Two speeding tickets about to go on my record...

Well I think I pretty much hosed myself. I got a speeding ticket going 52 in a 45, paid the fine and signed up for Defferred Disposition. Which means I have to take a driving class and not get convicted of another ticket in 90 days. Well last month I received another speeding ticket driving 42 in a 35. I decided to go with deferred disposition again but in this county they charge an extra $120 to do it, all in all $300. The Judge said I had until Tuesday to pay it. I signed the document and stupidly didn't read through it thoroughly. When I went to court clerk I asked if her they had any payment plans, because although I had the $300 would be better me financially if I could break it down in payments. So I asked her, and she said I needed to ask the Judge and I can see him a week later. So I said ok.

Well it turns out that by going to the court again they are considering it a showcase hearing which I guess is there to explain to the judge why you failed to pay, etc. So the first I talked to him today I told him I asked the clerk on Tuesday if there was a payment plan, and she said I would need to come today to ask you. He said you can ask, but I don't do payment plans which is a lie, because I heard him offer it to other people. So he says I can pay it in 30 days, but it's going to go on my record. I told the lady who takes care of the paperwork that I still want to do the defferred and since he denied the payment plan i'll pay today. She said that he's not allowing me to do deferred anymore, and that I have to pay the $295 fee anyways and it'll go on my record.

So I talk to the Judge again, told him I made a mistake I told him the clerk never told me it would compromise the deferred disposition if I went today to ask you. He's said it's too late, I then asked him why am I still paying the extra $120 instead of $177 which would have been if I didn't sign up for the deferral. He acted like he doesn't deal with the fees and he's not going to argue with me.

So by this ticket going on my record it's most certainly going to cause the other one to go on my record too. My only hope is trying to talk to other Judge to see I can still keep it off my record which I'm sure won't happen.

Do I have any options? Definitely a lesson learned, but just wanted to know if anyone knew of any course of action to prevent both of these tickets going on my record.

The document pretty much states I waived my right to a jury, appeal, and that I have to pay this fee.

Is it to late to bring a lawyer to work this out for you? It may help, but I'm not sure.

    You don't.

KrazyMofo, get a lawyer. That'll be the best $300 you ever spent.

You're right I did get a ticket in the beginning of the year for making a U-turn, and I took a driving class to keep it off my record. So I had to deferred to get these two tickets off my record. Not a good year for me, obviously I need to get my act together and stop getting tickets.

I don't know if I have any way to prevent these two at this point. I don't know if I should get a lawyer for the first one. If I can get atleast one to stay off that would be fine.

Sucks man. I just had to go to court in Irving this week for some old (over 6 years) toll fines. I got off a lot easier than I thought I would.

You may just call a local attorney and see what they say. Just curious, which court were you having to go to? I want to make sure to never get ticketed there. So far my experience with the Irving JP and Allen court system has been fairly pleasant considering.

The one I got first was in Murphy, don't have any issue with them. There my only hope at this point. Farmer's Branch is the one who I oficially hate now.

I'm considering it, I never had to deal with a lawyer before. I know someone who said they were able to keep a DUI off his record with this lawyer. So I'm going to see about contacting him.

Do you guys have ticket attorneys in your area? It ends up costing the price of the tickets, but you have a clean record.
Please. Please contact me a ben62670 @ yahoo.com. Make sure to include who you are, and you are from Polk so I don't delete your email. Also I am now physically unable to work on any projects. If you need help let these guys know. There are many people who will help if you let them know where you are.
    Thanks
    Ben

I'm sure there is. I'm going to start asking around. I should have just paid the fine on Tuesday.

I'm glad I don't stroll through Farmers Branch much. I don't remember if there is a ticket attorney that advertises on The Ticket or ESPN radio, but you might check their websites just in case. They might have a free consultation for listeners. Good luck man.

Well that's what he told me he said there were some other circumstances don't remember the whole story. But I do know he was charged with that, and he ended up getting a lawyer to take care of it, I'll ask him again if I decide to go the lawyer route.

Texas sucks. Two tickets for 7 over? In Georgia, local cops can't even give you a ticket for less than 10 over. State Patrol can, but not local cops.

I'd definitely check with a lawyer. There may be some anti-speed trap laws that can come into play.

That much of a ticket for 7 miles over is complete ****. Just a scam to steal money from citizens.

I understand that "brekaing the law is breaking the law" but c'mon. There's no way that's a 100 dollar offense.
If you will it, dude, it is no dream.

It's probably not a $100 offense. The last ticket I got was for 6 over, and I actualy was doing 6 over, not more. $10 fine + $110 court costs + $25 state fee = $145.

The "court costs" are a complete scam. I didn't go to court, I went to the county clerk, signed the ticket, and paid the fine. What court cost? Or maybe they pay the county clerk $2K an hour?
