I never heard of this kind of contract before... thats why inever bothered to look at it before we moved.

She just g ot off phone with that damn dealer.. they want 4,845 plus 2 years of interest so sum up nearly about 7 thousand dollars PLUS REPO FEES and cost of reterieve the vehicle. RIP OFF!!

with those money, i could have bought brand new 2009 cars instead of 2007.... MFers!

Even though you moved from PA. and breached your contract, aren't you still entitled to the personal belongings in the Jeep????

40% of the loan for 2 years interest? Sounds like you were being screwed long before they repoed it. I wouldn't let your wife negotiate or sign any more contracts.

Shady dealers like that are hoping for customers that breach their contract. More money for them. Some of my wife's relatives go to these dealers despite of our strong objections. The cars are overpriced, the interest rate is horrendous and the terms are really bad. We have tried but it's their money (that they don't have), and if they can't settle for something they can afford, they are going to be in the same situation forever.

    CaligulaPolk,

Your situation stinks and on a certain level I feel for you. But never, ever have I entered into a contract (or let anyone else on my behalf) w/o FULLY understanding what I'm signing. I know hindsight is 20/20. There had to be a reason you or your wife needed to use a shady dealer like you did. A normal upstanding dealership and bank doesn't treat you like that.

For whatever reason you used a high risk dealer and although their practicies are deplorable......it sounds like everything was spelled out you just neglected to read it. Ignorance isn't an excuse.

I hope you learned a lesson (I have many times; the hard way) and I wish you good luck from this point forward. Average people with average credit don;t have to go to these cut-throat dealers.

Sorry to hear this for you. That financing sounds like borderline loan sharking to me. The contract was signed so not much can be done. As a last ditch effort you could contact the PA dept responsible for banking regulations, to see if the contract crossed the legal line (probably did not). Also file a complaint with the Better Business Bureau and county/state Attorneys General Office. These will not help you unless the contract was illegal (which I think would be your responsibility to hire a lawyer to prove) but it might help reduce some of the stress.

How long have you been paying while out of state? Been mailing the MO's the whole time? I'm just curious as to when and how the shady dealer found out about your move and if he was just waiting to do this to you.

I have a hard enough time trusting halfway decent new car dealers/dealerships. I would never set foot into one of these shady used car places.

You got screwed...but unfortunately it was done "with consent".

Too many people never know what they sign and are only concerned with the moment. IE: walking out of there with the keys to the car. It is the only way these guys can survive. Read...ask questions...then ask them to show you where what they tell you is in the document if you aren't sure about it. Otherwise...pay cash.

Sounds like contract doldrums there! In house financing in Pa. is a B..h! I remember doing it and ended up paying twice the going 'interest' rate. Unfortunately for them. I paid the car off in less than 2 years so they DIDN'T get that interest?

heiney9 does have a point, unfortunately. The lesson....NEVER finance with a dealer--or their bank! Always use a separate reputable bank...and always read the fine print! Or consult with a lawyer who will interpret it for you.

    I know it suxx!

if i pay upfront their fee.. yep they would but he said basically there are nothing can be done.

My wife looked up online and compared other prices and milesage and she found that jeep at good deal and low milesage. this was why she picked this dealer. BIG MISTAKE!!! also my part for letting wife make the decision. NEXT TIME THERE WONT BE HER DECISION!! :p maybe buy a car from car dealer where my neighbors work so i can know where he lives hehehe.

I sure learned something here and a lesson. BUT THIS IS **** anyway. It is a good thing my brother has his jeep (While he travels the country) and i can use for temporary until we decide what we want to do. but our jokes still shared about neighbors car :D

Next time for some reason im going back to PA to visit in laws. ILL SAY TO THE OWNER OF THAT SHADY PLACe " YOU RIPOFF ****" when hes with customer and for them not to buy becuz of shady business. Ill post flyers around telling people not to do business with them.

It seems that the only real mistake, if you're happy with the car, is the financing deal. Had you known, you could probably have used your in-laws' address as a "valid address" in PA, since you're paying on time anyway and are near the end of the contract. Otherwise, if your credit really was decent, you could probably have secured similar terms, or better, without the PA address requirement, from such obvious sources as e-loan and Lending Tree.

This whole thing must totally be worth it for them, if they went to all the effort of "stalking" you to almost steal the car from under your nose and haul it all the way back to PA.

Maybe you should write a detailed letter to the local press about this dealer, and the local TV stations too. Some bad publicity, in these difficult times, might make him reconsider the towing fees, at the very least. If you play your cards right, I'm not convinced that you would not be able to get some retribution.

BEWARE...if he sells the car for less that what is "owed" (and there is a good chance he can/will include the interest called for in the contract as well as legal fees, towing and recovery fees, etc) he has the right to sue you for the deficit balance. Just because he repossessed the car does not mean he is done with you. He can get a judgment against you, your wife and/or whoever signed on the loan in your absence without you ever knowing about it. It may be enforceable in FL and definitely in PA. Don't think just because he has the car it is over. You need to make sure you know what is happening. Maybe someone (relative) in PA can get some help with the city, state or legal aid folks.

One other point: if your wife's sister co-signed (did I really read that somewhere), then she has always maintained a valid address in PA, has she not? This might not be a clear cut breach of contract on your part ... Just thinking out loud ...

"valid address in PA" - is that what it really says, or does it say something like "must maintain PA residency". I could have a "valid" address in all 50 states if I own property there. Moving temporarily for a job and not having changed your drivers license and vehicle registrations to FL, and still having a mailing address in PA ........ well that might introduce a sticky wicket into things, eh?

I would definitely report them to the better business bureau, because not making you understand the consequences of moving out of state. Or even warning you before re-possessing it, thats just bas business.

they want a residency address in city of warminster (most of my in laws do not live in warminster)not outside of that town. ITS WEIRD!! Owner on the phone treated my wife like she ran away and stole the car or was behind payment. Nothing i can do becuz its repod and they want me pay more money.. even if i got po box.. it doesnt matter anymore.. she got scammed as well for me too.:mad::mad: I felt that it was the plan when we told the dealer who i bought from that we were moving and they never said nothing until few weeks later. I guess they were monitoring the location where we were in.

Next time wont happen. and i will expose them, will contact philly news and let them know. at least i can do something about it. will call the 800 number tomorrow. 30th of this month would be my first payment from florida. so whole payment was done in pa. I actually lost my payment this month when i prepaid for june 30 th to july 30th on 15th of june.before i moved here. I CLD had brought rti a5 refurb if i knew it will be gone, oh well! :D Oh damn the insurance payment for july too :(
