    just got off the phone with Grim

    UPS sent them back to the store he shipped them from in Co.

    Gosh, UPS has lost all respect from me. Basically I was told by UPS that they are back in CO because they denied the insurance claim and they were mine to take back. Well, the boxes and styrofoam are TRASHED! I certainly can say that this is shipping damage all the way. I was told that based on UPS standards they weren't "packaged properly" even though I sent them the same way they came to me from UPS with no issues. So to further exploit the issues at hand if they were packed wrong in the first place they sent them BACK to colorado with the styrofoam all smashed to bits and about 5 holes in each box. NOW there is significant damage to the wood on the speakers from the return trip! I refused to pick them up and they are going to "escalate the claim" to someone higher up than the dipshit at UPS. Glad that I told them what was in the package before shipping and the lady at the counter who took them back looked inside the boxes because I was out of tape and didn't say a word that they weren't "up to UPS standards". This should be a slam dunk in getting the refund but it will take some time.

    Should have never let UPS take them, (but you didn't know any better, not your fault), they usually inspect the package on sight and then decide the claim, from what I know. When mole said UPS took them I thought you would never see them again. Escalate the claim and if not satisfied, sue them, that's the only thing these companies understand these days. I use FED EX, just have better luck with them & when they deliver they ring, UPS just throws the stuff and runs back to the truck, It's not funny anymore.:mad:

    im not trying to dick him over on this. i dont think its his fault, i think its 100% UPS FAULT!

    what sucks is because i am not the shipper they wont even talk to me about this whole thing.

    if UPS wont pay up. ill work something out with him on this.

    I wrote a couple of paragraphs about UPS and a lot of Polks delivered, 8-M70's, 2-M60's, 4-90e's, 2-m50'S, Pair of M40's, 6-pairs M30's, 4-PSW505's, 2-PSW10's, 4-CS2's & 1-CS1, never had an electrical, speaker, tweeter or sound quality issue, but had holes in several boxes, but no scratches on any cabinets, but did have Exploded Styrofoam, ripped grill cloths and cracked grills. I consider myself very lucky. OUT OF 34 BOXES, 12 DAMAGED ONE WAY OR ANOTHER.

    I had a 110 lb. triple boxed Z-11 delivered, I guess it was too heavy and bulky to throw; It had "THIS END UP ALWAYS" & "FRAGILE ELECTRONICS" "HANDLE WITH CARE ON IT".

    You would think UPS would see the "HUGE PICTURES OF SPEAKER CABINETS ON THE BOXES" So my point is, since there are "HUGE PICTURES OF SPEAKER CABINETS ON THE BOXES" it's gross negligence on the part of UPS for the damage that was done the second time around and UPS even PACKED them to send back to COLORADO. UPS is liable for that, any judge would see this point.


    POLK MIGHT WANT TO ADD TO THEIR SIGNAGE ON THE BOXES > "THIS END UP ALWAYS”, "FRAGILE ELECTRONICS" & "HANDLE WITH CARE ON IT" IT MIGHT HELP.

    TOTALLY REWRITTEN BECAUSE FIREFOX CRASHES LIKE SOME UPS SHIPMENT BOXES.

    the M70 boxes have a BIG pic of the speakers on the sides. the boxes also had arrows pointed up (THIS SIDE UP) on them aswell.

    gonna see what Grim can find out tomorrow.

    hope they (UPS) sees the light and does the right thing.

    I hate UPS... They have damaged sooo many things on me.

    This week, they lost a $600 mandolin that was supposed to be overnighted to me for Tuesday, it is a going away present for one of my workers... :mad:

    Today was his last day and I had to tell him about it and how UPS has ZERO idea where it is. Starting tomorrow, I can run a "trace" on it that can take up to a week and if they still can't find it, I guess they will send me another one. :rolleyes:

    Then I can mail it to him at his new house... NOT via UPS!

    BTW, I have M70's hooked up to my Denon 2808 that I can push well past -10.00 with zero issue...

    UPS always denies the claim at first, always. You have to keep pushing the issue.

    Here's the scoop after talking with the owner of the UPS store.

    1. He has no idea how Mole was able to file the claim in the first place and how they ended up back in colorado.

    2. UPS isn't liable for any damage in the return shipment because the boxes were opened and repackaged.

    3. Because the speakers were opened and hooked up, UPS can't accept any claim of damage because they can't tell when the damage took place.

    4. The speakers are mine to pick up again and I need to work something out with Mole to get this resolved.


    Does anyone have any suggestions as to where we can go from here?

    Bull crap UPS is not liable for damage during return shipping. The speakers were in custody of UPS and they were obviously negligent with the speakers... You can't back out of negligence, i don't care what they say. I would tell them that you're taking them to court for full replacement of the speakers.

    They beat them up on the way there, and beat them even worse on the way back... Don't just take UPS's word that they are not liable, they are.

    As for the claim of the original damage, how else is he supposed to figure out if they worked? Wave a magic wand over them to see if they were ok? He HAD to hook them up to see if there was any non-visable damage to the speaker.

    UPS claims that he should have refused shipment if he thought the boxes looked beat up. I know thats **** and I'm on Mole's side with all of this. He is going to contact UPS corporate with the tracking numbers and see where we can get that way since he filed the claim. It just sucks that now because the cabinets are destroyed I can't even do a warranty fix through polk to try and resolve the initial "popping" noise. I bet if I listed these on Craigs in this condition I'd be lucky to get 100 bucks.

    Then the driver should have pointed out the damage and asked him if he wanted to refuse it, or left an offical notice from UPS... Most people don't even know that's what they should do.

    I find that if you're persistant with companies like UPS, you will get your money from them, but you have to stay on them. Just don't budge and keep putting the blame on them, because they are going to try and blame you guys as much as possible.

    Usually you get transfered to 100 different people and you will finally get someone that does not want to deal with you and give you what you deserve.

    Why I wrote:

    It would be good if U had pictures at each stage of the shipping processes.
    Before and after destruction of your property.

    I know U 2 are trying to be nice about this with UPS, but that won't work or I'll be amazed if it does.

    If all else fails then, Yea, tell corporate you'll sue & mention you'll do them a big favor and post your experience with UPS & their incompetence all over the web, it's not a threat just a fact :)

    This would actually be gross negligence on UPS because they think they are the experts in Shipping & Handling. Cost less for UPS to pay U off cause a lawyer to answer a court filing will hit them over a $1,000.00 the first day & all U have 2 do is show up, prepare & use small claims court.

    I never took the speakers back yet so I can't take pictures. I need to see what mole can get done because he filed the claim. The next step is to threaten small claims and get the BBB involved with a nice claim against the local UPS store. A strike against them from the BBB is actually a big hit for a locally owned shop like that to where they might actually cave in this situation.

    I know about the pics and U probably don't have them at every stage anyway.
    If it comes to a suit you'll need pics as the end damage result, that's your claim.
    BBB is good and threaten to sue.

    Maybe Polk Audio will read this and fix them for free, I used a forum to do that, it was unusually amazing.

    If escalating the claim & threatening to sue doesn't pay off and U GRIMM has to file a suit in the future, just be sure to TAKE THE PICS OF THE DAMAGED ITEMS IN THE UPS OFFICE before U accept them. That's your (GRIMM'S) conclusive evidence FOR HIS CLAIM NOW.

    Oh & since grimm now has to file a claim with UPS because he is the receiver this time, with the damaged items caused by UPS, U owe mole 100% of his doe ray me back.

    I'm not picking sides, it's just the way it is from an impartial point of law.

    I'm sure U two will work it out.

    just got home about 20 minutes ago. did not get a chance to call UPS yet. i will first thing in the morning when i get up.

    i have been thinking about this all day long and im getting REALLY PISSED AT UPS!!!!!!

    this is just plan out BS!!!!!!!!

    I haven't had very good experiences with UPS. They once lost a laptop I had ordered from Newegg. According to the tracking information it made it to my local town's UPS station, but for several days it just kept saying out of delivery. Finally called and they had no idea on anything. They took it up with Newegg and my money was refunded, but Newegg was out of stock on that laptop so I couldn't get the same one.

    Go FedEx now.
