My girlfriend worked for an ice cream place called 32 degrees in college station. It was privately owned. Anyway, one day they just up and close the business. No warning at all. They owe her 2.5 paychecks. She calls them and can't get a hold of them. She got some paperwork from the tx workforce comission today but it asks questions that she doesnt know. For instance his home phone and address. She doesnt know how many hours she worked, doesnt know her beginning date of employment, among some other stuff.

Of course I tried looking them up at whitepages.com to no avail, but when I typed his name in google, i found a court date for them against Baskin Robins.

http://www.ca5.uscourts.gov/clerk/calendar/0511%5C13.htm
"*No. 04-40496. Alice Higgins, Et Al, Appellants; Flavio Olivarez, Appellant vs. Baskin-Robbins USA Co., etc. (and other related case)."

Its for Nov. 8 in Houston. I was wondering if there was anything I could do to help find their personal information. Would I be able to contact the court, explain the situation and ask? Is this something they can get arrested for? Does anyone know anything about this kind of stuff?

Thanks a lot for anything you can help us with,
-Cody

the g/f just thought of this, she knows where they go to church. So if they dont pay up we can wait for them after they get out.

Seems like church goer's would be a little better about this stuff...

one more question, is it a sin to beat his **** and take his money in the yard of a church?

    waaaa

On a more serious note, if I were you it would probably be best to just confront the person after church in a nice but firm way. If that doesn't work (might not as it sounds like the employer is already in trouble with the law) then I would seek legal help, or maybe someone has a better idea...

In CA, you can file w/a State Labor Commissioner office (a state government agency) to file a claim for the wages and penalties. You might one to check to see if Texas had a "labor board".

Same **** happened to me back in 1989. I was working for a small Greek family restaurant. They shut the doors and I got screwed out of 2 or 3 weeks pay. I filed with the bankruptcy court when the time came, but I never got a dime from that malaka!

at least they have her notice. They just up and quit one night and left all their workers SOL. They had just hired someone about a week before. Shes also had multiple checks bounce from them. The rest of her co-workers had the same problem. The g/f's a lot nicer than I am, I wouldve filed against them after the 2nd time my check bounced.

your right on your gorlfriend being too nice, 2 paychecks bounce? you gotta punch out of that joint. payroll is allways the LAST thing that does not get paid in a failing business. She has to report it to the appropriate agency in the state (if she doesnt have the start date and hours, they cant help much, the more detailed info of the infraction the better) but I'd bet there is a huge line of creditors waiting for a piece of their hide.

all in all, she might just have to chalk this up to life experience.

yep, thats what I meant by the big line of creditors, I forgot to mention the B word :)

Macleod is right, if they filed bankruptcy, regardless of chapter, your going to have to eat the loss, which stinks because its ayoung person at a part time job. Life can suck at times
