    Brett - glad it worked out! I'm guessing when presented with the facts, the in-house lawyer took a break to clean out his/her shorts and then said "pay da'man!".

    When I talked to her last week, she said that they'd been over it with Legal and they determined that I wasn't eligible etc etc and I told her "I'm having a hard time understanding how you're in any way able to justify that you notify me I get the package, set up a meeting to discuss the package, go over the package, deliver the package, and then only after I've left call and say 'Oops, you don't qualify' "to which she said she'll check back with them and get back to me.

    I've had to present them with the facts a few times over the past few years, and it always makes me happy to see the tail tuck back away......

    It's a bittersweet thing, most definitely.........I'd probably get at least double for them tryin to play the game they wanted to play......oh well.....lol.

    They felt vulnerable and probably would have lost a court case based on the facts as you descrive the. Their legal Dept. probably told them how much litigation would cost and they gave in pending the cost.

    Congrats Brett! I'm glad it worked out for you. Litigation would have taken three years:mad:

    I don't think Legal got the full story until the second time HR decided to tell them.......at that point, I'm sure it was a no-brainer.......

    It reminds me of a a quote they made several times a few years ago where the HR people said to me "If there's one thing we've learned in all of this, it's that we need to communicate more..." It makes me laugh just remembering it.....lol.

    In my limited understanding of contract law (Real Estate Broker), there was an agreement or contract that only required one piece to be executed. That piece was the acceptance letter. This was a unilateral piece that bound the contract as opposed to a bilateral piece that would require actions on both sides. Usually a contract is only bound only by acceptance and valuable consideration unless specific provisions are stipulated otherwise. Their legal-ese in their non-generic agreement letter left them open to you singing and binding the contract whether it was "in the system" or not. In MA, you would be entitled to Treble damage and reasonable Attorney's fees (insert joke here).

    Cool that you got it sooner rather than later, but it would have been nice to "make those **** pay" three times over. F'em. Who's starting the Lawyer joke thread?

    I agree on the making the **** pay part.......oh well......now it's time to use up Cobra and job placement and squeeze every last penny out of the losers.
