued on it, and that's what they picked me up on. Apparently your name only is good enough for an officer to bring you in. :rolleyes:

At any point, even when my SS# was run, nothing would ever come up, because my stuff WAS in order. The judge was a real d-bag, and said that he didn't care, they had my name and address right, so it was a valid warrant issued by the court.

Unfortunately for them, it doesn't even matter if the warrant had correct info or not, as i have documents from the very same court showing that i appeared, pled guilty already, and paid.

He didn't like that much. One of those power trip wanna-be judge judy types, but with more testosterone.

So now, i will be following what you did. I have a contact at work that has access to all of that, and will be keeping a close eye on what shows up or doesn't show up.

But for the time being, i'm VERY glad that i had the foresight/OCD enough to save all of my ticket/court info. I have tickets and receipts going back 5 years still stashed in my cabinet.

The chance of you getting any sort of settlement from the court/legal system are very slim at best. If you had hired an attorney to help you with this issue early on as SEVERAL members of this forum suggested...your time in jail could have been avoided. If you hire an ambulance chaser to reperesent you to sue the court/police/DA etc you will only be prolonging the issue and it probably won't work out in your favor.

IMO just make sure it is now settled and move on...and treat this as a hard lesson learned about the legal system.
