    A 50 pound dog is not a threat. I dealt with bigger dogs than that running/bicycling in the country when i was 13 and 130 pounds. The officer is easily 5'10", 215+. A simple kick would have dealt with the dog and probably not have been fatal...and we wouldn't be here today. I've never heard of a utility working shooting a dog...and I guarantee they deal with it a lot more...

    What I don't like is given the 911 call, why he had a gun out in the first place. Next, why does he have to point it at Mikey when he didn't fit the description. Like you said, we're all people. When you have a gun in your face, you're not thinking clearly or acting like you normally would. This officer was playing Billy Bad **** and going around screaming at everyone like he's there to whip some **** instead of protecting people. The dog runs at him because of it, what dog wouldn't?

    I love my dogs. I hate stories like this. That being said, the laws apply to all dogs. The drafters of dog laws silently assume all dogs are dangerous. Austin, TX law says the following:

    3-4-1 UNRESTRAINED DOG PROHIBITED.

    (A) Except as provided in Section 3-4-4 (Public Areas Where Restraint of a Dog is Not Required), an owner or handler of a dog shall keep the dog under restraint.

    (B) A person holding a dog on a leash or lead shall keep the dog under control at all times.

    Source: 1992 Code Section 3-3-2(A) and (B); Ord. 031009-9; Ord. 031211-11.

    This standard is set to protect the public from dangerous animals and also to protect animals from being misconstrued as violent despite being gentle in nature. Losing a pet is never right, but the owner should have made sure his dog did not exit the back yard or the house.

    Confinement of dogs
    It shall be unlawful for the owner or keeper of any dog to fail to keep at all times such dog either:

    (1) confined within the premises of the owner;

    (2) firmly secured by means of a collar and chain or other device so that it cannot stray beyond the premises on which it is secured; or

    (3) under the reasonable control of some person, or when engaged in lawful hunting, exhibition or field training.

    I'd say this circumstance would fall under #3. He had reasonable control of the dog. What he didn't have is a reasonable circumstance. If this cop was a bad guy, the dog would have been hailed a hero. The dog was in the back yard. Had the LEO not escalated the situation by needlessly pointing a gun and yelling at Mikey like he was a criminal (even though he didn't even fit the description of who they were looking for), the dog would have never felt that his owner was being threatened and wouldn't have acted like he did.

    The fact is that LEO should not have the ability to go in your yard with a gun at you, screaming to get your hands up, then murdering a dog that reacts like any dog would. If he wasn't on such a power trip, this never would have happened. He's the reason why police officers get such a bad rep. He was careless and wreckless and an innocent man's dog died because of it.

    I'm sorry....but this is one of the silliest statements so far. The guy is in his fenced back yard playing with his dog where it should be...sees a cop approaching in his driveway...THEN has a gun pointed at him and told to raise his hands and not move. How exactly is he supposed to keep the dog in the yard? If he moves to stop the dog...this cop may have shot him.

    This one is 100% on the cop. Trying to lay any blame on the dog or the owner is ludicrous!

    The statement is silly because the whole situation is ridiculous. I'm not arguing that the officer is not an idiot. I am stating in so many words that I never let my dogs out of my control because I know the world is stupid and the law recognizes that.

    Maybe we are talking semantics here...but he had control of his dog until the cop showed up and made it impossible to do so. Yes the situation is ridiculous...and it is a shame this policeman will suffer no consequences for his actions.

    Yes. Until then he had other non lethal tools that he could have used, Peperspray, Stun Gun, Taser, Baton, or Knight Stick. I garuntee you could get the job done with one of those even with a 100 lb dog.

    The cop tells you to freez and put your hands up. Then tells you to get your dog and shoots it. If the owner would have moved fast to secure the dog he propbably would have ended being shot for makeing a fast move.

    Not saying the officer was right because I think he went into this situation WAAAYYYY to aggressively.
    I believe the cops in Austin are a little on edge right now. In the last couple of weeks APD lost one of their own to a drunk in a Walmart, another cop shot and killed a drug dealing lowlife that took him on after a foot chase, and was trying to choke the cop with his own microphone cord while attempting to get his gun.
    Of course, the lowlife's family is all over the media saying the shooting was unjustified and the cop had no reason to shoot the" nice young man" who was trying to kill him.
    By the way, the nice young man had a rap sheet as long as both my arms, including multiple violent offenses as well as kidnapping.
    It's no wonder the police chief was admitted to the hospital with chest pains today.
