    The rules were approved in the final months of President Barack Obama's administration but hadn't taken effect yet. Under the bill Trump signed Monday, they never will — and the FCC isn't allowed to try to pass new rules.

    True, and they use your data to target ads at you (Facebook and google and the kings here), but there is a major difference: They don't SELL your data to others.

    Per NPR last night, Washington state is about to pass a law making it illegal in that state for internet companies to sell individual customers browsing histories. 20 other states are working on similar laws. This is because of constituents' outrage.

    This will inevitably end up in the Supreme Court. Hopefully Gorsuch is a true conservative...

    While I'm not surprised at all that this occurs, I am surprised the company could be so negligent in: first, not having mention of the gathering sale of information in their user agreement at ALL (according to the article), and second, not informing the customer of these practices. One could easily manufacture a legal argument for the latter, but the former leaves them literally defenseless against whatever case this plaintiff is bringing.

    Bose better get a new legal team...

    It depends what you mean by sell here. Their major PR coup is that they don't sell your information to other companies to use as they see fit; instead, they rent it to them, per se, by targeting their ads to you, using your data. This is obviously better than giving out our info, but still...

    Can't people just use the things without the app? How much can an app allow you to get the most? the most what? My Grado's don't need an app. I fail to see how an app can get you the most.

    The headphones in question are a wireless Bluetooth model. My guess is the app is a third party developed app anyway. From what I understand it is possible to use the headphones without the app but using it with a smart phone opens up more controls through the phone than would otherwise be available.

    I doubt the lawsuit will go anywhere. All apps and websites track users to some degree or other and it is not clear Kyle Zak has proved Bose knows whether he listens to One Direction obsessively or anything else. It is an allegation. But, I do think it is wise to understand that no electronic communication is really private.

    I work with a couple of people that have the Blows cube surround setups, both of them think they're the best thing ever. I'd love to educate them, but it's not worth the effort.
