No. I'm not joking.
I was teaching my girlfriend how to drive stick, i was in the passenger seat. We were going to Blockbuster to return some movies, and grab another.
The motorized shoulder belt things don't work, so we didn't have those fastened, just the lap belts.
So, we got pulled over because the officer didn't think we had our seat belts on. He came up and checked, believed us, ran the liscences and registration anyway. Came back, told us that we weren't getting any tickets, but that he had to take me in.
WTF?
He told me that there was an outstanding warrant for me in Johnson County, and that he'd have to take me in, that it would probably be a 30 minute in and out process if my girlfriend called and made bail now.
So he took me to the jail, and i waited 2 hours for them to process me. They called me up, asked for my SS#, i gave it to them. Gave it again, and again, and one more time. They started to get a weird look on their faces. I asked why.
"There's no warrant under this SS#." Alarm bells start going off.
They ended up pulling a warrant under my name, via a name search. It had a social that was so far off that not even ONE number matched on it. I was in their system TWICE. Once under my correct social (clear) and once under the wrong social. (Warrant)
Here's where it gets REALLY weird.
The warrant was issued 10/23/08. I'd been pulled over SINCE then in that county, and not a word was said. There was NO REASON on the warrant as to why there was a warrant, and no officer could tell me WHY there was a warrant.
As a little back story, i had a little issue with my liscence starting from a speeding ticket that i had lost and forgot to pay. That was all taken care of fairly recently. All court costs and fines paid, and my liscence reinstated in full. This was done AFTER the warrant was served. I never got served, since the warrant had the wrong address on it as well.
The ONLY thing that this warrant could have been related to was traffic offense. I've never had an issue with anything else. IF this warrant was valid, then i wouldn't have been able to get my liscence back, as far as i'm concerned. I was able to get my liscence back, because my true identity was and still is clear.
Long story short.... i spent 4 hours there last night before i got released. The bail bondsman said that NOTHING sounded right. He started to tell me not to drive anymore so i didn't get picked up again. I had to stop him and tell him:
"I wasn't driving. I have a valid liscence, i just gave it to you. It is clear, has only 4 points on it, no restrictions."
"Oh, well hell. That's **** up. This all sounds wrong."
Sooo.... that's my story.
What do i do? I'll have a court date set shortly, and i'm trying to decide if i should get a lawyer to help sort this out and seek damages, etc, since now i have to put on job applications that yes, i HAVE been arrested, and this falls under the category of Wrongful Arrest as far as i can tell.
Give me your thoughts, please!

Hahhaa! I'm not worried about that. I'm not going to jail. I would at the very least like the arrest off my record, the incorrect identity listing removed from their system, and my bail money back, though.
I'm calling a lawyer this afternoon to see what we can do, i'm just wondering if anyone has any insights on the situation. What to do, what not to do, how much should i sue for, etc.....I don't read the newsssspaperssss because dey aaaallllllllll...... have ugly print.

Being arrested and being convicted are two different things any employer that thinks differently is an idiot, supposedly you are innocent until proven guilty. It sounds like you were never even charged.

Then why did you ask?
Your bail will be returned to you. Well, more like whomever bailed you out. But if you went to a bail bondsmen. You didn't pay bail, he did. Then you are out the money you had to pay him to get him to front your bail for you. If you yourself paid bail, you'll get it back.
Bail is meant to keep you from jumping bail and make sure you show up to court. When you show up to court, you or whomever paid your bail gets a certificate for your bail amount. Most courts do it through a direct debit/deposit now.
As far as what you should do, for starters, keep your nose clean and handle your business. An arrest warrant over a traffic ticket? That should have been taken care of MONTHS before it came to this. Not the day after the warrant was issued for your arrest.
Secondly, no one I know of here is a criminal or civil lawyer. Therefore, in legal matters, the best advice get a lawyer. Sorry if you think that sucks but there is no way in hell you are going to get done what you need to get done by yourself. You need someone in your corner that understands the laws, your rights and how they apply to each other. Club Polk is not that person(s).
As far as your job applications, you can put down you were arrested if you want but it's really not necessary. If you are convicted of a crime, that's completely different. Even then, certain crimes don't need to be reported legally. But if you want to report an arrest on your job application, go ahead, shoot yourself in the foot. It won't necessarily come up on a background search unless you are going for a security clearance. A conviction will show up on any background check. An arrest is not necessarily an accusation of a crime but detainment for questioning in relation to a crime committed. You are not guilty of anything until your trial is over and your verdict is read. An arraignment is where you would be accused of a crime and a trial date set. Lots of people get arrested for lots of reasons. Not all of them have actually done something wrong.
But if you are in a position to be arrested for anything then you really have to question where your life is and you should look in to adjusting your behavior pattern so you don't have to run afoul of the local constabulary.
And next time you ask for advice with a vague and open ended question and don't get what you are looking for, don't tell everyone who has already replied with solid, good advice that it was useless.

I asked, hoping for insightful comments. I don't know in advance what the answer is, or else i wouldn't ask.As far as what you should do, for starters, keep your nose clean and handle your business. You didn't read the story, did you? It HAS been taken care of. A LONG time ago. As i stated at least twice in the story, my identity, with my social security number, my address, my liscense number is clear. My correct social security number has NO pending ANYTHING on it, and never has.
There is a SECOND identity out there that matches everything of mine BUT the social security number. My nose is clean. I handled my business. READ for christ's sake.Secondly, no one I know of here is a criminal or civil lawyer. Therefore, in legal matters, the best advice get a lawyer. You need someone in your corner that understands the laws, your rights and how they apply to each other. Club Polk is not that person(s).
I have already stated that i was getting a lawyer. I was just looking to see if anyone else has been through something similar, and what their experiences were. READ.But if you are in a position to be arrested for anything then you really have to question where your life is and you should look in to adjusting your behavior pattern so you don't have to run afoul of the local constabulary.
God. **** me, man. READ. I was in no position to be arrested for anything. Hence the thread. If i deserved to be arrested, i probably wouldn't be posting from work right now.And next time you ask for advice with a vague and open ended question and don't get what you are looking for, don't tell everyone who has already replied with solid, good advice that it was useless.

Good Luck with everything, try to get it all expunged from the record but its tough as the officer took you in under arrest, now don't turn to a life of crime. Seriously? Screw the lawyer. At least for now. You have already lost time and money that you won't be getting back.
My advice would be to go talk to your DA [District Attorney], any of them. Call them up and make an appointment [f that's a possibility where you live]. Start documenting everything. All correspondence, all letters, faxes....whatever. Try to get all correspondence in writing when you can and still document all verbal conversations, times, dates, who you spoke with, etc. and keep everything in one location. First off, find out why the warrant was issued.
If, at a certain point you feel like you are not making headway? Then you will want to hire a lawyer. Trust me, you will be much cheaper at doing the legwork than any lawyer I have ever met. Also, I would advise going to http://www.freecreditreport.com and paying the 24.95 or whatever it is to get ALL 3 of your credit reports to verify that your identity has not been compromised. Check with your homeowner's policy to see how much coverage you may have for identity theft. I'm not saying that to scare you, I'm just advising you what to do so that IF something has happened, you will know where you stand and what your options are. Who knows, if you uncover something, a lawyer might be covered for you already.~ In search of accurate reproduction of music. Real sound is my reference and while perfection may not be attainable? God dude. For the last time. THERE HAS NEVER BEEN A WARRANT ISSUED FOR ME. My social starts with a 107, and there has NEVER been a warrant on it. The warrant is listed with a social that starts with 415. I was never issued a warrant. This is false arrest.
Nobody can even tell me if the warrant is tied to traffic. There isn't even a reason listed on the actual warrant as to what it's for. None of the officers could tell me. They all agreed that it was strange.
I monitor my credit, all my bank accounts, nothing strange has happened. No breaches, no nothing.
As for taking care of speeding tickets and etc.... how could i have not taken care of it before a warrant was issued, if i've never had a warrant issued for ME? It's been taken care of, everything pertaining to me is clean.
Stolen identity is a possibility, but it's hard to pinpoint that without a reason being found for the warrant.I don't read the newsssspaperssss because dey aaaallllllllll...... have ugly print.
