Ok, boys here is the problem... I bought the speakers on the Canadian Ebay! My seller first claimed that he felt that Ebay misrepresented his item. (i spoke to Ebay and they said they just post what the sellers asks for them to post and they didn't make any such mistake). Ok.... Now he claims that he forgot to select the ship to destination to the UNITED STATES AS WELL AS CANADA! He feels that if he recieved more hits he would have received more money! The auction was just in CANADA! Once the auction ended he got pissed off once he realized that other speakers sold in the UNITED STATES for more money (he is pouting over sour milk) He is supposed to be mature instead hes getting really pushy and pissed off at me. That is once he saw how much these went for

He set the minimum bid for the item and is trying to get out of this. Consequently i feel that a minimum price is a price point that the seller is happy with receiving and any amount over that is an added benefit. This is not fair and is unacceptable. I have reported the issue and i am not in any way at fault. He is claiming arbitrage now that he thinks i will turn around and sell the speakers for more money here in the U.S. When in fact his intention as he said is that he wants me to release him from this (which i denied the mutual end sale agreement). So that he can go an re-list the speakers on Ebay and make more money
P.S this is not my intention i am a speaker enthusiasts and i love music. I didn't realize this bulls**t would happen!
This is long and i would appreciate your thoughts and opinions cause i need help!
Sincerely,
-Deepbass (Polk Enthusiast) -
P.S dbnh i don't have a spouse. Side note: I am not trying to be a ball buster, I just feel that I rightfully won the auction and would like the seller to fulfill his dutiable bound obligation. I am not a wealthy man made of tons of money. In fact I am a hard working college student who has worked hard for what I have. Who do you guys side with THOUGHTS, COMMENTS? Questions i am glad to answer!

I don't think there's a lot you can do, other than leave the appropriate feedback. Of course this could mean a negative for you also. Did you pay for them already? You could start a claim via Paypal, but you would just get your money back.

Ricardo is right! That is my ad that i won. Does anyone feel that i am wrong? These are now almost 20 years of age. (He is the 3rd owner and is sulking that he didnt get more... then why didnt he list them for more on his min bid? He's not being fair or honest with himself. Do you think this was out of line. if 133 people viewed the item wouldnt they have wanted them too? If everyone could call back there auctions and re-list there would be no such thing as an ebay?
-
There's nothing you can do if you let ebay know and they don't have a solution. Plenty of buyers don't pay after they win a auction and this is same thing only with the seller refusing to complete the transaction. Leave the seller negative feedback and snipe them for $999 when he relists them
-
He entered into a legally binding contract. If you wanted to, you could hire a lawyer to sue him for breach of contract. Another option would be to show up at his door with a ball peen hammer in hand.
Edit: Just read his ad and the story he is giving you about including the USA is BS. He clearly states, twice....
Shipping costs: Pickup only - see item description for details
Ships to: Will arrange for local pickup only (no shipping).
I would send him a certified letter stating that if he does not complete the sale, you will sue him for breach of contract, including all attorney fees and court costs. That should get his attention as he will lose in a court of law, Guaranteed!Political Correctness'.........defined

I agree with F1. Have an attorney send him a nasty letter. Just a letter shouldn't cost you much. If that doesn't work, go the ballpeen route.

Your purchase is a binding contract. It is no way your fault if he doesn't educate himself on 1) how e-bay works 2) what an item is worth. DO NOT let him off the hook.
Work with E-bay for a resolution and the next step is to send him a demand letter stating that a binding contract was entered by both parties and you demand he follow through with his end; if not you'll see him in small claims court which you don't need a lawyer for and the fees are minimal.
If you go on Judge Judy she'll certainly straighten is **** out. I've seen a few cases dealing with e-bay on JJ and you certainly have a soild solid case.

Hi All,
Below is the email I received from eBay regarding the reduced page view count. The auction # 160236789944 received a count of 133 page views; we all know the average is near 1000. Because I mounted the auction on eBay.ca and marked them as Pick Only (just like almost everyone else) most U.S. buyers did not 'see' my auction. I'm a little too pissed at the moment to go into this further having only just learned this boy has been herding you guys and trashing me on this forum. But I went through the same motions as you would at eBay and got almost 10th the page views; now is that fair to me and/or you?
And thank you very much for all this deepbass10hz.
Dear eBay Customer,
Thank you for writing to eBay. My name is Cindy and I appreciate the chance to assist you with your question.
I understand you are upset because your item received less views than other similar items. I'd like to clarify that whether an item is searchable on a specific site depends on the "ship to" location. If you specify that you'll only ship an item to Canada, the item will be searchable on eBay.ca site only. If you specify that you'll ship the item to US and Canada, it will be searchable on both eBay.ca and eBay.com sites.
With that being said, for your future reference, if you'd like an item to be searchable on both eBay.ca site and eBay.com site, but only offer local pick up, I'd suggest you to do the following:
1. On the Sell Your Item form, click on 'add or remove options' in the 'Give buyers shipping details' section, and make sure the box for 'International shipping' is checked.
2. Select 'Flat rate' for both demostic and international shipping and leave the amount blank.
3. Under internationl shipping, select 'will ship to Canada and the following' and then check off 'United State'.
This way, on the listing page, the shipping section will show "Check item description and payment instructions or contact seller for details." You can specify that this item is for local pick up only in the item description. This way, your item will also be searchable on eBay.com site.
I hope I was able to assist you today. If you would like further assistance please feel free to reply back to this email. We will be happy to address your questions and concerns.
Kind Regards,
Cindy C.

Where would he sue the seller?, where the seller lives or where he lives?
The seller is 18 hours away by car.
He'd have to do some research. I'd say since the seller is the defendant, the plaintiff (buyer) could file right in his jurisdiction and then the burden is on the defendant to show up and defend his case.
If he's a no show then he is most likely in default and a judgment will be made w/o him and if it's in the plaintiff's favor then that judgment can attach to physical property as well as being a matter of public record.

None of that matters. You listed the ad, it's your responsibility to do it correctly. You have an legal obligation to sell the speakers to the buyer as the auction has closed and he won the auction. NOTHING else matters at this point.
Even eBay is telling you this auction is a done deal. They state, "With that being said, for your future reference", that means the next time you list something, not that you get a do over on this one.
Give the man his speakers and stop crying about your mistake.Political Correctness'.........defined

Ignorance of how e-bay works is NOT an excuse to default on a binding contract. Man up, fulfill YOUR obligation, which was completely within YOUR control, and chalk it up as a learning lesson. Why should the buyer have to suffer for your ignorance and incompetence? Why should e-bay have to get involved when the rules, instructions and values are easily understood if one take the time to investigate.
The buyer has no reason to suffer in this transaction.

Another thought....there is no guarantee of how many people will view any given auction and even less of a guarantee of how much money an item will sell for. You don't have a legal leg to stand on in a court of law or here under Club Polk law.Political Correctness'.........defined

Tringtrang,
You have been on e-bay since 2005 and have a feedback of 37; surely you aren't new to the whole e-bay thing. The situation is unfortunate in that you did something unintentional by posting incorrectly, but you have to honor the contract.
Like I stated ignorance is not an excuse when dealing with e-bay. Rules, how to's and values of prior sales is readily available on the internet. He won your speakers fair and square and he has a right to expect you to follow through as there was no "hanky panky" here."Appreciation of audio is a completely subjective human experience. Your problem is not his problem. Grow up and do the right thing.
If you can't figure out Flea-Bay's add posting, then you need not be selling. You put it up for auction...he won. Quit bitching. End of story.
In fact, I'm just gonna blurt it out. You sir, are part of Flea-Prey's problems. It's folks like you that make We-Pay a bad experience. What a shame.
