    been down this road twice, first was fed ex fault, and me not having a original box, A subwoofer i shipped got smashed. fed ex shipped me the item back and we did a claim and refunded the seller.. end of story pretty much,

    I just traded a member even up for my black Rti70's for his cherry 70's, well when they arrived from fed ex the boxes were beat up, all the styrofoam was busted and destroyed, BUT the speakers were ok with only a fed rash spots not to be seen with the grill on, To ship those LSI15's without a original box is murder regardless of how he packed them,

    Fed ex will only insure for $100.00 as stated// If you do the claim the down side if the speakers are salvageable and due to the original cost you lose!!! They take back the speakers and boxes and investagate to see if enough packing was used/packed right and that it wasnt their fault.. Then they ship the broken items back to the sender, and you have to depend again on him to do the claim, If he does then you get your shipping cost back + 100.00 for each package,(what they cover automatically) I would say the parts are worth more then 200.00 , and he would get the parts back... So regardless that is what will happen with Fed ex, Unless he ponies up and gives back the 975.00 or what ever it was, and you still do a claim, send the speaks to fed ex and he can try and get the 200.00 + shipping back for himself..

    I feel for you and for future shipments of speakers i have learned my lesson, when ever possible use/keep original boxes and paddding and pad up more!!!!!!!!!

    While I agree we need to hear from e-tool here, Janusch, if at all possible I think you need to carefully ascertain whether or not all the damage actually occurred during shipment.

    Among the big carriers I still have had the most luck with FedEx.

    As for insurance, only the first $100 per package is free with the big carriers. Getting the money and keeping the package is possible as seen in the case of Doc's f/x 1000's, but that was UPS and the speakers were well packed.

    I really hope we can get good resolution here, both for Janusch's and the Flea Market's sakes.

    When I shipped the speakers they were in like new condition.

    I did remove them from the factory boxes ONLY because the lady at Fed Ex said they went over the max weight/dimensions in those boxes. I didn't tell this to Janusch because at that point they were in full panic mode and acted like I was a thief.
    So I went to Uhaul and payed $25. for smaller boxes, bubble wrap and a plastic protection cover. And wrapped them multiple times. When I shipped them I thought it included unsurance because I specified I wanted it for $1,000. I've never shipped anything like that before so I didn't know how to double check. The Fed EX lady was very rude since I placed a ground order after 5pm when I got off work. So it wouldn't surprise me at all if she "accidentally" didn't insure them like I asked. But it only costs about 2 bucks so it's ridiculous to think I just "didn't insure them".

    Please know, that I am only justifying my transaction so, to whom it may concern will know the truth. NOT because I owe it to anyone else that wants to make smart **** remarks. I held up my end of the bargin and Fed Ex was horrible from the start. And I don't see how they could be "badly" damaged when they didn't even have a fingerprint on them when I shipped them. Short of extreme abuse from Fed Ex. In that case I would contact them, and no matter how unfortunate it is and no matter how much I think it sucks, it's not my fault. So don't make me out to be the bad guy. And this is all I have to say on this topic.

    I don't visit this site but about once a week when I have time, so don't think I'm avoiding anything. It's quite the opposite.

    This is just a guess on package size and fed ex ground takes it ok, They won't take it if its 48" tall however.. and over 70 lbs..


    with that in mind, why didn't he use the foam holders atleast for the top and bottom of the speaker.. At that point i would have left with the speakers and contacted the buyer.. tried UPS or somply refunded the money and passed on the deal if we couldn't figure a viable way to ship the speakers..

    I would beg to differ, i may be wrong though, Im' not sure with UPS, But did Doc get any money?? I never heard of getting the item and money.

    Fed ex atleast Takes the item, I know that much.. and this is who we are dealing with.. Don't want anybody getting excited only to be let down again, then again maybe i don't know for sure except what happened to me and what they told me.

    Well, you know that the speakers were damaged in shipping. Poor packing and not getting insurance sound more like things that you controlled, not the buyer. Not mentioning that you didn't send the speakers in the original packaging because "the buyer was in full panick mode" wouldn't have been necessary if they were actually shipped when you told the buyer they were.

    Since it sounds like a lot of the problems were caused by your handling of the transaction, are you going to own up to your mistake and offer to either reduce the price for damaged speakers, or buy them back for the original $975?

    OK, since my last post wasn't clear enough for some. Let me break it down and elaborate on just the key points.


    1. The speakers were absolutely immaculate and never even had a speaker wire in them when the were shipped.

    2. I shipped them before the check even cleared and I have a receipt that shows the date of 5/19/03 like I said.

    3. I already said I asked for insurance so they should be insured. If they aren't then the lady at the desk didn't do her job.

    4. I packed them so well, the Fed Ex people would have literally had to throw them around and mistreat them to get damaged.
    There was maybe an inch on the sides where they could move.

    5. The speakers being damaged during shipping is not my fault and I don't think it's fair for me to be expected to take one in the balls because Fed Ex doesn't know how to handle packages.

    6. If this isn't plain as day then thats just the way it has to be. Because I am not going to explain things anymore.

    Now i can understand this, as The speaker i sent was packed properly so i thought also.. Fed ex was at fault and they paid out, I refunded the buyer.

    Thing is, You 2 need to start a claim!! asap!! request a pickup tag, and yes FED ex gets the busted speakers to inspect. They ship them back and the seller gets the pay out!! This is all considering thier is Insurance on them.. contact FED EX and get it taken care of, Lets stop the bickering and let them get done what they need to.. :)

    It's up to YOU to follow up about point number 3 here. As the recipient, there's absolutely nothing that Janusch can do from his end. Go to the hub that you shipped them out of and raise all holy hell to get this matter resolved.

    He doesn't even need to go to the station, they won't even know what is up.. You have to actually call fed ex, ask for ground claims, and give your tracking numbers and ask if they are insured.. and say you need to start a claim for damage to a package, LISTEN..

    It is the sellers responsibility to insure that the product is packed correctly and meets the shippers requirements for shipping. FedEx requires that any package weighing over 50 lbs. be packed with at least 1 inch of solid styrofoam type material around all surfaces and no free space around the product. Even if insurance is taken out on a item and that item isn't packed to FedEx's requirements, they will deny the claim for damage as they will in this case. Bubble wrap and one inch of free space in the carton isn't going to get a product weighing 70lbs. to it's destination in one piece, period!
    This is a unfortunate situation, but the bottom line is that the seller should have not shipped the product as he did. He should have contacted the buyer and explained that FedEx wasn't going to ship in the original cartons. It would have been up the the buyer at that point to decide if he wanted to pay more for freight truck delivery or just forget the deal. As it is, the seller owes the buyer a full refund minus shipping charges, buyer and seller split return shipping and the seller can fight it out with FedEx if he chooses.
    This is the fair and widely accepted resolution to a very common problem, sad as it is.

    Just curious, and i agree to an extent.. But F1 where did you get that info about the foam having to be inside the box?? and why do you think they will deny the claim.. That's not entirely true. They paid a claim out for me and i didn't use foam.

    I, like most of the folks here, want to believe you, truly. And you only need to follow up your words with actions to help us.

    I agree with brett, as a first step, I think you need to go to the FedEx location where you posted the shipment and talk to the manager. If you complain and explain to him that you intended to insure, and in fact left thinking you had insured, the shipment for the full value of the sale, you never know... The illogic of not insuring a near $1000 item for next to no cost, less than $4 per their web site, just might do some persuading with your words behind it.

    Push this as far up the FedEx chain as you have to and it's a good start. But if it fails for any reason, then I think F1 has laid out what the next steps are.

    I may not know everything, But i sell online everyweek and have shipped ALOT of packages through FED EX and luckily only had to make 1 claim, I also have an account with FED EX, To say i know alittle about shipping and some of the problems you encounter is an understatment..

    with that said, Look at your air bill E-tool.. as long as in the declared erea it is marked 1000.00 or 500.00 for each speaker then you are covered, NO guesswork, no pushing the manager around at the local fed ex, You won't get them to pay out $1000.00 bucks if you didn't pay for it period!! does a car insurance company cover an accident if you "meant" to have insurance but didn't??

    You don't even have to take the time to drive there, CALL FEd EX.. customer service, ask for Ground claims./.

    That's all i have to say, it's up to you from here.. everyone else seems to have a handle of the many ways to do a claim through fed ex, as i do

    The other thing that bears reiterating is the sellers responsibility to make good on the sale regardless of what Fed Ex does. If he didn't have insurance, or if the claim is denied because of poor packing, he should make good on the deal. He can do it by either refunding the purchase price (minus shipping) if the speakers are returned, or by negotiating a reduced price for the speakers with the buyer.

    Looking on the web, I see these speakers can be had new for $1199. (I am not sure how much shipping would be) $975 is too much to pay for damaged speakers.

    Anything weighing over 50 pounds should be packed like this, well this is how I would do it.....

    I would ship my M&K, like this.
    Light Blue: Bubble Wrap
    Pink: Egg Carton Type Stuff
    Brown: Box
    It'll be double boxed, and Egg Carton doubled

    Yes, we've read what you've said. The reason that we're all telling him to go to FedEx in person and have a talk with them is because he indicated that he wanted the insurance and the paperwork is reflecting that he didn't have any. I can assure you that picking up the phone and calling Customer Service (which is most likely on the other side of the country) will do absolutely nothing for him. If I was in either on of their shoes, you can bet your **** that I'd be jumping down people's throats to get this kinda situation taken care of, especially if (as is being claimed) FedEx was negligable in not adding what was ordered. That being said, there's something to be said about being thorough in sending $1000 worth of speakers and not even looking at the receipt...........

    They were packed in the original boxes and shipped via UPS and insured for $600.

    They arrived with minor/moderate cosmetic damage.

    At my request, wallstreet initiated a claim as the shipper.

    UPS came to the house, inspected the speaks and boxes, and I told them shipping the speaks back was out of the question and that we (wallstreet and I) would would accept partial insurance payment just to cover the damage repair.

    About three weeks later, wallstreet gets a check for $657.

    I told him to keep $100 for his trouble, and he sends me a check for $557.

    Everyone is pleased and punch, and I get to keep the 1000's.

    WOW DOC, that is a great deal, I may start shipping UPS if that is how they handle claims, Versus Fed EX.. Thanks for the breakdown.. I just know what FED EX does usually.

    I'm trying to help, and you seem to have everything under control.

    Why should E-Tool have the right to jump down anyones neck at Fed EX???? If he wrote insurance on the damm paperwork he gets it, if he didn't then he's out the cash out of his own pocket!!

    I agree, it was his fault they were ruined so he should get the speakers back and refund the money, or partial at the buyers option, I don't think however if it was all FED EX's fualt think that it's "ALL" on the sellers head.. BUt in this case it was the shippers problem with inadaquote packing materials, So he should pay


    Why do you think going to the terminal is gonna yield such great results?? Do you think that they keep everyones personal paperwork to finger through when ever a problem arises??

    I was overcharged about 3 different times from the same terminal, everytime i went home and double checked per the website it came up cheaper then they charged, I went to the terminal and they said, YOU HAVE TO CALL CS we don't have any info here.. ENOUGH said..

    I also read your posts. All brett and I are doing is stating what we would do. In my experience it always helps to work face-to-face. So why not try?

    Nothing to lose by visiting the drop point except a little time and it's possible it will help. Just like it's possible to collect on a claim and keep the merchandise. May not be the norm, but it is possible.
