Police to ignore California impound law amid concern of fairness to illegal immigrants

The Los Angeles Police Department will soon start ignoring California state law, which requires police to impound the vehicles of unlicensed drivers for 30 days.

The majority of unlicensed motorists in Los Angeles are immigrants who are in the country illegally and have low-income jobs. The LAPD says the state's impound law is unfair because it limits their ability to get to their jobs and imposes a steep fine to get their car back.




As long as drivers can produce some form of I.D., proof of insurance and vehicle registration, they'll be allowed to keep their car. Police Chief Charlie Beck insists that it's simply leveling the playing field.

"It's about fairness. It's about equal application of the law," Beck told a Los Angeles TV station earlier this month.

Opponents of Beck's decision are furious and refer to studies showing unlicensed drivers are among the most dangerous on the road. Indeed, a 2011 AAA study titled "Unlicensed to Kill" finds they are five times more likely to be involved in fatal crashes and more likely to flee the scene of a crime.

The decision has angered Don Rosenberg, a resident of Los Angeles County, who lost his 25-year old son, Drew, in a 2010 accident caused by an unlicensed driver in San Francisco, a city with lax impound policies. The driver, who tried fleeing the scene, had previously been pulled over but was allowed to retrieve his car after a short time, months before the accident.

"It doesn't matter to me who killed my son-- what their nationality was. It was the fact that if the law were followed, he'd be alive today," Rosenberg told Fox News.

Los Angeles District Attorney Steve Cooley wrote Chief Beck, saying his policy would be "invalid" in light of state law, which states a vehicle "shall be impounded." But supporters of Beck's decision say, regardless of the law, he's doing the right thing for illegal immigrants who cannot yet obtain driver's licenses here.

"A low-income person doesn't have the ability to pay the fees after 30 days to get their car back," said Cardinal Roger Mahony, former Archbishop of Los Angeles and an immigration activist. "Basically, we're just creating more punitive problems for them."

The L.A. Police Commission voted in favor of the new policy 4-1 last month. The LAPD says officers will begin implementing it in a matter of weeks. The city attorney has also sided with Beck's decision.

Immigrant advocates say the controversy highlights the need to provide provisional driver's licenses for illegal immigrants.

Don Rosenberg says he'd favor that, as long as the police enforce state law by impounding unlicensed drivers' cars when pulled over. But he believes that the city is pandering to the Latino community and doesn't hold out hope that the policy will change anytime soon.

"It's more important that people who are in the country illegally get to drive than it is that people who are here get to live," he said.

    You realize that if given a chance the majority of these "illegals" would gladly become US Citizens, right?

    If a program were put into place to allow those here illegally to go through the process without fear of punishment, I think we would have a large number of new Americans.

    However, I don't agree with what the LAPD is doing here. It's obviously against the law, no matter what policies they pass.
    The law is the "law" for a reason: it's unbiased. The law doesn't care who you are or where you're from.

    If memory serves there has been a process in place for over a century that helps you become an American citizen.They just choose to ignore it.
    My ancestors came here generations ago as immigrants.They were not illegal immigrants because they followed the laws in place to become an American.

    I actually don't have a beef with "fast tracking" some illegals, providing they've been law abiding (I know, insert irony here) good citizens and have school-age children. I do think the "anchor baby" law needs to go. I don't see any sense in cutting our nose off to spite our face, and I don't think it's right to make children pay for their parents decision to illegally immigrate.

    Wasn't most of the immigrant laws created recently drawn up by the prison industry to generate revenue? That’s what I understood at least... I could be wrong.
    According to NPR, Pearce brought his draft legislation to a December meeting of the American Legislative Exchange Council in Washington, D.C. The representatives of several corporations were there, including officials from the Corrections Corporation of America, the country’s largest private prisons company.

    The legislative language approved unanimously at that meeting went on to become Arizona’s immigration law (currently stayed pending court challenges). In the months in between, 30 of the bill’s 36 sponsors drew in campaign donations from the private prisons industry, NPR reports.

    Putting politics aside, the real issue here is a police chief who has officially stated to ignore/not enforce a law that is on the books. We're not talking letting a dog wander without a leash. If the chief doesn't like the law then I suggest that during his off duty time he works with groups that want to change law within the legal process.

    Then let them begin their path to citizenship by first following our laws, thus demonstrating they will respect our legal process. They could go one further and learn at least a sentence or two of english. The ones I see here in California are folowing an edict from Vincente Fox, former President of Mexico, which was to repopulate the southwestern U.S. and then reclaim it for Mexico. This is not fantasy or conspiratorial thought, but the actual words and position of the Mexican government.

    12,000,000 Americans moving south of the border would be called an invasion, and be repelled with force. Americans can never become a citizen of Mexico, vote or hold office, own property or anything else. All this PC bullsh!t has gotten us is the unravelling of our way of life.

    We are being invaded by nothing less than a civilian force determined to help their supporters undermine the American way of life. Radicals(illegals, anarchists etc), Socialists, Communists, Islamists and Revolutionaries are working together to destroy our way of life. Time to stand up and choose a side, because this spring and summer will make '68 look like a Cub Scout Jamboree...

    Ever since they lost the Alamo Mexican presidents have said the very same, Vincente Fox was the most recent. I have inlaws that are of Mexican decent and they refuse to learn English. They state if we want to communicate with them WE should learn Spanish... Needless to say at family get togethers it's REAL interesting to say the least.

    I had more than a few tell me that this land belongs to Mexico and not the U.S., and that I should go back to "Fu@&ing Europe where I belong! I won't repeat my reply because I don't feel like getting banned today.

    Politics aside, you have law enforcement saying openly they will not enforce the law. They should be fired on the spot lickety split. They do not get to pick and chose which laws to enforce and which to not. Good example our Justice department is setting eh.

    If not having a car is a hardship for illegals, what makes it any less of a hardship for citizens ?

    How much you want to bet that if I just forgot my liscense and insurance paperwork at home, that I would never see my car again? My cheap little Sunfire would not be worth recovering after it got towed and held for 30 days. Maybe I should get myself one hell of a suntan and change my name to Javier.:rolleyes:

    I cannot figure law enforcement out at all.
    We got a beater car for my son to fix up.97 honda civic.
    2 weeks ago i get a notice from barney fife to cover it with a "proper" car cover.not a tarp or other type of cover but a fitted car cover.
    if i don't i get fined.
    this is in the back lawn near the alley.meanwhile everybody out front is blowing by at 50 miles an hour on a 25mph street and they don't do sh^t!

    How about being put in jail for no completeing the siding on the BACK of your house?
    A Minnesota man was arrested and thrown in jail — all because city officials said he had not properly put up siding on his house.

    Officials in Burnsville, Minn. cited Mitch Faber with “having an unfinished exterior” when, nearly four years after he started it, his home’s stucco project was not complete, Fox News reported.

    Faber told Minneapolis ABC affiliate KSTP-TV he always intended to finish the project, but that he ran into financial trouble when the economy took a turn.

    His first encounter with the city happened in 2007 when he got a letter saying the siding needed to be finished.

    “We were in the process of finishing,” Faber told the station. “This wasn’t something that we were trying to avoid doing.”


    There were two more letters in 2009 and another in 2010, which required Faber to appear in court. That’s when, he told KSTP, he was instructed in no uncertain terms: Finish the siding or go to jail.

    In order to comply, Faber and his wife spent $12,000 to put a stucco facade over their house’s plywood exterior. It wasn’t enough: Last November, Faber was arrested after city inspectors concluded the work wasn’t up to code.

    Big Brother now has some balls...

    Well, 4 years and he still could not finish it, throwing him in jail wasn't that crazy after multiple verbal/written warnings :biggrin: I mean, I wouldn't want my neighbor's house to be an eyesore for the whole community. If that house were in the middle of nowhere, like in a private ranch, it wouldn't be an issue.

    First off, your thought process in this matter seems to be based on a stereotype. There is a huge population of migrant farmers in my area (lots of farmland and vineyards), and a large percentage is probably illegal...but they mix into our population, most of the ones I hear know enough English to get by, and they're pretty damn polite. Which is more than I can say for a lot of "Americans".     Secondly, I'm not sure why you're comparing the USA to Mexico. Two drastically different countries with vastly different policies and people, and yet you seem to expect them to be just like us...or at least want us to follow their policies of "get the eff out of our country". Just remember that unless you are Native American, we are all descended from "illegal aliens".

    How can you pick apart the concept of following the law? I don't care how "nice" they are... they BROKE THE LAW!

    As far as being deported goes, catching illegals is a lot like fishing in some states... catch and release. It takes as long to legally deport someone as it does to execute a murderer, not to mention the costs. We pay for ALL the legal fees on both sides of tehcase, which can be hundreds of thousands of dollars PER CASE!

    It took my wife and her family 20 YEARS to follow our laws and come here legally. That it takes so long is partly due to the horrific backlog of illegals choking up the system, but then again that's the goal isn't it?

    In order to replace the system, you first need to break the one we've got. We my friends, are about to be replaced.

    No we are NOT all descended from illegal aliens.If you came here and went through the process of becoming an American the way you were/are supposed to there is nothing illegal about it.
    That's the point.They are breaking the law.Now our law enforcement is as well to cater to them for some reason.
    I guess you are cool with them voting also.
    I live in the Gettysburg apple country so i am exposed to Mexicans every day.Some are fine,some not.Just like every race.
    My problem is with those breaking the law.I don't give a crap where they came from or what color they are.

    I remember TET, Armstrong on the surface of the Moon, RFK being shot, Nixon and Watergate, and the fall of Saigon. I remember the oil crisis of 1973. I have been acutely aware of the history that was taking place around me in my early years, and even then, I was shocked by the complete lack of respect shown our returning soldiers. I was born in 1965 btw, so my memories may not be as vivid as those of you old farts out there, but I also study history.
