Police molested my SRT's on the way home!!!!

Does anyone have a wiring diagram for the internals of the Polk SRT system so i can check them when they get here in the morning? Or know someone i can call at Polk for it?

I flew my brother in law out to Cali to pick up a SRT system i just bought and in COLBY KANSAS they pulled him over for a suspicious looking vehicle, this is a new rental van from National Rental car by the way, then proceed to search the car. When the didn't find anything they called for backup and proceeded to take each speaker apart!!! **** **** HOLES!!!! Pulled the drivers out of the top units and the amp plated out of the subs. Needless to say two hours later they found nothing and let him go.

I couldn't be more furious right now!

I need a diagram so I can check the speakers when they get here.

I am praying they didn't scratch dent scuff or harm them in any way. I have lusted over these for years, and when I finally have the resources to buy my own and search what seems like forever to find a set in perfect condition this happens!

Thanks for any help,

Jonathon

If I am not mistaken, they are required to restore everything to the condition in which they found it. I would place a call to the local law enforcement agency.

    Oh trust me...
I have already talked to the head police guy on duty.

Depending on the condition of the speakers when they arrive will determine my course of action.

    It might be legal...

The drug dog didnt find anything before they took them apart.

a suspicious looking rental van seems weak to me..
The driver may have looked out of place, but that`s not a good enough reason to get pulled over...is somebody leaving some details out..?

Dont get me wrong, I have nothing against the police but this is out of control.

Same thing happened to the race team I was the crew chief for last year on our way to Daytona for the Rolex race, its a semi with sponsors on the side, with race cars inside, and tool carts, computers etc. kept the driver detained for hours.

    Ridiculous.

The key phrase here is probable cause....I'd say that they are weak in that department.

I'd also go out on a limb and say without a search warrant, they shouldn't have been taking anything apart.

Speaking to an attorney is probably NOT a bad idea.

    NOPE!

no details left out, pulled him over, questioned him for a minuit then started back to his car. turned around and came back and started asking questions about the boxes in the back, and it went from there.

Officer said it they have a lot of smuggling through there... whatever

    I will,

unfortunately in this day in age my company has to keep an attorney on retainer, I guess he will be doing some personal work for me soon.

BTW, he was one of the federal prosecuting attorneys for the largest drug bust in Oklahoma history before he returned to private practice.

You have to give them permission to search your car, was permission given and if so, WHY???

    WTH????!!!!

Man, that is a bunch of hooey. I hope your speakers get to you in fine shape and all ends well. If not, I'd be pissed.. er I mean you should be pissed and get them for damages.

I know how you feel... you get your new toy only to have someone spoil it for you. I remember getting a pair of $250 Armani sunglasses and my brother stepped on them the night I got them. Needless to say, I was angry.

The police aren't obligated to do anything for you. If permission was granted or probable cause was issued, good luck being angry.

The only thing that will get you satisfaction will be a lawyer and alot of money. Move on with your life....its just a speaker.

I do have to agree with Mark on this although it certainly wouldn't make me any happier than you. After the police conduct a search I don't believe they are responsible for clean up or putting things back they way they found them. I don't agree with this but...
I guess there is a lot of crap LEOs can get away with if they choose to do so.

    Due to the statement....

It really did become more than just a little bit overboard and ridiculous after this point. What did he think was being smuggled, diamonds?

Welcome to the new world order. I would get an attorneys advice. Was your brother black or Spanish? You may have been profiled by the police.

Sounds like a fascist police force.

Don't give up. This is noyt right.

    Well...

The cabinets are all scratched up, and the grill fabric is trashed, but I will take them apart tonight and check them out.

The attorney said they can search the vehicle, but taking them apart is a totally different story.

At this point I know the cabinets are going to be refinished and the grills recovered.

And as far as the cost to have this resolved with the police department, I don’t really care, I will be perusing them.

Denver to Kansas City I-70 is notorious for drug traffic, and the Colby/Goodland/Oakley/Hays locals get there share of busts, but tearing something up during the search is reason enough to persue the issue. Probably a long shot, but I'd raise hell, for my own peace of mind.

sorry but probable cause supercedes your speakers. It sucks, but they're doing their jobs. And no, they don't have to restore anything once they're done searching. But hey good luck with the inquiry. :)

IIRC, probable cause has its limits. Considering that they searched the vehicle and a dog sniff around and found nothing, I dont know if there would be merit to dig deeper like they did...check with a criminal lawyer. If it was a free for all, your brother would have been subjected to a cavity search too...

Look, based on what this guy is saying....there was no consent to search (I'm guessing your brother didn't tell them they could rip the speakers apart), there was no search warrant and there doesn't appear to be any probably cause other than a van with speaker boxes.

Yes, the police does have an obligation not to wreck your **** unneccessarily. It's your right protected under the fourth ammendment. It may require a lawyer but, if everything went down as you say, it's pretty cut and dry.

Maybe there's more to this than your brothers is saying. Maybe there was a good reason for the aggressive search. Don't take this personally, but maybe your brother is lying or withholding information. Maybe not. Talk to a supervisor of rank (Chief, Lieutenants, etc., not a Sergeant) and see what their side of the story is. Then move forward from there. You may have a case or maybe not. Did a drug give a positive hit on the car or your speakers? People use rentals to move drugs, so its posible some sort of residue or scent was lingering or maybe the person you bought the speakers from. In New York if a drug dog gives an alert for drugs on a car the police can search it and anything inside of it. Good luck.

good luck fighting the law John Cougar Melloncamp says it like it is. I have a friend who was served a warrent that had already been taken care of two years prior. They took his car half apart, took his suds out of the eclusure and busted the terminals off of one, and broke some of the trim in the car. He ended up getting a lawyer, and ended up 5 grand in the hole. But like I said, good luck.

I can assure you my attorney is very familiar with the rules for search laws, he was involved with a DEA task force prosecuting the largest drug bust in Oklahoma history.

I know my brother in law pretty well considering he is a superintendent for my construction company.
in my phone call with the attorney this morning he said they were way out of line.

The position of the Colby sheriff office is he used accessive acceleration leaving the rest area and mini vans are full of drugs all the time.
