Trespass on others property, get hurt due to said trespassing, sue for $24.2 million dollars. Rediculous. http://www.msnbc.msn.com/id/15446658/

That's a ridiculous case. I've got a tract of land and it spooks me when hunters wander onto it and if something would happen to them. Posted signs do nothing apparently.>

Here in Missouri, you don't have to necessarily post signs. You can paint a visible purple mark on a tree to have the same effect as a posted sign.
There's guidelines as to how close these painted marks need to be to be considered an impenetrable barrier; I think it's something pretty generous like 50 yards. That negates the, "I didn't see any 'No Trespassing' Signs !!" defense.
Hurt yourself while trespassing, even due to the landowners negligence (open well, etc) and it's your tough luck.

We have a 12ft fence w/ razor wire on top. Beware of dogs signs and no tresspassing signs. some guy climbed the fence into the lot and was bit by the dogs. He sued and won a rather large sum of cash considering what the company makes. Now we can't have the dogs in the lot due to the insurance companies. Funny, I'm 2 blocks outside the Philadelphia city limit.Michael

Back in the 70's, a hunter sued an Iowa farmer after injuring himself climbing over barb wire fences to hunt. The farmer had no idea the guy was even there. The lawsuit cost the farmer his farm. They changed the hunting laws that now state a farmer had to give permission to allow hunting.
That was good legislation! We had guys that would show up from Chicago with guns, walk out in a field full of cattle and start blasting away at pheasants. This slowed down that nonsense!
Here in Dallas, some lady who had lost her liciense for DWI somehow was out driving in an insured, unregistered trunk at the airport, got off on a access road under contruction, and crashed her trunk. They didn't find her for a couple of days. She sued and won! The cab and bed of the truck were full of empty beer cans. She should of gotten arrested instead of a settlement."The legitimate powers of government extend to such acts only as are injurious to others. But it does me no injury for my neighbour to say there are twenty gods, or no god. It neither picks my pocket nor breaks my leg." --Thomas Jefferson -
But tort reform isn't an important issue in this country... :rolleyes:If you will it, dude, it is no dream.

And people don't like the conservative philosophy of PERSONAL RESPONSIBILITY. How can any company, no matter what the industry, stay in business when the insurance company is charging more for yearly coverage than the business rakes in each year. Doctors are particularly affected by these frivolous lawsuits.
-
What bothers me this time of year are the hunters who come out from the cities once a year to hunt. I own a 250 acre pine plantation and like to hunt and walk around in there myself. If the trespassers are hunting on my property, most of them don't think about what they shoot at., ie, if it moves, shoot at it. Also the possibility of someone starting a fire or driving the four wheeler over your tree seedlings. Although it's nice to have helped the local sheriff get elected, helps get things done and the problem eliminated.>

i say double the current, dead people cant sue. The judge deserves an asswhipping too. There wouldnt be so many stupid &%$#in lawsuits if the judges wouldnt grant them this kind of bs

Some judges are guilty for not throwing this crap out of court or limiting damages, but the lawyers are also part of the problem. They know they will be getting a healthy slice of pie so what's to stop them? There needs to be more "stupid" laws on the books especially for cases involving trespassing across clearly posted property.
-
It could be clearly posted and it still wouldn't matter. Yes, it's a damn shame somebody got hurt, but you can blame the lawyers because, as previously stated, they get a healthy cut of the proceeds. Don't think judges don't get a slice of that pie, too. They were lawyers before they became judges.
Even if you double the current, the family can sue. The laws need to be changed, and you aren't going to do it in here...
