The Shipper/Seller is resonsible for filing a claim if he sent it "prepaid" on his account.
He will give you a refund and if he insured the package properly, he will get his money back from UPS.

Also note you must send it back to him because eventually it will belong to UPS. Hate it for you because I bet that is a nice one!

Yep, just box it back up, tell the seller you want them to arrange for UPS to pick it up for claim inspection. Tell them you want a refund immediately, not when UPS settles the claim (which may be 1-2 months)
For rig details, see my profile. Nothing here anymore...

Personally, if the damage doesn't effect the sound quality or stability of the unit i'd keep it.

If you're that impressed with it and it's just a cosmetic thing, I wouldn't bother with filing the claim.

I agree, If it's just cosmetics I am sure there could be a way to kind of hide it if you looked around.
Really if it sounds great and just cosmetics I wouldn't bother.

Did you accept it? Do you have a picture of how it was packed? Was the outside of the box crushed? If no big deal then super glue is your friend.....

I agree. While it stinks that it's not perfect, from the picture it doesn't appear to be too bad.

The box was fine but he used bubble wrap inside it instead of the original packaging

The seller is awsome though and will pay me back every dime

I just spoke with him and he offerd me 20% off the price if I did not want to send it back

Before I did anything, I'd call Martin Logan and ask about replacement/repair parts. ML customer service is right up there with Polk. If the replacement piece can be bought for the 20% he is offering you, it seems it would be a no brainer.

Hard for me to imagine it was shipping damage if the box wasn't a wreck. If there wasn't anything else in the box for it to really get mangled on he sent it that way. or so it seems

Alright, then why on earth would you blame UPS for "effing" up your speaker when it was clearly an inadequate packing job? A heavy piece of equipment inside a box packed only with peanuts or bubble wrap is *never* going to survive, regardless of the shipper.

I have no tie to UPS or any other shipping company, but I do tend to get tired of people blaming the shipper instead of either taking responsibility for their own crappy packing job or the blaming the shippers packaging.

I would doubt that UPS will reimburse for this, so the seller will have to eat it.

I don't know. I know they are rough with boxes. I've seen what my packing ups center looks like and how they handle boxes off the truck, especially smaller ones. It is just a quick toss off the back into a bin.
Who knows. It is worth a try. 20% is a good deal though all in all.
That's like free shipping and 10% off. Still a good deal wither way .

Absolutely, they are *all* rough with packages. A shipper has to assume that the package will get thrown around and package appropriately. And unless you're carrying a speaker in the back seat of your own car, I don't see how you could expect it to survive a trip packed only in bubble wrap.

Whatever makes you happy...BUT I would say the shipper did okay and the fault lies with the seller who did offer quite quickly to make it right......

Very true, 20% back is a nice deal.
Plus anything being shipped no matter how packed and cared for has a chance of being dropped or potentially broken a bit.

    PFB,

I know it's irritating to receive something with cosmetic damage...but your own pics make it seem like NO significant part was affected....just the plastic molding around the speaker components?

So if it works...take the discount and find some colored Poly...to smear over the crack and blend it in better.

I, must say that I don't have much experience with UPS. I mailed one thing that I boxed with them about 1800 miles....it arrived safe and sound!

Everything else I've bought on line has been pretty much Fed Exed and Double boxed. No problems, there, so far?
