^ If UPS fills the insurance claim they take the product. They have giant warehouses that hold all of their broken insurance items and have auctions from what I hear. The only way you are keeping those is if they deny the shippers claim and you work out something with the seller where you get a partial refund.

Probably best to do what others have advised but you could potentially keep the speakers, ask for a partial refund and try to repair the damage with the necessary parts from Polk. If the speakers are still in working condition, the situation is very salvageable and could save you a lot of time and trouble dealing with claims, shipping, etc. Of course, you shouldn't have to waste your time doing this but it could be better than dealing with UPS which WILL be an absolute pain. The whole situation is very unfortunate and I hope all ends well.

Just one more reason why I would never buy, nor sell large speakers through anything but a local pickup. Sorry to see this. The frickin seller should have packed them better. UPS is rough, but that type of damage only comes from poor packaging. All to common though. The others are correct. No way you can keep the speakers. Once UPS picks those up from you for inspection, you will never see them again. It either goes back to the shipper, or they settle the claim with the shipper and UPS keeps them. File your Ebay/PayPal claim immediately unless the seller agrees to a full refund. Tell her its between UPS and her now.

I bought these on eBay, using a PayPal account, charged to my credit card. So there are three levels of protection in play here. The seller says she is willing to give a refund, but let's wait a few days and see how UPS handles this. If it works out that I can get a damaged pair of LSi's for next to nothing so be it. If not , I will push ahead for a refund. There is already a dispute opened in PayPal and a long chain of emails and photo evidence. I have got time and quite frankly have already made a new home for my RTi system in the bedroom.

Also be aware that if you get your claim remedied through Paypal in almost all instances it requires you return the merchandise.

I know the merchandise is damaged, but why do you think you will get your money back and get to keep the product?

UPS will take the speakers if they pay the claim (but I can tell you from experience) you have ZERO chance of that since the seller didn't follow proper packing guidelines.

If Paypal refunds your money they will require you send the merchandise back to the seller and when she confirms via tracking, etc its back in her possession then Paypal will issue a refund.

If you want to keep the LSi's for "next to nothing" then you should have worked that out with the seller before filing the Paypal claim or prior to her filing the UPS claim.

They are back in UPS possession, it is now between them. She says she will issue a refund, guess I will find out soon enough. On the way home swung through Best Buy and made an impulse buy on a pair of BW 683. About the same price range as the LSi's and if I am unhappy with them there is a 45 day return period. Seems the 15's had a bit more clarity. Will give it a week or so and see if they grow on me.

I have been in this same situation (not with speakers, but poor packing). Looks like your end result is better then mine, and that your dealing with a mature seller. Good luck with the B&W's, I got a chance to hear a pair at a brick and mortar store and really liked them.

DO NOT FILE NEGATIVE FEEDBACK (Yet), and DO NOT DEAL WITH THE SELLER UNTIL YOU DO THE FOLLOWING:

Simply log into your eBay account and go to (top right) "My eBay" / "Summary"

Center left under "Buy", Click on "Won / Purchased"

To the far right of the item you purchased, click the down arrow beside "More actions"

    Click "Resolve a problem"

In the search box type "Received Damaged" (without the quotation marks) and click the "Search" button.

Scroll down the returned page until you see verbiage about shipping damage, click that link and file a claim.

You will want this documentation even with a stellar seller to insure this does not cost you a single penny.

After settled you will be able to cancel the claim if you were fully satisfied. Otherwise, eBay will give you a full refund, shipping and all.

Thank you for the advice all. A case is open, hopefully the seller lives up to her end. I am going to purchase a pair (from and authorized seller) new. I will run them against the BW's for a week or so and keep whichever sounds best. This whole thing started from a desire to have a full LSi rig, so will most likely go that route.

Update. Got a full refund from PayPal. The new LSi15's arrived direct from Polk on Tuesday. I returned the BW's to Best Buy for a full refund. My LSi setup is complete and life is good.

Nice to see you care George.

The OP already got replacements and his money back, but you would have to read the thread to understand that rather than jumping in the middle and making assumtions. You know what they say about ASSuming things, right George? As for the restoration of mine, they came out quite nicely, thanks for asking.

If you had read the entire thread, you would have also found this...
I would not accept it either in a perfect world, but given the choice of scrapping the speaker and loosing the money, or trying to save it, I would choose the latter. Obviously the best choice is to get his money back, and it is the only right thing for the seller to do in this case. All I am offering is a solution to the problem if other means of recovery fail, as they did in my case.

    Thanks for playing.

Big floor standers need to be shipped strapped to a palet! My Tyler Acoustic floor standers were double boxed with plently of foam (the stuff with gray plastic bag stuff around it). In addition since they each weighed 130 lb's, they had to be shipped via freight, they arrived in perfect condition and the boxes looked great. I went to the local Yellow truck depot and they used a fork lift to load them into the back of my truck.

I also understand that a lot of these shipping outfits charge no more then UPS.

I bought a pair of 25's from Polk two years ago and they sent them by freight, Conway i believe. I just purchased a pair of 15's from ebay and the seller shipped them UPS and of course I had this thread before my purchase thinking I hope that this doesnt happen to me. Long story short Im minus my left channel 15 b/c the grill broke in half and made some minor scratches on the front. So hopefully i'll have a new left 15 by next week?
