What should I do? Ebay issue.

Hi all...
Late last week, I won 5 Pinnacle speakers - AC400 for only 10 bucks. My brother was looking for something to replace his 5 HTIB, and these were cheap as can be. I contacted the seller, he said he would be back on Wednesday (Today) from the beach. I told him I could pick them up since he was local, and I could bring cash or pay via paypal. I was looking at my local craigslist and saw them up for sale 125 OBO. I know this is the same guy- Same name and town. I emailed him, didn't let him know that I saw the craigslist ad, and asked again when i could pick them up and how he'd like me to pay. I'm not sure what I should do about this? Should I just pay via paypal and tell him I'm expecting them? Should I email him and let him know I saw his ad? I already printed and pasted the page. It has his phone number, etc. He has a few negative ebay ratings, but is at 96% (Much better than Russman :) haha - See his ebay post).

Please advise.

    Well, what did he say? You've emailed him a couple times and since you didn't include his responses in the above, I assume he hasn't answered you. Did he agree to local pick up before you bought them?

    ALWAYS, ALWAYS get the terms/agreements up front with email documentation so if you have to file a claim it's all in writing. Was local pickup an option? The only option? If it was, I'd pay cash at time of pick up.

    It was local pickup preferred in the original listing. When I emailed him originally, all he said was he would be back from the beach on Wednesday, and we'd take care of it today...then I saw the craigslist ad. It's obvious to me it was he felt he wasn't getting enough, although he put the ebay listing as 'No Reserve'. Waiting to hear advice. Thanks,

    The best advice I can give is wait until you hear from him. Do you know when the CL ad was listed? Maybe before the Ebay ad? Until you get some feedback from him you are just assuming.

    I don't know what else to tell you. He said he'd be back today and the day isn;t even 1/2 over and you already want this wrapped up.

    Not being critical, just calling it how I see it based on the info you've given so far

    P.s. Also if you are concerned about his negative Ebay rating, why are you asking about it now?

    P.s.s. When was the purchase made? ie; how long since the auction ended have you been waiting?

    The ad was posted first time this morning, at least that's what the ad says. I'll wait to hear from him and post what he says. I'm wondering what would happen if he sells them via craigslist today.

    The first thing I'd do is cancel his craigslist ad, just eliminate it as a spam or overpost, he can't sell them if he doesn't advertise can he?

    As long as you haven't paid him he probably wants to try to get more money for them, at least you haven't paid him.

    Some people can't seem to figure out how to get the price they want and are dismayed when something goes for way less than they had in mind. I use an opening bid that's the minimum I'm willing to take, if it gets a bid I'm good with it that way.

    Cancel that ad though
    You aren't done with wire and ready for upgrades and other tweaks until you are totally done with wire.

    You keep after him and when he doesn't respond or produce the item you report him to ebay and leave negative feedback. You're not out any money, right?

    Pay the money with paypal, then it's a completed transaction in ebay's eyes. ( with the exception of you receiving your items) If the seller doesn't honor the deal/sale, he's in breach, you get your money back, he get's your lousy (but accurate) feedback!;)

    Here's the listing if you are interested. It clearly says that anyone can pick them up locally without charge. I tried to pay via paypal, but it's making me do the 17 bucks shipping, so I emailed him through ebay this time asking him again how he'd like to proceed. Thanks for the advice.

    He seems to sell alot on Ebay, so the vague mention of something to the effect of 'please advise when I can pick up speakers so we both can proceed with a POSITIVE transaction' may help your case.

    Wouldn't it be worth an additional $17 to not have to drive somewhere and have to deal with this person face to face? I would.

    I would be concerned how he would package and ship all those speakers for only 17.00, even if it was local....ie is he going to stuff them in PO flat rate boxes?

    Move on....there's always another deal.
    CTC BBQ Amplifier, Sonic Frontiers Line3 Pre-Amplifier and Wadia 581 SACD player. Speakers? Always changing but for now, Mission Argonauts I picked up for $50 bucks, mint.

    Quick update -

    I did NOT hear from the seller yesterday. I emailed him just a few minutes ago and asked him to contact me today regarding the speakers. I sent the message through Ebay and through email. Hopefully I will hear from him today.

    Okay,

    I officially won these on 7/3/10. Should I cancel the sale and leave negative feedback? Will he leave negative feedback for me if I do this? What are my other options? I have never done this before. Thanks.

    He can't leave negative feedback, but he can respond negatively to your negative feedback. Is the verbal assault on your character worth $10?

    Why do you have to cancel the purchase? He could turn that around on you? Will it allow you to leave feedback now? Again, be ready for a **** storm and is it worth $10 to you? I bought a dead tube and it took about 90 days for Ebay to rule in my favor. I left the negative feedback for his attitude, etc. and he verbally lambasted me even though he HAD to leave positive feedback.

    Just make sure he can't leave negative feedback because you didn't pay (obviously you couldn't since it was local pickup). Go thru whatever process you need to so he can't actually leave anything but positive or no feedback. If you leave a comment expect him to rebutt.

    Howabout pay the $10 + $17 and have him ship them to you. Still a great deal and if he never ships them, then you can leave negative feedback and you will get your money back. Try that...

    It looks like the seller did the same thing once before in Oct 2009 based on the ebay buyer feedback here

    Post an ad on CL explaining what sort of person the seller of those speakers is & the tricks he has pulled. Might mess up his chances of selling them on CL anyway.;)

    I have NEVER heard from you about the Pinnacle speakers although about 5 messages and about 5 emails over the course of almost a month. Payment has been sent for weeks. My next step is to go through ebay, cancel the transaction, and leave negative feedback. This is NOT me looking for something for nothing or about a bad installation. This is about your lack of communication, refusal to respond to me, or ship my item. I will give you until Monday to respond so we can fix this problem.

    I'd hit the report item symbol on the auction page, fill in the pertinent info and see what happens. I guess I'd also contact paypal too. Good luck with this skid mark ! :)

    Make sure you know any time limits that Ebay/PayPal may have and don't wait to long.

    You want to report "non-receipt" of item. Your money should be covered by paypal. If its been over 2 weeks from payment date, and you have tried to contact seller(which i see you have done), then file your claim.
