Another nail in the, oops I didn't list the shipping correctly, coffin......
These things are huge and weigh a lot. I prefer to sell them on a local pickup basis. Shipping them would be a nightmare. You would be better off driving for 15 hours to pick them up rather than pay for crating and shipping. Contact me before bidding if you have any questions about possible shipping ideas that you may have.

BTW, I printed out a copy of the auction just in case deep bass hasn't done so and something odd were to happen to the listing.

I'd bet you won't be seeing those speakers and a letter from a lawyer isn't going to do anything. The most that might happen, if you complain thru Safe Harbor, is an account suspension. He'll just post them again, under another account name. He messed up, I agree but that's the way it goes.

I'd just move on and look for another pair.

Did he follow through on the upgrade?

    Hi there,

    Thanks for all your support.

Let's hope that you never find yourself in my situation.

It's a sad world that we live in that people group together with a heard mentality to piss on someone that didn't even make a mistake but was shistered by the system he used to try to sell something in the most honest and fair way he knew how. Why don't you think about the fact that I did nothing different than you would have if you had posted on eBay.com? eBay is not a legal system, it is a corporation with an auction engine and it is not perfect. It is filled with holes and nuances; one of which I fell into. BTW, why did I get a Seller fee refund if I didn't have a case to make?
I can estimate that this would go on and on forever till I was blue in the face and that explaining this to you ‘all’ is more than an uphill battle. But imagine that you put your prized Polk SDA SRS 1.2 TL speakers on eBay only to find that some nuance cost you 90% of the potential market place and we will see how quickly you come around to my side of this ‘issue’. As far as eBay is concerned the matter is over. However, unfortunately the damage is done and I can see that you ‘all’ just jumped off that cliff one by one to bash the bashed.

    Caught in a struggle,
    Goodness, i've tried,
    You're such a puzzle,
I guess, God bless and goodbye…

herbhead, as many people have pointed out,
YOU are the one who is wrong.
YOU had several days to look at the people counter.
YOU set the minimum bid (why would you set one if you didn't feel that it was acceptable anyway?).
YOU entered into a binding contract.

Read the rules before posting! Man up and sell the speakers!

YOU are one of those people who make US, Canadians, look bad to Americans.

And you know what? We are not sheep or monkeys to call us a heard. Everyone is entitled to their own opinion, and whether you like it or not, majority believes that you are wrong.

Nuance? What nuance? Did you read the ad after you wrote and posted it or were you high on herb?

Let me make sure I understand your position:

    1. You feel slighted because eBay did not advertise your speakers on the US eBay listings? Why would they? You said you were in Canada and LOCAL PICK UP ONLY.

    2. You actually had some reasonable expectation that someone in the US was going to want to pay freight on two 180 pound, coffin sized speakers from CANADA even after your ad specifically said NO SHIPPING? For future reference, one of the biggest deterrents to sales of the large SDA's among US buyers and sellers is the packing and shipping charges and the risk of shipping damage.

Based on 1 and 2 above, I think your choice of a screen name, "herbhead", is an appropriate one.

Good luck with your sale. I'm 99% certain of where the sales proceeds will be going.

Note to deep bass: Move on. Another pair will come along, preferably from a seller whose head is not under the influence of "herb". Herbhead is actually doing you a big favor. The grief of dealing with this kind of individual is not worth it even if he were giving the speakers away.

You know that old saying dont piss off the cook until AFTER you get your food....even if deep somehow gets them for his 1,500 bucks, you never know what a disgruntled seller is going to do to those damn things before deep gets his hands on them.

We know this ebay sellers name AND the serial numbers of the 2 speakers...and since polk forum members along with the other audio forums we belong to snatch up the majority of these in the USA .....we could in many ways make it really difficult to resell those .

After all the **** deep has already gone through, I would have a really hard time wanting those anymore from a pissed off seller.

I say link this thread in your negative feedback and keep your 1,500 bones.

This is why I hate the e-bay feedback system. A disgruntled party can basically lie and put up false information or do the blackmail thing like this **** is doing. At first I thought walk away and give some negative feedback. He's certainly gotten some in the past.

But now since he's basically threatened to blackmail you I say stay on it with e-bay and I hope to god you used a credit card. Send those ****'s after him and he can't wriggle out of it.

Actually, for me, it would be worth it. But then, I'd rather get my **** kicked for doing right than for doing wrong, plus I wouldn't have to worry about all the negative karma that's gonna come due.;)

    Deep Bass,

Call ebay and state that Dikhead was in default on the auction, and left you a negative feedback as retaliation... and see if they will remove it for you. The site states that feedback cannot be changed, but we all now that is BS.

Mr. Herbhead,,do the right thing,,deepbass won the auction fairly,,he should not have to pay for your mistake. The negative Karma that will happen if you proceed on this path will not be worth it in the long run.The "flip" side of this is the good karma that will follow you when you do the right thing. Where would he sue the seller?, where the seller lives or where he lives?

The seller is 18 hours away by car.

He would file suit at his location. That would help him as the seller would ignore the required appearance and he would win judgment by default. He could then take that judgement to the vicinage of the seller and apply for enforcement of the order. The US and Canada have reciprocal agreements which would allow this.

Understand the judgement will be for the value of the goods, not the goods themselves. He could also apply to vacate the judgement at any time.

The question is do you want them that bad. It's alot of ****. Just f#ck with him as much as you can and look for another set, IMHO. If you need help, I'd be glad to piss in his cornflakes on a regular basis for ya. POS...
