    LOL.....given what we know so far, you don't find it at least somewhat....unusual ? Lets forget conspiracy theories for a minute and simply look at the chain of events and supposedly whats considered best practice.

    I've been around death, average joes who die, relatives, and in every case no matter how obvious the cause of death is, a medical professional has to physically see the body and pronounce death. An autopsy is practically automatic, least in my state it is. Neither of these 2 things happened. Maybe that's just Texan law, I don't really know for sure.

    What I do know is, if your shot in the head, hung yourself, or died in a very obvious way, those 2 things still happen. Why not with Scalia ? When JFK was shot, cause of death was obvious, and those 2 things still happened, and he was a sitting president. Not Scalia though ?

    Seems to me, if it was anyone else found with a pillow over their head, those 2 things would have happened. If it was Jesse Jackson found with a pillow over his head, would people say " Eh, nothing to see here, move on. " I think we both know that answer.

    Pillow or not Mikey, that's almost irrelevant, those 2 things should have happened regardless of who he is or the pillow.....over his head, above his head, on the floor, doesn't matter much. Determining cause of death is though, and that procedure was not applied. In todays day and age, we autopsy the scum of the earth to determine cause of death, but not a sitting SC judge ?

    You are spot on Tony, there needs to be an autopsy, Texas has that same law as Illinois. Savage mentioned this last night, something isn't right about this, it needs to be investigated.

    Seriously, Tony? Paranoid much? My father went in less than an hour in his mid-80s. The idea that Scalia was targeted just seems over the top to me. But this further demonstrates that if the two of us ever found ourselves in a bar drinking for an evening there would be something akin to the half day or so of dialog that occurred when Jung met Freud for the first time. lol

    Let's just leave this thread as it was intended and let the old Justice RIP.

    It is OK for the family not to have an autopsy done. Apparently the judge who "certified" the death spoke to investigators and Scalia's personal physician before making the ruling. So this practice does not seem out of the ordinary. It may touch off conspiracy theories, but there is a logical explanation for it. "Over the head" could also be interpreted as on top vertically, or horizontally (touching the hair only) since the body is not vertical.

    If the family didn't wish an autopsy, and there was some minimal investigation performed, we should not cause undue commotion with this speculation.

    Jesus man, all I'm sayin' is.....normal procedures were not followed, why ? Does anyone care to ask why anymore ? Does anyone care that his body was drained of all fluids and thrown away pronto ? Is that normal procedure ?

    We all know JFK was shot and by whom....done deal, but has anyone offered a legitimate reason as to WHY he was shot ? All speculation isn't it ? Do we really know ?

    Scalia indeed was a great man, originalist, strict adherence with passion to our governing documents. He'll rest in peace, as long as whoever replaces him doesn't undo the good work he's already done. That was his wish.

    Scalia interpreted the law as written; he didn't attempt to "massage" law into some new paradigm to appease a narrative. Since SCOTUS judges are not tasked with creating or modifying law, Scalia did his job. It would be great if all justices understood the "scope" of their duties.

    From the article linked above it seems like normal procedure allowed exactly what happened. The police didn't suspect wrong doing and the family didn't. The judge spoke to the investigators, the family, and the personal physician and concluded the same. If the family is OK without an autopsy and the state allows it then it's "normal procedure". May not the case for all states but OK where he lived. I don't see where there is evidence of a cover up.

    Are you saying the article is wrong? Is there other credible evidence that would suggest fowl play?

    Your probably right Fox, except that it's the 'interpretation" part that constantly changes with each judge, which is why each judge is so important, especially at this point in time.

    Maybe I'm just born with a skeptical eye, an untrustworthy component in my brain .

    Who did the initial investigation ? Were they qualified ? Appears not....no detectives were present to determine anything. I get this may appear to be legal by Texan standards, which is based on costs, but we are talking a SC Judge, not some dude texting on his phone who walked in front of a train.

    He was a high ranking Federal employee, with U.S. Marshal protection. The person with the authority to order an autopsy, or not, is the Attorney General.

    Part of the normal procedure I mentioned is the determination of foul play, or not, when a person dies. Who made that determination and were they qualified to do so ? It appears not....so far, from what I can tell. That determination dictates the next steps taken.

    Look, the whole process just seems out of whack to me, considering who the man was, no witnesses, no medical professional present, no qualified detectives on site to determine anything, no autopsy.

    Heck, I can pronounce anyone dead who is his age, overweight, as natural causes. Big deal, doesn't tell anyone by what cause though. Heart attack, brain tumor, etc.....and what exactly caused that at that particular time. Only an autopsy can confirm or deny any notions of wrong doing. So in my mind, either those present didn't care to know, were too incompetent, or didn't want x information to get out.

    To use your "cinder block" example. It's different if you throw that cinder block in the pond, versus me coming along and throwing it in if you were unsure. Big difference between suicide and murder, no ? The only way to find out would be an investigation, no ? Unless nobody cared about who you were, then it's easy to write down cause of death as drowning/suicide.....and steal that phone you left on the table. :p

    Art. 49.03. POWERS AND DUTIES. The powers granted and duties imposed on a justice of the peace under this article are independent of the powers and duties of a law enforcement agency investigating a death.


    Amended by Acts 1987, 70th Leg., ch. 529, Sec. 1, eff. Sept. 1, 1987.





    Art. 49.04. DEATHS REQUIRING AN INQUEST. (a) A justice of the peace shall conduct an inquest into the death of a person who dies in the county served by the justice if:

    (1) the person dies in prison under circumstances other than those described by Section 501.055(b), Government Code, or in jail;

    (2) the person dies an unnatural death from a cause other than a legal execution;

    (3) the body or a body part of a person is found, the cause or circumstances of death are unknown, and:

    (A) the person is identified; or

    (B) the person is unidentified;

    (4) the circumstances of the death indicate that the death may have been caused by unlawful means;

    (5) the person commits suicide or the circumstances of the death indicate that the death may have been caused by suicide;

    (6) the person dies without having been attended by a physician;

    (7) the person dies while attended by a physician who is unable to certify the cause of death and who requests the justice of the peace to conduct an inquest; or

    (8) the person is a child younger than six years of age and an inquest is required by Chapter 264, Family Code.

    (b) Except as provided by Subsection (c) of this section, a physician who attends the death of a person and who is unable to certify the cause of death shall report the death to the justice of the peace of the precinct where the death occurred and request that the justice conduct an inquest.

    (c) If a person dies in a hospital or other institution and an attending physician is unable to certify the cause of death, the superintendent or general manager of the hospital or institution shall report the death to the justice of the peace of the precinct where the hospital or institution is located.

    (d) A justice of the peace investigating a death described by Subsection (a)(3)(B) shall report the death to the missing children and missing persons information clearinghouse of the
