A threat is "I'm coming to get you." The OP's commments COULD be taken as advice, and not a threat. I don't know his intent....but neither do you. I'd give anyone the benefit of the doubt until and unless it becomes clear a threat was intended.

I understand the rules on selling gear, but not everyone reads all of the rules in the forum they just joined.
Yeah, I wouldn't read the rules if I was just signing up to try and sell something on another members thread.

I agree with you IN THEORY about being nice, but are you freaking serious, man? How can that be misinterpretted? Maybe he was giving advice, but why then not post it on the thread as a whole instead of sending a private message. Here's one reason why I disagree with you and why I think you're being naive:
He opens his "advice" PM by addressing HTguru as "son". This is an obviously condescending and inflammatory name to call someone with whom you are not for familiar. His following statements, within the negative context set forth by the previously noted preface, leave no ambiguity about his intent: he was trying to intimidate one of our members, and that is not tolerated here.

Sorry but regardless of what you think, a PM like that really is uncalled for, and in the first place why would a normal person say something like that. I live about 2 hours from Milwaukee and yet would have no desire after reading what was said to a member to do business with someone like that.

Correct me if I'm wrong but if you're new with less than 100 posts trying to sell something in the flea market, aren't you greeted with an alert message saying you don't have permission or whatever to start a thread in that particular section of the forum? And on the old forum, I believe there was a sticky with the title "100 posts required to sell". Of course I could be wrong on both counts. But I believe people know they're breaking the rules simply because they don't start their own threads - they hijack others.
I sent jsampson a pm myself, and admittedly it wasn't very friendly. I told him about the rules and that if can't follow them, then he needs to take his stuff elsewhere. Mistake on my part, I Know. I sent both messages to a mod. Well guys, many of you continue to make my point for me again and again. I'm not saying there was or was not malicious intent on the part of the 'offending member.' If you are able to read minds you should be working on Wall Street, not posting here.
All I have said is that there was room for misunderstanding and that we should all give the benefit of the doubt until malice is obvious.
For my suggestion, I have been called naive (twice), told to 'pull your head out of your butt', and generally told I'm an idiot because I don't assume from a single email that this guy is 'a douchebag', 'a ****', or that 'he has serious mental problems', or that 'F*ck that guy. We don't want him here' is an approriate.
Let's all remember that his original post was met with a not-particularly-polite response of 'No one's interested. Put it on Craigslist or eBay'. His response was not particularly polite, either. However, responding impolitely to an impolite post is understandable. I wouldn't have done it, but I don't call people 'douchebags', either.
By the way, many of those who have posted responses in this thread are guilty of violating the forum rules. I've copied them below.
Check out the "Very Important" section, along with item number 5. Especially pertinent is item number 8 about being respectful of new members.
I'm dissappointed that those who claim to be so concerned about the rules are breaking them so flagrantly.

Reacting to a hostile post with more hostility puts YOU in jeopardy, and risks your account from being deleted. To be objective and fair about situations where forum members are attacking each other, BOTH members' accounts will be removed from our forum (and no, we don't care who started it).
Polk's Warning System...
The warning system is in place to ensure that the peace is kept. The offenses are as follows:
1st Offense: A private warning sent via PM
2st Offense: A public warning issued and the closing of the thread
3nd Offense: A 7 Day suspension from posting privileges
4th Offense: A 30 Day suspension from posting privileges
5th Offense: A LIFETIME BAN
The warnings have a one year shelf life. They will expire 1 year from the date of the initial warning.
*Polk Moderators can decide to skip the minor warnings and go directly to the lifetime ban based on severity of the offense.

In response to the discussion about the threats from the guy in Wisconsin: The poster rtart has a valid point and rather than have the cops haul him off to cyber jail maybe a little kindness would be in order. Well lets put it this way. Since the new poster couldnt create his own thread in the FS market due to lack of posts, he bumps another sale thread from A YEAR AGO to try and sell something.
When I first joined the forum I tried to post about a set of R50's I had for sale not knowing the rules, but once I saw you needed 100 posts, I didnt go back to post in another OLD sale thread just to bypass that rules.
Just because you assume good intent from everyone you met, doesnt mean thats what your going to get. We protect our own here at Club Polk which is why I like coming here. A new person with no reputation trying to sell something is one thing I am wary of as they have no track record. I am one of the guys that called you naive. It certainly wasn't to insult you; it was pointing out that a threatening private message sent to an individual is not meant to educate the forum as you claim. Additionally, the fact that you have to argue that point repeatedly makes me think you like to argue just for the sake of arguing instead of actually admitting that you are wrong and moving on. It was a threat, plain and simple. And while I wouldn't be alarmed by it in the least, it is banworthy and is something that should not be tolerated on this or any other foum. Manning up and admitting you are wrong is much better than posting the rules of the forum to support your ridiculous argument.Shawn

As John knows, I work in law enforcement in one of the biggest agencies in the country. The message was a threat and, yes, a report can be filed as a Threatening Message (misdemeanor) or Criminal Threats (felony).
The determining factor would be intent, and his statement can certainly, be understood as an intent to threaten. -
Thanks for the info, leftcoast. I told jsampon that I sent his message to the mods and if he sends me one more message that I would file a police report. Thanks to one of our members, I have all the info I need on the guy. I haven't heard back from him so hopefully he's long gone.
