wet paint.... PennDOT responsible?

I'm guessing that I won't like the answer to this.

Driving home today, I turned onto a road that looked like it had recently been painted. However, there were no "Wet Paint" signs or anything of the like. About a mile up the road, I drove onto the center line and heard a very disheartening "squishy" sound. A ways on up the road, I encountered the "Wet Paint" chase truck..... just a bit too late for my driver's side paint job.

They probably can't be held responsible for damaging my paint, can they? The thing is, there were no Wet Paint signs, or work area signs or anything, up until that chase truck, which was out of my view when I touched the line. 'Til I got home, the paint was dry, so no luck wiping it off. Yellow paint on a black truck=just a bit visual!!!

    My area of expertise....

    NEVER are you to be held responsible when they are negligent. If they had wet paint signs up, you wouldn't have even been able to drive on the wet lines.

    I'd call the PDOT and file a complaint and not get off the phone until you get someone on that will listen to you and will take responsiblity.

    I had a situation years back when I was driving on a road tht they had recently repaved. Well, when they did that, they left this one storm drain (not the type that just stay along the curb....but stick out a bit into the roadway) at the pre-repaved level and there was about a 6" drop from the new surface down to the bottom. Well I hit that in my camaro and bent the hell out of my left 2 wheels. I filed a complaint and made the city buy my replacement wheels.

    Ditto what Brett said. Call PDOT up and inform them of what happened and go from there. I too think it was their fault for not putting up signs to warn of wet paint.

    Well, the yellow paint came off of the painted surfaces of my truck, but I was unable to get it off the mudflaps (not a big deal), or the plastic trim around the wheel wells. I don't think I'm going to pursue this, though I do think it was rather shitacular of them to not put up signs warning of the wet paint.

    Why was I over the center line? It's a narrow road to begin with, that they recently widened just enough to make it true 2 lanes. I was passing by someone's driveway, and wanted to make sure they weren't going to back into me. Squishy squishy, over the first center line I go.... From the amount of paint on my mudflap, there's going to be one large dull spot in the roadway there...

    Oh, and when I finally reached the chase truck, I noticed that the vehicle in front of me also had yellow paint on their tires..... guess they didn't see that, either.....

    PS- In regards to vehicular damage, I remember an article in the newspaper this past winter stating the PennDOT is not responsible for damage due to potholes. This was brought up after a number of people had blowouts and damaged rims from a pothole spanning most of both lanes of the highway on Rt. 80 this winter.
