Audiogon seller backed out after taking my money

Well today I put an offer in for a nice tube pre. The seller responds later and said there is one offer ahead of mine. Straight away I though what the heck so I used the buy it now and just paid straight away. Well he calls me up and then starts babbling on about he sold it and some one just came to his house and bought it (in the space of less than 5 minutes? ) and he does not have it. I know its BS and cant prove anything but its just sad.
Now I am just not happy and a little depressed by the whole ordeal and the seller still has my $3550 that he said he will just refund tomorrow. Crap day and frustrated just like back in the days when daddy always promised to buy me a pony but never did.

He has already told you what will happen......just wait until he refunds, then spend the money someplace else. Without emails, you really only have the Buy It Now transaction contract and your receipt of payment to stand on. I would contact Audiogon to get them to flag the transaction as a potential infraction of the sellers agreement to proceed with the sale. The contract is binding as soon as you paid and he is in default until he delivers or refunds. If he receives directions from Audiogon, he will act on the refund process faster to protect his ability to sell with them. He will claim that he sold the item locally and simply didn't have time to take down the listing, which is actually true even though you think differently. You really aren't opening a case against it yet, just letting them in on the phone call's content. Well he changed his story today and said he had to drive to the sale but on the phone a guy just showed up on his door. I agree with everyone that its one of these things that happens and I got my money back so I am not out nothing.
