e-bay situation

Looking for some advice.....
At the beginning of this month I bid on a piece of stereo equipment, won the auction. I paid using paypal the day after my bid was accepted.
The seller answered my questions about said equipment during the auction. He also responded to my inquiry about shipping costs. I have sent him 3 emails in the last 2 weeks inquiring about when he was going to ship the item. I get no response. Needless to say I'm a little pissed that the guy can't atleast respond to e-mail. I've been very matter of fact and have not gotten angry in my email's. I also understand people get busy. That may be an excuse not to ship immediately but not an excuse not to respond to e-mail especially since he already has the cash.
In the ad he stated item would ship immediately after payment was received. What do I do know? How long should one typically wait before escalating my e-mails/contacting e-bay or paypal. I'm new to e-bay and it's standard procedures.
I was able to get his ph# and address and he only lives about 40 minutes away from me. I could just show up on his door step this weekend......
Any input on how to procede on this would be helpful.

Give the seller a phone call and offer to pick up the item to avoid potential shipping damages. Ask for a refund of shipping charges if the seller hasn't shipped the item yet.

Simple convienence....It's 40 minutes each way and I guess with gas prices the way they are $11 for shipping seemed to be a better deal. Plus I didn't expect the guy to be like this. Plus I just recently was able to find out he was this close to me.

no reason to ship anything if you are that close. 40 mins could save you not only some money. but a big headache if they get damaged in transit.
I had a guy who never responded to emails for a week once he got his money in hand. I sent him three emails to he could let me know when he was going to ship my speakers. Nothing. No response.
Finally on the last email.. i get a UPS tracking number. I look it up on the net.. and find out that they are here and will be delivered today. I was surprised that he failed to send me the tracking number a few days earlier. No damage in my case to the speakers.PolkFest 2012, who's going>?

At a very minimum, file a sellers complaint via PayPal and they'll freeze his account until he ponies up tracking information that they can verify.
I had to do this once and saved myself just under $200 on something the guy had zero intention on sending.comment comment comment comment. bitchy. -

You can also look into Square Trade linky
PayPal also has a form of buyer protection. Log in to your PayPal account and click the tab on the top of the right side "Auction Tools". Once your there find "Protection Programs" then "Buyer Protection".

How long should one wait before filing complaints and threatening, etc..... There has to be some sort of protocol here. Do I need to wait 30 days before starting any "official" action? I'm a pretty understanding person when it comes to this stuff, but just flat out ignoring me tends to piss me off much quicker.

I think 10 days is the standard. If you paid and you haven't heard in more than 10 days, file a complaint. Try to call the person 1st though.For rig details, see my profile. Nothing here anymore... -
Make every reasonable attempt to contact the person. In turn, give them a reasonable amount of time to get back to you; which you have done.

This is my final e-mail to the person who is trying to rip me off on e-bay. After this I will be contacting e-bay and paypal to try to remedy the situation. I was able to find a ph# on the internet for the person I may call them Sunday night and see what kind of response I get.

You have to try and call him before you go to PayPal/Ebay. There is always the chance that something is preventing your email from reaching him, spam filters, computer crashed, etc. Its unlikely, but you never know.
I had a buyer who didn't respond to my invoice or emails for a week. I called him and he was like "oh, sorry". His computer had been on the fritz and his ISP had changed as well. He sent me payment the next day and everything was fine.For rig details, see my profile. Nothing here anymore... -

I agree, and I will try to contact him by phone, before filing a complaint. However, I did some checking and he just completed bidding and paying for another auction on Apr 14th, so it seeems his computer, paypal account and e-mail are working properly. He also uses a Yahoo addy, and you can check your e-mail from any computer. So if his computer is down I would think he'd find away to check his e-mail and contact me if her really gave a crap about completeing my transaction! I'm still willing to give him a chance to make it right, but time is definetly running out. If the dispute resoultion on e-bay doesn't work I'm going after him with mail fraud and will try to get the FTC involved. I may even take him to small claims court.....can you tell I'm really pissed right now!

Listen, when someone completely stops communciating after they've accepted money for an item, and have been otherwise prompt prior to being paid, then you need to file your complaint immediately.
There is no grace period on something going this far out.....period.
File the complaint with Paypal and get that done before you don't have the option to do so. If he can prove that the item has been shipped, then it doesn't count against him and they unfreeze his account.
I don't care what his problems are. As a seller he promised shipment of items immediately after being paid. You have EVERY right to protect yourself and make sure that you're not screwed, and if you choose to wait any longer than you already have, you're **** yourself more than trying to help him.comment comment comment comment. bitchy. -

As I stated earlier I found a phone # and addy through the white pages on Yahoo. Late this afternoon I tried to call and of course it has been disconnected. I know there is a lot of "old " info floating around in cyber-space and he has probably moved, etc....I know he still lives in Madison WI, because that's how he is registered on e-bay.
So I filed an official "Non-Receipt of mechandise" claim with paypal. They will try to open a dialoge with him. I've made my response now it's up to him to respond. If he doesn't respond in 10 days I automatically win the judgement. Since we are talking about $125, I'm pretty sure it's covered under e-bays standard buyers insurance which is up to $200. The thing that really irritates me is e-bay charges a $25 processing fee. Why the hell should I have to pay them $25 to give me my own money back? I know it's better than losing the whole amount. Of course this is a 2nd option. It's my understanding that paypal will do what it can to recover the money, but they don't guarantee they will recover the whole amount. If they can't recover then e-bay steps in up to a $200 maximum.
This whole situation just blows.....There are other things I've wanted to bid on if he ends up not sending me the merch, but I haven't because I don't know if the original purchase will ever show up.
Oh well, I'm a big believer in Karma....what goes around comes around, I truely believe that.

You can't 'withdraw' a payment that you've made via PayPal, but by filing a complaint with them, they put a freeze on the guys account and force him to provide information on shipping. If he doesn't do that, he can either refund the money himself, or his account will remain frozen until he resolves the issue.comment comment comment comment. bitchy.

This is the reply I got from the dead beat seller, after I filed my complaint with paypal. This is beyond bull-****.....but if I get the merchandise as stated then filing the complaint worked.
This is a direct quote from him.
"I am sorry I forgot to ship the item out. I will ship it out tonight and include a $10 check for yout trouble."
He FORGOT...How the hell do you forget to send something especially after it's been paid for and someone is sending you e-mails asking where the item is.
