So yet again someone damages the rear of my CTS.....
Went goodwill hunting (har har) today like we always do (girlfriend and I).
Went to the new goodwill and found nothing, actually for the most part we found nothing. It was the last stop of the day and we were leaving. I backed my car up at a 45 degree angle to pull between two cars in front of me. I ALWAYS look back so I can see back, left and right to make sure no one is in the way. As I finished backing, I shifted to drive, and as I was shifting, and old lady in a Lincoln LS started backing. I looked back again and saw her coming at me, she wasn't turning at all. The gap between her side of the parking lot and my car is approximately 2 car lengths, maybe slightly less. I yelled some profanities and my girlfriend said "HOONKKKK" so I honked. I held the horn down as she was still backing, until she hit me, and 2 seconds after. I immediately shift back into park and get out of the car.
My car was stationary and shifted into Drive when she hit me. She didn't even bother to look back when she was backing, her head was looking straight forward. Since she was backing straight into me I could see through her rear window, which is untinted. She immediately accuses me of backing into her. I tell her NO, my car was already fully out before she even left her spot. Also, my car was not moving, so she hit a stationary object. Her argument is "why didn't you honk?". I tell her, I did, before, during, and after. Obviously she did not hear it. I'm livid, but held my cool and did not yell at her. She's an old woman, 73 to be exact.
I check out my car. She hit the passenger rear corner of my bumper, and had moved my car about 6 inches (I had brakes fully applied). It shifted my bumper to the left 1/2 inch, breaking some clips, and spider cracking the paint on that corner of the bumper, and stripping all the paint off at the top edge. There's also damage to my rear quarter panel. The very middle of her bumper has my paint on it, and spider cracking. Her-middle, me, rear quarter. To an adjuster that's her fault. The fact that I was stationary - her fault. I'm thinking, what would have happened if there was a person or child there, she didnt even bother to look.
She starts going off on me and my girlfriend. I let my girlfriend do the talking as she is a Farmers claims/liability adjuster. Just my luck, the lady can't find her insurance verification. At that time I tell her I'm glad to call the police for her lack of verification. I know they can't write a report because it's private property, but having no insurance in Oklahoma means towing your car away. It literally takes her 15 minutes to find it. She keeps climbing into her car and closing it like she's going to take off. She says "you saw me sitting in my car for 15 minutes, why didn't you watch out?". WTF...yeah I'm spying on you woman. I snap pictures of EVERYTHING. I wish my DSLR wasn't sitting at home..geez. I see the bumper is pushed into my custom exhaust too. I'm hoping that it doesn't melt my bumper.
Anyways, I demanded her information and she cops attitude. I'm asking nicely, holding back quite a bit of rage. This is clearly her fault and she's pinning it on me somehow. I get all her information down with the assistance of my girlfriend (her handwriting is better, and she knows what to get down better than me). She copies down my information as well. She sees my last name and the first thing she says is, "oh, you're from OUT OF TOWN". Her ID is sitting right next to mine, they're from the same state. I tell her "NO, ma'am, my last name means I'm Vietnamese, it has no bearing on where I live, which clearly is OKLAHOMA since it says OKLAHOMA on my drivers license.
I snap more pictures. The lady rambles on about how I didn't honk again and there's no damage to my car. I tell her clearly there is, and honking or not honking does not constitute her lack of liability for backing into my car. I don't have to announce to her that I'm there. My girlfriend reassures me it won't be my liability, but the lady disputing it may make it difficult without proof. Well I get all the info down and am about to leave, then the old woman walks back into goodwill. I look at the building, there's a security camera pointed at the parking lot. Good?
I tell my girlfriend to sit there as I go see if I can check out the security camera. I go in and the old woman is telling everyone that this asian guy hit her car and is fleeing the scene. She doesn't realize I'm standing right there waiting to talk to the manager. The people inside tell her to call the police so they can come out and arrest me. I'm like... "you people are so f'n stupid, but whatever" (i didn't say that, i just thought it). I let the old woman finish her rant and call the cops. When she was done I walked into the managers office and said "ma'am, I'm the *guy* that she claims hit her car, I notice you have a security system with a DVR, can we take a look at the footage at 2:07pm today and see what happened?".
She tells me sure. I tell her that I'm not going to even try to explain, and that the video will tell all. We take a few moments to find the exact time, and viola... there is the video. It shows me clearly backing up, stopping, and then the woman in the Lincoln backs up 2 car lengths STRAIGHT back into my car, as if deliberately. Then she immediately goes forward back into her spot (she moved it, a no no).
"Looks like the old woman clearly hit you, and you weren't moving", the manager says. Yeah, I know. The cop shows up. My gf and I go out to greet him. I say to myself "be nice". I greet the Sergeant and tell him what happened. He explains it's private property and he cannot write a report. We explain we understand, but the old woman is being unreasonable. He tells us we've done what we should do, and it will be fine. The old woman flips her lid at him. We tell her and him there is surveillance footage of the whole thing, and if they would like to watch it, it would clear it all up. Well the officer convinces her to go look. He rolls his eyes a few times as she spouts negative comments about me, once again saying I hit her, and that I didn't honk. We go inside and watch the video.
She immediately says "this doesn't show you honking!". We play it back again, and I tell her... You can see my car is NOT MOVING, and you backed straight into me AFTER I had already completely pulled out of my spot. She hit a stationary vehicle. She once again denies it and says she isn't at fault.
After a third view, and her rambling more, the officer finally steps in to say "ma'am, the video clearly shows you hit them, and they were not moving".
At this point the Sergeant is fed up with her and just tells us "here is my badge number, and my name, PLEASE feel free to call me and I can give a statement based on what I saw in the video, also, get a copy of it when you can". I can't get a copy til monday, when IT is in the building.
I shake hands with the officer, and thank him for his assistance. I apologize for the inconvenience (even though she called him). It certainly helped my case.
We got in the car and went home - she was still yelling crap at us even though the cop already put her in her place. What was scary was that she followed my car for 4 miles as we headed home. I even made attempts to pull away but she somehow ended up right behind me. I finally got fed up with it and used my cars power to get away.
Sigh, not even 5 hours into getting my new exhaust (xpipe) installed and already more damage to my rear bumper.
What sucks is she's going to try to file against me, so I'll have to deal with her insurance company (Farmers) and mine (Travelers). Coincidentally, my girlfriend works for Farmers, and used to do this very job.
I'll get mine, and she'll get hers. She did not need to be so negative. I could have very well flipped my lid at her, but I decided to be the bigger person and held it all in, only saying what was necessary. I always tell myself I'd kick the crap out of anyone who damages my car, but realistically that is not the case.
Thank you Rosey (my gf). I'm glad no one was between our cars, or behind hers. No one was hurt, and that's what is important. Sigh, more repairs...and costly ones for such simple damage.

I won't lose this. When I get a copy of the video and send it to her adjuster, and mine - it won't matter what she says.
I know that if my girlfriend had been driving, and it was her car, I certainly would have been more upset. This is because my girlfriend backs up 90 degrees and that means either her whole side, or my whole side would have been damaged, not just the bumper.
Even if I don't get the video, I can get a statement from the officer, as he watched it with us.

Thank you-know-who that she hit you and didn't back up into a baby stroller. If she moved your car 6", the stroller would have been crushed. The lady should lose her license.

Just this morning I was going to get donuts for the family - I'm in the right lane next to a compact Subaru in the left - and the Subaru driver (who happened to be a woman...not that that is of any note) changes lanes *into me*.
Fortunately the shoulder was wide enough for me to swerve out of the way.
I look at her and she looks at me with a shocked look of "oh gosh, maybe I should have looked first before blindly changing lanes with my baby in the back seat and endangering her life".
Duh...Grrr.....

just last week i had some "older" lady almost do the same exact thing. i get in my car and put it in reverse to start backing up. luckily i was still looking out the back window while doing so. the lady behind my starts backing up while i'm already doing the same. i started beeping, and stopped the car, as she's still coming. she never looked, or stopped and i had to throw it in drive and go forward to avoid getting hit.50" samsung dlp

In that type of situation all you need to do is smile and get the basic info. Nothing like watching an irate person going off. I will pay money to watch people like that get mad for almost no reason. That's why I love this place so much.

You need some screen recording software like Camtasia Studio. -

She drives like the crazy lady that lives near me. No regard to anything whatsoever. Her bumper that has been replaced countless times tells the tale. She even pulls back into the original parking spot quickly, just like how the crazy lady here does......I wonder if there is a similarity between the drugs/prescriptions they both may be on.....~ In search of accurate reproduction of music. At the speed she was backing out, she might have hit your car if you hadn't moved at all. Hope she loses her license before she finds herself on the 6 o'clock news after her foot hits the gas rather than the brake and really hurts somebody.The Gear... Yeah. I mean I argued with her for a while. She claims we didn't honk. She argued "why didn't you stop when you saw me coming?".
I saw her coming. I did stop. I did honk (before, during, after).
She didn't even bother turning her car. She then moved her car when she should have left it where it was when she contacted me.
I really need to get the additional footage. I came back out from goodwill and there were handmarks (my car was very dusty) all over my bumper where someone pulled it back into place.

I agree. What if someone had been walking behind her car? There are kids and other people at goodwill all the time. The would be severely injured or dead.
Her negative attitude to me, wouldn't have flown very far is someone was laying under her car there. Her "why didn't you honk" excuse would have fallen on deaf ears.
