Well the Adam Walsh Act provision which allowed the Federal Bureau of Prisons to hold sex offenders deemed "sexually dangerous persons" passed their scentence term expiration date has been ruled unconstitutional by the Fourth Circuit Court of Appeals. Not suprisingly most of the pediophile's and sex offenders to whom the Walsh Act applied were being held within the Fourth Court's district (NC). It should be noted the Fourth Circuit has traditionally been viewed as conservative and supportive of the law enforcement community.

The Bureau of Prison's is exploring the possibility of its own appeal of this ruling. However, the Soliciter General will make the final decision on any appeal process. Furthermore, the Fourth Court did not order the inmates to be released forthwith and allowed release pending appeal.

Rest assured they are among us, everywhere.

    Probably about the worst situation to ask this question, but why would it be *legally* allowed to hold someone past their court sentence?

    itd be nice if offenders are tattooed with some kind of signs to protect good citzens of america especially kids!!!

    i have an alternativ approach to this problem... seeing as though those opposed to the death penalty for child molesters are those that likely support abortion rights, perhaps we just call for retroactive abbortion, after all if the parents had the knowlege of what a waste their child was to become they certainly would have cohsen this option of abortion in the first place. baring this they should go live with the judges and their fimilies

    The Walsh statute was passed into law by Congress. The law said the Federal Government would need to certify that a sex offender releasing from prison was not sexually dangerous, the Attorney General as the nations Top Cop and head of all DOJ agencies tasked the Federal Bureau of Prisons with this certification. These inmates go through extensive testing/interview/counseling done by professionals in the field, those found to meet the provisions of the statute were held.

    There have always been people held past their term, if you want to go away forever, make a viable threat against the President. We have held the Mariel Cubans for years as detainees.

    We will have to see what happens with the Walsh decision. It is possible the Federal Government will appeal to the Supreme Court, however, it would be unusual with the 4th Circuit.
