Paypal Coughs Up Court Settlement Cash...To Me

I purchased a Sony tuner in 2004 off eBay. The tuner was shipped poorly packed and arrived damaged. In addition to this, aside from the shipping damage, the tuner was not in as good cosmetic condition as the seller indicated in his eBay add.
When I contacted the seller, he said he thought I was being too picky about both the shipping damage and the cosmetic condition since the tuner worked as stated in the ad, but he would take the turner back and refund my money when he received the UPS claim settlement. He kept the UPS settlement claim and my money.
Paypal said they would not intervene because it was outside of the 30 day refund window. I explained that I allowed the window to close because I was trying to work with the seller as he waited on a UPS damage claim.
In 2008, I received notice of a class action lawsuit pertaining to Paypal claims refusals similar to mine. I met all the requirement of the lawsuit class and promptly filed a claim form with supporting documentation. I then forgot about the matter.
Yesterday, I received a check for $361.70, which covered the original price of the tuner plus several years of judicial interest.
In ten years of dealing with eBay, this is the only case where I had lost money. The only other negative experience was a non-paying bidder who left retaliatory negative feedback.
I wonder if Paypal will now go back and ding the seller's account for their court settlement loss.:biggrin:

I've never had any problems with Paypal and dispute resolution, period. I hear horror stories and "I'll never use them again" type crap but nope, never a problem. To boot, more entities are going with PayPal so you'll end up using them at some point, regardless of your moral stand.
Good work DK, due dilligence pays off and they must've thought they were dealing with a 18 year old or something. Little did they know that you have done extensive writeups on cables, inductors, built one of a kind products and are the spectrum analyzer guru when it comes to audio cables...pffft, amateurs. They clearly didn't know who they were dealing with....CTC BBQ Amplifier, Sonic Frontiers Line3 Pre-Amplifier and Wadia 581 SACD player. Speakers? Always changing but for now, Mission Argonauts I picked up for $50 bucks, mint. -
I'm sure I'm in the minority, but I just can't see how PayPal owes you anything. You filed a claim outside of the agreed upon window to do so, and it's not really THEIR fault you got scammed.
What if you had written the person a check? Would the bank that cashed the check be liable? The US Mint if you had paid cash?
I know you didn't initiate the lawsuit, and I'm happy you got your money back, but... just doesn't seem like the right person got screwed in this deal, even if it is a huge corporation.If you will it, dude, it is no dream. -

Hey, don't cash the check for 90 days and then sue them again when the bank won't let you cash it. :rolleyes:

It is right and initially a huge problem. Probably why the lawsuit was initiated.....DK can clarify more I'm sure.

30 day window is BS IMO. It should be encouraged to work things out before involving a 3rd party...not the other way around.

Congrats on getting the money back, but unfortunately, PayPal is still up to the same practices.
My brother got totally screwed last year by PayPal, Ebay and his credit card. He bought a piece of test equipment from a seller in Indonesia. The seller had great feedback (over 500), but the item arrived in non-working condition. The seller agreed to let him return it for a refund, but my brother had to pay significant $ to ship it back to him. There was no offer of sending a replacement free of charge. Weeks went by and he didn't get a refund. The seller was not returning messages, so my brother left neg feedback and tried to make a claim, but it was too late. The seller decided to not refund since my brother left neg feedback and so my brother was screwed out of the cost of the item+ 2x shipping. PayPal was no help, his credit card was no help. Flat out thievery and nothing could be done.
Moral of the story is if there is a problem with the transaction, always file a dispute with Ebay/PayPal even if you are trying to work things out with the seller. You can always cancel a dispute, but if you miss the deadline, your screwed if the seller doesn't make good.For rig details, see my profile. Nothing here anymore... -

there should be a way to start your claim within 30 days, also alerting that the process is ongoing with the seller, and if the seller does right the claim will be waived.
Might be that way, dont know,but sounds like a good middle ground, cover yourself, but reserve your rights if seller does wrong.humpty dumpty was pushed -
That's exactly how it does work, if you're in a situation like that communication with the seller is key. Explain why you're opening the dispute, and that you'll be perfectly happy to cancel it once things are resolved.
