I wish I had found this thread sooner and read about your problem. I called fedex and spoke to their claims department. The seller or buyer can file a claim up to 21 days after delivery. However, since you have made repairs to your speaker already, even if you file a claim, the only way you could get some money from fedex is if they cut a check without inspecting your speaker and box for the damage.
Paypal insurance won't be available if the item you bought was insured.
MasterCard won't insure damaged USED items. I'm not sure about Visa.
If you feel it's worth a try, call fedex at 1 800 463 3339 and say "claims" when you hear the recording. If they don't help you, try the fedex Pittsburg claim office at 1 877 602 1166 x7401 When they ask you to provide "proof of value" you can print a copy of your internet receipt and fax or mail it in.
If they decide to accept your claim and cut a check, it will go to the shipper of record (the store it was shipped from). The check will be in the name of the shipper. You need to get the shipper to get the check from the store, cash the check and give you the refund. UPS handles their claims the same way.
Finally, if the shipper decides to keep the money, read ebay's buyer protection policies. Ebay will refund your money if the seller keeps the insurance refund and either suspend or terminate the seller.
Don't email bidders of that seller you are having problems with, it is against ebay policy and you might have problems. I can't locate the link for this right now, but I read about it on ebay.
Another option is to carefully read ebay's buyer protection policies. There may be a form you can fill out explaining that the shipper has moved and is not working with you on an insured item. Ebay may exercise their insurance policy and offer you a refund. They may also suspend or terminate the seller. You can also file an ebay dispute to see where that leads. Type in "dispute" in ebay's help search.
These options are better than filing a negative feedback, since they can retaliate and give you one too. -

Thank you for the info. FedEx actually did pick up the speakers and did an inspection. I think if the shipper ever gives a release to FedEx to settle with me I should be all set. The problem here is the shipper has his money and is not very motivated to get this resolved and the bigger problem is the FedEx customer care office. I faxed them my PayPal info five times before they said they received it. I got an email from the shipper and he told me he has faxed his info three times and FedEx still has no record of it. I said it before and theres no doubt in my mind that FedEx has a policy to put you off till you give up. I know this wont amount to a pee hole in the snow but on my job I ship things a few times a week and will never use FedEx again.
