Ok Chris got an email last Friday 8/15/08.... Basically it said no they will not refund his money because it was a private sale and not an Ebay sale. WTF? So I got him to call them today and they say yes its there policy, but they will review again.

I knew about the email from 4 days ago, I'm so pissed about I have trouble even talking about. This was Chris first sale / buy, I'm sure it will be he's last. That's sad.

Wait a minute......who said it's not covered because it wasn't bought on Ebay? UPS said this in an e-mail? Firstly they don't deal with anything in email and secondly as I stated in another thread form my job I have been reviewing the Service Manuals for all the retail carriers and I just was reading the UPS manual and nowhere is their any verbiage about it not being covered outside of Ebay.

    More info please.

If he misrepresented the items condition or conditions of sale, then that falls under "fraud" They don't guarantee that they can recover any money but, it would be in the sellers best interest to refund the purchase rather than get fraud charges slapped against him. The US Postal Service has jurisdiction when it comes to internet fraud. And believe me, from an experience I had. They do investigate this kind of crap. It's been suggested in this thread already that the seller misrepresented the amps condition, right?

He didn't use the US Postal Service so they won't touch it anymore than they will go after Best Buy if you walk in an purchase a bad TV.

I've been following this thread for days now,,disneyjoe,, where are things at right now? Any co-operation from the dylanblada person? Is there an end in sight? I hope that things get worked out for the buyer,,Chris?,,I can only imagine the stress and anxiety generated over this deal. I cannot understand how the seller sleeps at all,,when the Karma hits,,I hope it's big. This is just sad.

This is what Chris told me by his Email and Phone call to PayPal, but I haven't seen this email myself. I told Chris to link this thread to PayPal, as no one is happy with Dylan and if PayPal is doing this I sure people with not use PayPal.

Karma is getting bigger. ;)

Steve, you need to tell Chris to stop dicking around, go down to the courthouse and file a lawsuit in small claims. It may be the only way to stop Dylan from doing this to someone else.

It seems that they are missing the fact the item was damaged DURING shipment and not just that you are not satisfied with the quality of the item. SOMEONE needs to follow up and make sure they get it right!

It looks like you have bought at least 11 times on here so I am assuming the same reason/s you have. It was something you wanted and you felt you could trust the fellow selling it to you or at least the risk was acceptable. Of course the people you bought from had a very good rep on here as being solid peeps.

There will always be risk whether you buy from here or ebay, the only thing one can do is to attempt to lower that risk to an acceptable level. Personally I think that the flea market rules should be changed to a minimum of 200 posts and membership for 6 months to buy or sell something, in addition the first time someone sells something they should be required to ship and the item received in the same condition at time of sale before payment is sent by the buyer if the value of the object is $250.00 or more.

    Just my 2 cents :D

So according to your rules, someone can hang around for 6 months, then easily con a new seller.

No matter what, trust is a big issue here. As is respect when selling privately. Obviously, respect was not present when Dylan refused to return payment.

Me personally, if someone had an issue I wouldnt think twice, I would give back the money. Its really not that hard of a concept.

I think that with both partys buyer and seller having a minimum of 6 months membership and 200 posts the likelyhood of getting ripped off is far less than the current system, and chances are by the time you have made 200 posts on here the buyer and seller both can get a feeling for each other by looking at some of there posts. Is this idea perfect? no but better than we currently have.

I asked Chris about this yesterday, there's been nothing from Dylan. So I'm sure he doesn't wish to man up here. I sorry to report that Chris will not pursue this in court, which I would personally enjoy, but truly isn't my call.
