F'n people. Texting on her phone, dumbass ends up in a Mall fountain, and it's the malls fault.

    That mall is local to me. I've been going there since I knew how to walk. The fountain has always been there. I'm pretty sure the local judges will laugh her **** out of court if it gets that far...

    Holy flying F#%* batman.

    Oh no, people are laughing at me for falling into a fountain b/c I'm too GD stupid to look up occasionally while I'm TEXTING AND WALKING.

    The mindset of society today is sad. "Noone came to my aid." It's not like she was in there for more than 10 seconds.

    And her sniffles make me want to reach through the video and choke her @ss out. What an infuriating interview....

    She said no one came to her aid... but at the same time she said "I hope no one saw me".

    Gee.. I wonder.
    She herself even said she could have been hit by a car.

    She was in public, and stuff filmed/pictured in public are...well public domain. It's not like you can tell it was her, and her name wasn't plastered all over.

    She claims she is a mall employee, so she should be more than familiar with the location of the fountain. I doubt she'll get any type of settlement. Waste of the courts time.

    First, this just proves there are too many lawyers out there.

    What is she going to sue for? She was in a public place and was recorded being an idiot. She did not get hurt, got right up and walked away.

    I hate people like this that want to sue for anything. Hopefully next time she is texting near a cliff.

    The main issue appears to be that the video was not taken by someone nearby, but recorded on a portable device from play back of the mall's surveillance tapes. Her other concerns will be pushed because of how the video was obtained.

    Her issue is with the 'security' department leaking the video out. Not with her actual act of falling into the fountain, which she admits was her fault. For the vid leak, she absolutely has a case and will likely get a settlement.

    No she doesn't...she was in a public place and is an adult. She has no expectation of privacy, like if she was in a bathroom.

    The event took place in public, yes. But those recordings are not public domain. It would be different if a mall patron took the video.

    But what about all of the video you see on the local news about 7/11 robberies, or trolley station altercations - they show up all the time?

    I'm not a lawyer, nor do I play one on TV or the internet - what is the legality of releasing surveillance vids from public places?

    Those recordings can be released to anyone for any reason. Its not illegal. Whether or not they'll find some activist judge to hear the case is a different matter.

    as soon as I saw this video clips.. first thing I wrote on FB was she's gonna sue the mall for putting a fountain in her way.. she'll get millions for it. too.. the mall will go bankrupt and hundreds of people will be out of a job. but she'll be famous for 15 minutes and own three houses in Hawaii
