There are other pics, more damage on the speaker footings, more scatch, and dents, but I think you get the general idea. As for the seller I think he feels justified on what he sent and since he believes that it was my fault for rushing him, I'm not expecting much.

OMG! that is pretty much in line with the definition of major damage! provide etool with all of these evidence and he needs to unleash hell onto Fedex! It's clearly what consitute major abuse on the part of Fedex, negligence, et.al. Sue them if they even raise their voices! I don't believe even the original packaging would stand that kind of abuse, unless they were double boxed. But, that's only IMHO..

He could still do a claim, But i think "we" all know he never insured them and he was getting "a run around" from the fed ex lady that day.. Sure .. They have to insure if its on the airbill period.. If it wasn't they won't pay out.. A company is not going to pay a grand because they feel bad for what happened.. 100.00 yeah, they offer that free.. seems like a raw deal,

edit: on a side note, FED EX is extremly rough as of lately with packages and this is just abuse as stated above, My speakers boxes were almost as beat up as these.. and to think they deliver them to your door with a clear mind and say " YUP i delivered these and the customer should be happy!! Like they don't know they were all beat to hell, and the driver should do a claim on his own when damage is detected and he should send them to the warehouse for inspection, knowing they caused the damage...MY HT RIG:

You are right they are only going to insure them for $100 each, but I if I was them I wouldn't pay me. Again the packing was not done well. There was air space between the bubble wrap and the cardboard boxes. Those heavy speakers never had a chance. And if the FedEx guys treated them with white gloves I still believe there would have been damage. -

Though I doubt it will change much, I noticed that the first time anyone mentioned anything about this possibly being a bad deal occured on page 2 of this thread. On May 27, you stated some concern. If the speakers really were shipped on May 19, how could he have felt rushed?
Also, it is hard to tell based on your pictures, but is the bubble wrap the kind with small bubbles? In any event, it looks like flimsy packaging. Any extra space in the box should have been filled with styrofoam packing foam.
Sorry this happened to you, it looks like your speakers are pretty much ruined. -

They look bad, but they still play, and sound pretty good. Only concern is that the wood panel of the woofer looks a little warped and keeps falling off, but I should be able to do something about that. -
At the VERY minimum, if you're going to keep those things (I wouldn't) you should be getting half of your cash back. I agree that even if FedEx would have pampered those things, that packing isn't something that I would feel comfortable sending even a glass vase in......Originally posted by Janusch

Warped? That sounds like it could have been pre-existing damage. I don't see any way that poor packaging can cause wood to warp. -

Any chance you could post a pic? At this point, I guess I am just lookin' for an understanding of what could go wrong from shipping heavy speakers with inadequate packaging materials. I tried to get a pic of this, but I could not get the right angle to show what I'm talking about. basicly there are some velcro on the wood and the speaker. they are not touching solidly so the wood keeps falling off if the speaker gets moved. If the speaker sits there it is fine and the wood stays in place. I tried to put the wood paneling on my table and you can see a very slight warp, but does not show up when I took the picture(Not that big to notice). I don't think it is off by much. Why this would happen, I don't know either. And there may be a possablity that the wood got some mosture in it and warped. Maybe overtime the wood will dry out and reture back to its original shap.

As indicated above, shippers do have some responsibility for assuring that damaged packages are intercepted along the way. This starts with their acceptance of an inadequately packed item, e.g., one that is shifting around inside of the box.
Only thing I can say is if e-tool has checked out, go it alone. Tote them to your local FedEx with a print out of e-tool's post(s) and make your case. Worst you will hopefully do is the $200 and that should adequately fund materials for repair.
If you're knowledgeable enough to repair the underlying particle board and re-veneer them, great. If not, har, gidrah, F1 and maybe others ought to be able to give you some good guidance through the process.

NIB? Check out the pic in the 4th post down. Is that what he received? No. Had they been in the proper boxes (shown in the add and stated as part of the deal... "NIB") they would not have shown up in that condition.
Unless the buyer was informed of these changes to the packaging (and agreed) then the seller is at fault and needs to make it right.

Using more than a single layer of thin bubble wrap in a box with room for the speakers to move would have helped too. -

I'm sorry, but I had to comment on this. First he says they are NIB, with one box open to check for "shipping mishandles" then he says that he sold these in "like new" condition. Which is it? Like new or NIB?
I also agree that unless stated by the shipper the "NIB" speakers ought to have been new IN the box that they rolled off the factory floor on.
I don't believe that Eulogy was trying to sell Jrausch effed up speakers, but I do believe he was trying to get away with spending the least amount of money on packaging with these delicate speakers as possible, and this is what ensued. I think the misinformation is catching up with him, and if I were him i'd refund half the money and let them keep the speakers or refund it all and take the screwed up speakers and take the issue up with Fed-ex.
The latter seems like the easiest of the 2 options, but he knows he didn't pay for extra insurance and thus doesn't want to eat his losses that are NOT the purchasers fault. -
Janusch,I have been a Delivery Driver for U.P.S. for the last 25 years,and let me tell you that I have "seen it all" when it comes to shipping packages.
I can not speak for Fed Ex,and I can only assume that the Carrier was Fed Ex Ground. Right?
First of all,Fed Ex would not have accepted these pkgs. for shipment "if" they knew what the contents were and "if" the pkgs. were going to have a declared value of 500. each.To say that Fex Ex would not accept the speakers in the original cartons is nothing but "pure B.S."
It was also stated that the shipper went to U-Haul and bought new shipping cartons is also "pure bunk"...If so.why would Golf Clubs,etc. be written on the outsideof the cartons?
I can say from experience,that Polk Tower Speakers,even in the "Factory" containers are not packed well enough to withstand a lot of transportation.The stra- blocks in the top and base of the cartons is "good" but the sides,front and back of the cabinets needs protection also if they are to be moved for any distance at all.
All I can say is what a lot of others have stated,it is up to the shipper to file a claim,he is the one that hired the carrier to deliver these pkgs. from point A to point B...If I were you,I would not give up and just "settle" for what you've got in front of you...
If this man does make this right by you,I would take him to Small Claims Court,you do not and should not have to settle for anything less than a full refund,in my opinion anyway...the squeaky wheel gets the grease... -

I agree totally (almost) with all of the statements MReeter made but would just like to share that the Lsi's I received recently were shipped in the original box and took some abuse. As I was pulling them out of the box in perfect condition I took an extra look at the box. There was several inches all around the seemingly non-protected parts. (mine were all squished in). It was at that point I realized the boxes were well designed. Sure, something hard hitting this particular area could have caused problems but they left so much space that it would be VERY unlikely. I feel a little uneasy about this particular deal because I considered them. One big reason I did make the consideration was because of the factory packaging. (which at the time I didn't know the ones I was looking at had).
Hey, it was part of the enticement.
I don't think the seller intentionally caused a problem here but he did make a mistake in his judgement on the boxes. Unfortunatly it was a VERY expensive mistake and although I know it hurts, he should take care of it. Many of us would, considering the circumstances.

Guys I thank you for the support. The wife and I have already looked at some of the suggestions you are posting. Including small claims court, of course he is in Florida and if we did this it may drag on for a long time and also include more expenses.
To be honest, I'm almost 40 years old and have been through a lot more dramatic things then this. I've had a house destroyed by a contractors fault and this guy got out of any responsiblity. And trust we lost a lot more then a grand. But I believe everything works out in the end. It did in the case of my house. Not what I thought would happen, but something much better.
Where I always have hope that people will be upright and do the right thing, I find that in reality it does not happens most of the time. Most of us, including myself can justify most things away. (Everyone else is speeding, the goverment all ready taxes me too much already, well its the booze talking ... ) Remember even Adam sad that Eve made him eat that apple, She blames the snake, and the Snake blames God.
In my heart I do not believe that anyone get away with Doing wrong. Life is a funny thing and the older you get the more you realize that.
The reason I posted the Pics and have given updates for your benifit in the future. If you have any dealings. If there is any other updates, like a mircle call from him to see if you can settle things, I will post it, but This is one long thread for the flea market and maybe we need to just end it.
Again Thanks (I still have faith when there are people like Hoosier21 out there and some of the other people I have dealt with) So who know I still need to trade my CSI400 for a LSIC
Again he has justified himself and believes he is in the right. And no amount of telling him how he should act is going to make a differents.

If the cartons were not over 130" in lenght+girth and was not over 108" long,they would not be over the size limit for U.P.S. or Fed Ex Ground shipments...The Fed Ex web site also states that there should be at least 2"-3" of packing material on all sides of the contents,even more on heavier items...

Janusch, someone mentioned that it was possible to do cosmetic repairs for the type of damage you have. If you aren't versed in that kind of work, it may be worth starting a thread on the subject. In all honesty, I wouldn't mind seeing how people could repair that kind of damage myself.

It's hard to tell from the fuzzy pics, but it looks to me as though the damage is to the black lacquered parts of the speakers. So, the first thing is to remove all the drivers, the crossover and whatever else comes off (side panels), then I would fill the damaged areas with a wood epoxy, sand smooth and then scuff sand the entire cabinet. Next, they go to the spray booth to be shot with multiple coats of gloss black lacquer, lightly sanded between coats. After the coats have had a chance to begin curing, I would start the rubbing out process. Without rubbing out the finish to a high gloss sheen (in this case) the finish would look cheap, like someone used a spray can from the local hardware store. The grill hardware can be purchasd from Polk and should be a easy fix. Reassemble and you're good to go.Political Correctness'.........defined
