Legal Question - audio recording at work

I'm hoping someone with more legal knowledge than me, possibly a lawyer, could help answer a few questions I have about the legality of an employer recording audio of employees and customers without their knowledge. I'd be happy to PM some details to anyone who would be willing to help. Thanks.

**NOT A LAWYER BUT WORK WITH THEM**

We've had discussions around some of this offhand and it depends on the laws in the given state.

In Indiana its legal as long to record phone calls as long as one party consents (which normally would be the person doing the recording lol)....
Indiana's wiretapping law is a "one-party consent" law. Indiana makes it a crime to record a telephone conversation unless one party to the conversation consents. See Ind. Code § 35-31.5-2-176 and Ind.

But its gonna vary state to state.... and recording phone calls (the example above) is likely going to be covered differently than recording conversations in the workplace..... but I dont know, and again am not a lawyer....

Sounds like maybe I'll need to try to confirm things in my state. Thanks for the responses so far.

What state are you in? I can ask around a bit at work if you’d like....

Need to know if it was a phone conversation, surveillance equipment, just normal chatting on the sales floor etc.

If you are still in Iowa, Iowa is also a One-Party Consent state.

Yep, still in Iowa. In this situation neither party was aware recording was taking place. The person recording was not present.

Sent you a PM, but to sum it up, there could be grounds for one party consenting.....
