Ebay question

I bought my wife a Tiffany necklace on the 22 Dec 2009. Paid for it the following day. Yes I know the holidays can slow down the postal service but I have yet to receive the item I paid for. I email the seller 2 days ago asking if there was a way she could look up the location of our item. She has yet to reply. Any of our previous email were answered right away. I also noticed she is no longer selling anything. How much longer should I give the seller before taking it to the next step? and asking for a refund/ the item was paid through PP.

The item was coming from Cali and she told me it was shipped the week that I paid for it. I know customs can take long...but it's never taken this long for anything I've purchased either through EBay or CP....and no she didn't get a tracking number. GRRRRRRRRR!

    I would definitely start rattling cages.. but if she sent it via USPS then they can't do tracking.. I know when I sell stuff on ebay and ship to canada the postal service it can take 2+ weeks to get there, I've had items take 3 or more sometimes.. that being said.. if she's not responding then i would possibly take some steps.. and hope that is shows up in the next day or two.

    Put in a claim with Paypal for non shipment. You should have had it by now!

    Agreed. At the very least it will protect you down the road. Also, it should freeze her Paypal current balance.

    I got scammed once on eBay. I tried to "work it out" with the seller, and in the mean time, they were emptying their paypal account. By the time the dispute got filed, the seller completely ignored it, got their account banned, and moved on.

    What happens say the claim gets started and such. and or I get some $ back...but for some reason I get the item...

    I've shipped/received stuff to/from Canada and 3+ weeks by USPS is not unheard of. I've seen Customs sit on things for well over a week.

    However, since the seller is not getting back to you, I'd probably move forward with a claim. It can be dropped if you happen to receive the item.

    Nothing to lose, protecting your payment to gain. It may piss the seller off, but after 3 weeks you're entitled (not sure I would be so patient).

    I had to file a claim once due to an unresponsive seller on Audiogon. PayPal was very responsive and held the money in escrow. In the end, I got what I paid for and PayPal made the seller whole.

    it takes 10 days after cleard payment before you will be allowd to file a cliam with paypal. once the claim is filed you will have an additional waiting cooling period for the disagreement to be discussed .then after the sellar and paypal discuss it you can rebutt. paypal makes a decision then it takes about 30 to 45 days to get your money back. its about a 6 to 8 week process after the initial claim. if it hasnt arrived in 11 weeks it aint gonna lol. if it does you can cancel your claim at any time. also usps doesnt have a tracking per se but it does have delivery confirmation so look into that as well. i hope this helps. take care ,dan

    I'm in the middle of an eBay dispute myself right now. I started out filing a dispute with Paypal. The seller has still been unresponsive. Finally, I remembered the Paypal transaction was via a Visa card. So I'm just going to charge the payment back. As I understand it, Paypal will then charge the seller back. Many credit card companies won't let you dispute after 30 days, so be sure to know what the rules and timeline are. Chris

    Just for good measure, I'm going to keep the junk printer this creep sent me for the ink cartridges and print heads. See how he likes it when I ignore HIS e-mails. :eek::eek:

    would suggest to file the claim. you only have a certain amount of time to do it in, and better to be safe than sorry with transactions. Worst comes to worst you do the claim and then get the item, should be able to drop the claim fairly easily, never had to do it but I don't imagine it would be too bad to do.

    2 weeks? Hah, I bought my NAD CDP from Canada (Canada Post to USPS) and it took them 7 weeks to get it here...I hate shipping services, except UPS; they have never screwed me over.

    Contact ebay first with this and see if they'll give you a phone # for the person to contact directly. Keep in touch with them as per progress.

    I had to do a dispute thing with them a while back over some speakers I won. Called & left a message, no answer.
    I had not paid the dude yet though, because he had mentioned a shipping variable in the auction. He had alot of good past sales history & feedback, but picked this time in his life to become an idiot.

    The problem with "just waiting" is that most scammers do just that. They'll string you along just long enough to get you past the dispute cutoff, and then drop all communication. Cover YOUR ****. Screw the seller's "feelings."

    Open a "dispute". If after 30 days you've heard nothing and not received the item you can elevate a dispute to a claim. I've done over 150 transacitons on ebay and opened several disputes and only had to elevate to claim once and then I got my money back .

    PayPal gives you 45 days to file a dispute. Most eBay items paid thru PayPal these days are covered 100% regardless of what money the seller has in their PP account. All the factual information you need about time lines and filing are listed on eBay, you simply have to look for it. You can even file a claim thru eBay instead of PP (one and the same really), which is actually faster than filing thru PP.

    I'm going to file today. I look through Ebay claims and try that. PP claims seems very easy though

    Ok so it's done. I now have till Feb 4 2010 before they close the case. So If I don't hear from her or like what her resolution will be, I can proceed to the next step on or before that date.

    Paypal and Ebay are the exact same when it comes to filing a claim. As F1 stated you have 45 days and if it's decided in your favor you will get your money back regardless of the sellers status. Expect it to take 4-6 weeks.

    I was just in a dispute with a seller for a dead tube. Opened my case (thru Ebay) on 12-2-09 and it was resolved (money returned) 1-11-10.

    If you buy on Ebay Paypal covers everything regardless if the seller can pay.

    If the item comes you can cancel the claim at any time.

    the times that i've done disputed I've always given the other person a few days to respond.. you don't have to give them til the 4th by any means but if you want to give them the weekend. I don't think that's a bad idea.. as I and couple others stated before shipping to Canada sometimes takes several weeks.. its just a shame that she's stopped communicating with you.

    That's my issue as well. If she told me something happened to her and didn't get to shipping it till last week. Then I'd be ok. But 4 days with no reply! :mad:

    Maybe I misunderstood. Are you saying you have until Feb 4 BEFORE the time ends to dispute the sale or that you already started a dispute and you have until Feb 4 to resolve it.

    But yes, it's always best to try and work things out amongst each other. In my bad tube case even though I opened the dispute the seller and I still tried to work a solution. The seller was a very rude and nasty man and was being totally unreasonable in what he was willing to do to settle the issue.

    His main issue is he felt he sold me the tubes too cheap (hindsight) and wasn't going to give me a full refund of what I paid because I got such a "good deal" from him. He listed a no reserve auction starting at $9.99, not my fault if he realized after the sale he *might* have gotten more. So he was trying to "punish" me for getting a better than average deal.

    He was rude and nasty calling me names, etc..............after dealing with that for a few weeks I just opened a dispute case. We still continued to try and resolve the issue but he was completely unreasonable and just wouldn't let the idea go about how I should have paid him more to begin with.

    In the end Ebay/Paypal came through for me and refunded the entire amount incl shipping when they confirmed I had sent the tubes back to the seller.

    The seller gets 7 business days to respond. If they don't respond at all then you win by default.
