Bad deal on Audiogon - Do not deal with Jdej541943aol

I tried to be a patient guy, but it didn't work out. At this point I'm not sure I'll see my money.

AVOID any dealings with Jdej541943aol of Weston (Ft. Lauderdale) Florida.

Didn't think I'd win it, but I said hey what the hay why not. The seller had limited feedback but all but one was positive. The negative mentioned something about lack of communication. I said OK, not everybody communicates well to everybody's preference.
Payment type was check or MO only, which this would be the first auction of this type I tried-otherwise I always used PP.

Was I too patient?

Summary of events:
9/30/08 @ 9:14PM-I Won auction #1222823965, item #1222823665;a HK AVR-7300 for $182.50 +shipping
-Payment type was Check or MO only.

10/1/08 I requested shipping costs so I could send check.
** No response

10/3 or 10/4/08 I sent Audiogon customer service a message asking how long I should wait for a seller to update the shipping costs. (No Response)


At this point i'm thinking the seller didn't expect to sell it for so little and is trying to avoid following through.

10/4/08 Seller updated Shipping costs [ Total due $227.50 ]

10/4/08 I agreed to total via Audiogon

10/4/08 I submitted check request for $227.50 via online transaction with my bank. Expected arrival date to seller was 10/9.

10/4/08 I sent the seller an update to let them know when to expect the check.


10/8/08 Seller sent email to me to indicate that they received my update and are looking forward to shipping 'the beast'.

10/10/08 Sent seller a request to confirm receipt of check
** No reponse


Bank records show the check was cashed on 10/9

10/10/08 Seller updated Audiogon to indicate the payment was recieved

10/12/08 I kindly requested seller to provide tracking # or to let me know when they might expect to ship. And to let me know if they had a presonal reason for delay or something but to jsut communicate with me.
** No response

10/14/08 I sent seller another respectful request for status and to contact me
**No response
10/16/08 Sent another accomodating request for communication before filing report with Audiogon.
**No response
10/20/08 Sent final request for communications.
**No response

I want to point out that in all of my communications I have been patient, respectful, and unaccusing. I feel I have been very patient in this transaction from the very beginning.

I filed a dispute against the seller with Audiogon on 10/20. The Seller is given three days to respond.

I sent an email to the other buyer that left this seller a negative to ask about his transaction. Turns out the transaction never completed. He said he won a low bid on a different item and never recieved any responses and assumed that the guy just didn't want to sell. He never sent any money.
I assumed that the sale completed just with poor communications.

10/22/08 I recieved an email (via Audiogon) from the seller:
I will be shipping your receiver shortly. My bank just clear your ck 100%
That's the entire email. He still has not responded to the Dispute on Audiogon.

10/24/08 I recieved this email from the 'gon (just a portion of it) :
Audiogon has not received a response from Jdej541943aol.
Therefore, Mmadden28's statements will be considered accurate and complete.
Audiogon will proceed under this assumption, and will consider this Dispute closed


Audiogon has suspended his account.

10/24/08 I sent the seller a last ditch effort email to settle the matter. Note-I only ever asked the seller to ship the item- I never asked for my money back.

10/26/08 The seller responded to the above email with this:
i have communicated plenty . I sent you an email when i got your payment and I sent you an email thursday when the check cleared . I believe thats all I needed to do . I will refund your money immediately . You gave me a check that was put on hold for 10 business days .That is of your own fault not mine .

I spoke to my bank about the 10 day hold time. The bank told me that was no fault of my account, but because of a restriction placed on the recipients account. This restriction is usually due to a problem or poor history ont he account, such as with bounced checks, etc.

10/27/08--I sent this follow-up:
You recieved the check on 10/9 according to my bank records; you indicated you recieved it on 10/10. 10 days of hold time from 10/10 would be 10/20. OK so you said it cleared on 10/22. Today is 4 days beyond that, yet still no indication of shipping and no communications on why it hasn't been shipped.

The lack of communication I refer to should be obvious.
I sent you several requests for a response and you never replied. It's just plain disrespectful and unprofessional.
To begin with it took you 4 days after the close of bidding before you even provided shipping cost information so that I could even send you a check. You ignored my requests.
I asked what the status was after you recieved my check several times and you did not respond except the one time I noted, when you acknowledged that you recieved the check. You did not tell me that your bank placed a 10 day hold on the deposit into your account-That would have been nice to know.

I provided 2 days between each of my requests-enough time for you to have received and responded, yet you did not.
I asked for communications again and indicated in that message that if I didn't hear back from you that I would be forced to file a dispute with Audiogon, yet you did not respond. Then you never even responded to the Audiogon dispute process-How is that my fault? How is that something you didn't think you needed to do?

I was respectful and patient in every one of my communications with you. I never assumed wrong doing like most would. I asked you if you had a reason for delay in shipping-you never responded. I am flexible and can understand delays for personal reasons but you never replied to any of my requests. I feel I have trusted far far far more than many would ever have. What am I supposed to do? What am I supposed to think?

I would kindly request that you send me a US Postal Money Order or certified cashiers check via a trackable means, for the full amount that I paid you. I would also accept payment via Paypal.

Please let me know when you send it along with the tracking #.

10/29/08 (today) still **No response

The bank explained to me that when I request a check be paid via online billing, they charge me for it immediately on the scheduled date. My money is actually deposited into the banks account and they write a check from thier own account. This could explain why it was indicated as cashed on 10/9. The bank ensures its mailed out ni time to arrive by the due date if not sooner.

I am somewhat relieved by this as at least I know this guy doesn't have my bank account # at his disposal. :cool:
The bank is working on providing me a copy of the actual check the seller signed and deposited.

If I don't hear back from him by the end of the day tomorrow, I will take appropriate legal actions.

    I'd be happy if he would just ship the amp or send me my refund. But this game with the lack of communication is BS. Its more obvious to me that his immediate response to refund my money as opposed to shipping the item, when I never even asked or hinted for the refund, is a sure sign he didn't want to sell it so low. And if that were the case, all he had to do was say so and I likely would have yielded.
    Initially I offered to pay by PP and cover the fees, if he didn't want to wait for the check--but he didn't respond.
    Also had he cashed my check at the bank it was drawn on instead of his apparently problematic restricted account, he would have had cash in hand on day 1.

    Update:
    After I started with legal action and filed with the Internet Crime Complaint Center (IC3), I waited and waited. Still nothing from the Seller. :confused:

    Then wait a minute......just the other day.....
    Wait just one minute....What's this? A letter in the mailbox for me?
    Ooooh who could it be from? Well lookie here-its from none other than Julio. ;)
    It contained a copy of the sale from Audiogon and a US Postal Order Money Order (as I requested) for the full amount. Of course there were no apologies or anything like that, just a simple MO. I was really expecting to see a personal check (and would have expected it to contain a large percentage of Latex) so I was delighted to see a USPS MO.
    What's that like 3 weeks since he said he would refund my money?? :mad: But I got it :D.

    I went online and found the Phone # to call to verify the MO, and for some odd reason the automated system was unable to verify it. Now I'm thinking 'is this guy actually going to try to pass off a bogus USPO MO on me too?' :(:mad: I got transferred to another number, but they were able to manually verify that the MO is good to go.
    Yeehaa! :cool::D

    So with all the recent bad deals, I'm back in business :cool:, with no losses (except some minor return shipping costs).
    I will be much more reserved abuot certain deals on the 'bay or the 'gon, especially with certain payment types.
