far as the speakers are concerned, why would it be the sellers fault if UPS messed up the speakers? I didn't read the whole thread but got the jist of it. I bought a pair of rti38's a few years ago and the same thing happened, corner crunched alittle and the tweeters actually fell inside the cabinets on both speakers.. they popped right back in, These were brand new also.. I asked the seller what we could do, he offered i send them back and do a claim or he'd give me i think 30 bucks back.. They worked and the dent was minute... I took the 30 bucks and saved the hassle, If its factory packing they should/will pay the claim.. Ive done plenty of claims with fed ex and they told me factory packing is acceptable for a claim.. if the speakers work i think 50 is admirable(sp) or just send em back and do the claim. I still never understand why on e-bay anyway that people think its the sole problem of the seller when fed ex and UPS eff up a package.MY HT RIG:

Because Cliff, it is the responsibility of the Seller to provide the Buyer the product as described. The product is not working and the product is damaged. That is why the Seller files the claim with UPS. If the pictures or ad description do not say the tweeter is broken or the cabinet smashed the seller has little to stand on.
We had a member cant remember who, he sent a sub to some lady, it got scratched, she went to courtover it, she won.
When I filed my dispute with Paypal they had not yet invented all of the fee's. Those boys can make money outta watching the grass grow.

are you sure there is a charge to file a claim? i just checked my account and i did not see any charge from a recent claim, and i got my refund from that vendor the next day.
this is what i saw on the paypal site:

Yep, there is a fee. I filed a claim once and believe I was charged $20. Hey they( PayPal) have you over a barrel. It's better to get most of you $$$ money than none at all. I do beleive if they do not recover the $$$ for you they don't get the fee, not sure though

I have filed several PayPal disputes over the years, and there has NEVER been a charge to do so.
I wonder if there's a difference between nonupgraded and upgraded (Premier) PayPal accounts... mine is the latter. -
RT1 i agree to an extent, But **** a seller because you didn't get half your money back via a charge back is bogus and not sound advice.. If they were advertised as new and its obvious it happened in shipment, Its not the seller who is at fault its The shipping company, Of course around here we'd like to expect the seller to front the money for the claim or work things out, However as a seller on e-bay, its not feasable to be sending buyers refunds on their word, That's what a claim is for.. Ive had buyers say they had damage and wanted partial refunds, soon as i said send it back for a refund they said, "oh its not that bad forget it) You guys like to think you can just trust someone to send the item back or be truthful about the extent of the damage is their even is any.. Look at it in the sellers eyes.. I buy something, say its damaged, and request half my money back, So he obviously didn't have a problem with the damage that much, and when offered 50 bucks which is fair IMO he refused and is erged to do a charge back in which he gets 100% back and the item.. Is this fair? Ive sold for a looog time, No negatives and one neutral in 7 years.. Think i'm doing something right? or just luck after all them years.. Id like to think i know what i'm talking about, and respect what you think.. But i don't think anyone else here does e-bay for an income/business.. Not that makes me right, but i have a good idea on many situations involving sales and e-bay.. I'm done though, shaft the guy and do a charge back and be done with it.

The speakers do not work. Although they are in the original packing, that packaging sucks. There is no padding in the box at all, just a piece of cardboard between the two speakers, and a piece of cardbord on the top and bottom. The speakers were less that half an inch from the outside of the carton. Don't you think it is the sellers responibility to package them correctly? I know if I had shipped them, they would have been double boxed at the very least, as it is obvious looking at the package that they would more than likely not survive UPS shipment.
In order to pay a claim, UPS checks for proper packaging. Here are UPS guidlines for proper shippimg, note the 2 inches of cusioning required:

BTW, there is NO obvious damage to the box, so for all I know they could have been damaged before shipment.
The seller has been unwilling to accept any responsibility, and after I turned down his $50 partial refund, has informed me that he will do NOTHING, not even file a claim with UPS. The tone of his emails has been threatening since the beggining.
I filed a dispute with PayPal this morning. Here is a portion of the email they sent me:
"Our investigation will be made on a best-effort basis and PayPal cannot
guarantee funds recovery. For transactions that do not qualify for PayPal
Buyer Protection, eBay will provide Standard Purchase Protection for
$200.00 USD coverage with a $25.00 USD processing fee. For more information
about our Buyer Protection Policy, please review the PayPal User Agreement"
After filing the complaint, I logged into ebay, and the item now shows as unpaid, and the "pay now" button has reappeared. Is this normal? -
Does anyone know the answer to my last question? I am concerned that the item now shows as unpaid, and that the "pay now" button has reappeared.
Can a seller make that happen? Or is it PayPal or Ebay?
