Received UPS damaged LSiC

I got my LSi Center speaker back today which was damaged by UPS. Anyone following this knows I shipped it to the buyer, it got dropped really hard and was sent back to me. I already returned payment to the buyer so now it is between me and UPS. Hopefully they will pay for it.

What I wanted to say here is that I think Polk has done a much better job with their xovers than they used to on the SDA's. The xover in this center broke off on all 4 corners where it attaches to the posts which are molded into the terminal pad. Funny part is that both the terminal plate and xover was damaged. 3 places the xover circuit board broke and one place the molded post broke. In polks defense the packaging saved the speaker box but it was hit so hard that the foam ends around the speaker was squished and allowed a few little marks on the cabinent (from hitting the cardboard). The older SDA xovers and boxes would have disentegrated under this type of abuse!

I am very impressed with the build quality here. Given the force of impact the whole box should have broken in pieces! Polk has really done their homework here.

    So UPS calls and leaves me a message: We see no damage to your speaker and will send a letter explaining this to you. The speaker was laying against the cardboard box when we received it. The packaging was not sufficient. Thank you.

    Well yea it was laying against the cardboard, you hit it so freakin hard that you squished the 3/4" foam endcaps into a 1/8" strip of nothing!!!

    The factory packaging was not sufficient?? The foam endcaps were thick at the top and squished down to nothing at the bottom, and it was totally obvious!! Any moron could look at it and see the extensive abuse it would take to cause this. Good thing for them I was not here to answer the phone!

    Good luck madmax, I've had to deal with UPS the past week and I've been less then impressed with their abilities to track a package, read email or listen to voice mail. :rolleyes:

    Max, you used the foam packing Polk provides? UPS *CRUSHED* it? Dude........UPS outta deal with that one. That is LAME.

    all polk towers i bought have had the styrofoam cracked and in pieces. but the cabinet was only damaged on 1 occasion, took it back and got a new one.

    Yep. It was the original packaging and fully intact when I shipped it out.

    I wonder if Polk packages to any specific industry standards which I could quote to them? You know, like ansi ****.x.****.xx or whatever.

    I think my company does something like that but I'm not sure what standard it would be.

    Oh yea, the towers I understand but the center packaging is almost bullit proof. There is a well design molded endcap on both sides which will not come out of place inside the box. VERY ROBUST!

    whoop **** on that box! Madmax did a very quick refund. A+ person to work with.

    Did find a new LSIC for $359 free shipping "black market".
    They 2x boxed it for free.

    I'm glad to hear you got a good one!

    Now, for the ****:
    I received my letter from UPS:

    Your claim has been denied. UPS will not assume liability for packages which were damaged before UPS pickup or after UPS deliveey.

    This is even different than their previous phone message which said the packaging was not sufficient! Now I'm **** pissed off.

    The speaker (and packaging) was mint when I packaged it and the buyer got it damaged. How do I go about this?? My thought is that I will have to file a small claims suit against UPS? Is this the proper dialog? Do I have to turn this into a pissing match for them to do something? I plan on spending the weekend taking high resolution photographs and preparing a multipage document to fax to them. Any ideas on how to procede?

    Sounds like small claims court is the only way to go Max.

    I doubt you've exhausted your UPS options as yet. There's likely to be an appeals office...

    take your problem to the highest person in UPS that you can.

    short story here:

    A friend of mine got a lemon hot tub. It kept burning up motors. He replaced the motor twice in one year. Then he had to replace some sensor twice. He kept working with the local distributor of the hot tub.. they kept replacing this part and that part. Finally after putting in over $1300 in parts over a year period. He finally wrote a letter to the president of the company. he had it hand delivered to the president by another friend who was attending a retreat that the president of the company was also attending. He hand delivered the letter. Within a week. He had a brand new hot tub. Better than his old one.. he hasn't had ANY problems with the new one. Knock on wood. :p

    point is.. taking your problem to the highest person in the company will get you noticed, and get you some results too.
